지하수법상 지하수의 통합적 구축에 관한 법제와 정책 연구

대체용수인「지하수법」의 목적은 지하수의 효율적인 관리 · 보전 · 이용 · 개발과 적정한 지하수의 개발 및 이용을 도모하고 지하수 오염을 예방하여 공공 복리증진에 이바지 하여야 한다(지하수법 제1조 제1항). 그리고 국가는 국민에게 양질의 지하수를 이용할 수 있도록 효율적으로 관리하고 보전하고 종합적인 계획과 합리적 시책을 마련하여야 한다(지하수법 제3조 제1항). 우리나라는 최근 기후변화로 인하여 가뭄이 지속적으로 증가하고 있으며 가뭄에 대비하기 위한 비상 대체용수의 개발수요가 급격히 증가하고 있는 상황에 놓여 있다. 대체 수자원으로서 지하수의 통합적 관리 운영체계를 구축하기 위해서는 지하수 관련 정보를 쉽게 파악할 수 있는 운영체계가 형성되어야 하고 지하수 효율적 활용을 위하여 국가가 적극적으로 검토하고 추진하여야 한다.
지하수의 통합적 관리를 위한 거버넌스 체계의 구축을 위한 가장 중요한 요건으로는 정부와 지방자치단체, 이해관계자들이 지하수 관련 정보를 상호 공유하고 소통하여야 하여야 하며 통합적 지하수 유지 · 관리 체계를 운영하기 위해서는 지하수 관련 전문가, 환경단체, 민간사업자 등 여러 이해관계자들이 정확하고 신속하게 지하수 관련 정보 시스템에 쉽게 접근할 수 있어야 하며 상호 연계된 지하수 관리 운영체계 구축이 무엇보다 중요하다고 할 수 있다. 따라서 통합적 지하수 운영 체계를 구축하는 데 여러 가지 문제점이 나타날 것으로 예상되므로 지하수의 통합적 관리를 위한 문제점과 해결방안을 연구할 필요가 있다.
본 연구에서는 수량과 수질을 포함한 지하수의 개념과 통합적 관리를 위한 지하수 거버넌스 구축의 필요성을 정립하고, 통합적 지하수 관리 체계 구축에서 나타나는 문제점과 이에 대한 해결방안을 제시하고자 한다. 따라서 통합적 지하수 관리 운영체계의 문제점과 해결방안으로 첫째, 지하수의 관련 법률과 업무 체계를 일원화하여야 한다. 우리나라는 각 부 · 처간 개별 법령에 따라 지하수를 관리하고 있어, 체계적 관리와 자료의 통합 · 연계에 어려움이 있다. 둘째, 지하수 폐관정의 관리를 위하여 주민들과의 협력이 무엇보다 중요하다. 실패공은 노후 관정 및 폐관정과 더불어 방치되는 경우가 많은데, 오염물질 유입으로 인근 지역의 지하수를 오염시키는 주요 원인 중의 하나이다. 오염된 지하수는 지표수에 비하여 수질을 복원하는데 오랜 시일과 노력이 필요하므로, 사용하지 않는 불용공(不用孔)을 원상 복구하는 등 지하수의 개발에서 사후조치에 이르기까지의 체계적인 관리가 필요하다. 실패공의 효율적인 처리를 위해 인력 및 예산이 부족한 시 · 군 · 구에서는 지역주민과의 협력체계를 구축하여, 준공검사를 비롯한 관할구역의 지하수 시설 관련 업무를 지원받는 방안이 필요하다. 셋째, 지하수 관리 재원의 확충과 활성화를 위해 지하수관리특별회계의 지하수이용부담금을 부과 · 징수하는 지자체에서는 지하수관리특별회계를 의무적으로 설치하도록 하고, 중앙부처 및 시 · 도는 운영의 적절성에 대한 관리 · 점검을 강화하여야 한다. 또한 지하수이용부담금의 활성화를 위해 지하수이용부담금 상한액 조정 및 부과 · 징수 대상을 확대하여야 한다. 넷째. 최적 대체 수자원 이용 계획 수립과 연계 활성화를 위해 한정된 수자원의 효율적인 활용을 위해 빗물, 하수 및 해수담수화 등 대체수자원 관련 기술을 지속적으로 개발하고, 대체수자원 시설 활용을 위한 세부규정을 마련할 필요가 있다. 더불어 물 분야 최 상위 법정계획인 국가물관리기본계획에서 건전한 물 순환 체계 구축을 위한 기본방향 및 목표를 설정하고 유역물관리종합계획에서 이를 구체화하도록 하여야 한다.
다섯째, 지하수의 국가 관측망 및 수질측정망의 체계적 통합운영을 위해 지하수의 수위 조사를 위한 국가 관측망과 수질 측정을 위한 수질측정망을 체계적으로 구축하여 관련 자료를 지속적으로 축적하고, 이에 대한 분석결과를 정책수립 과정에 활용하여야 한다.
The purpose of the Groundwater Act, which is an alternative water, shall contribute to the promotion of public welfare by promoting the efficient management, preservation, use, and development of groundwater, development and use of appropriate groundwater, and preventing groundwater pollution (Article 1 (1) of the Groundwater Act). In addition, the State shall efficiently manage and preserve high-quality groundwater to the people, and prepare comprehensive plans and rational policies (Article 3, Paragraph 1 of the Groundwater Act).
In Korea, droughts are continuously increasing due to recent climate change, and the demand for the development of emergency alternative water to prepare for drought is rapidly increasing.
In order to establish an integrated management and operation system for groundwater as an alternative water resource, an operation system that can easily grasp groundwater-related information should be formed, and the state should actively review and promote it for efficient use of groundwater.
The most important requirement for the establishment of a governance system for the integrated management of groundwater is that the government, local governments, and stakeholders share and communicate groundwater-related information. Therefore, since various problems are expected to arise in establishing an integrated groundwater operation system, it is necessary to study the problems and solutions for the integrated management of groundwater.
This study aims to establish the concept of groundwater including water and water quality and the need to establish groundwater governance for integrated management, and to present problems and solutions to them. Therefore, as a solution to the problems of the integrated groundwater management operating system, first, the relevant laws and work systems of groundwater should be unified. Since Korea manages groundwater according to individual laws and regulations between ministries and agencies, it is difficult to integrate and link systematic management and data. Second, cooperation with residents is of paramount importance for the management of groundwater waste wells. Failure balls are often left unattended along with old and abandoned wells, which are one of the main causes of contamination of groundwater in nearby areas due to the inflow of pollutants. Contaminated groundwater requires a long time and effort to restore water quality compared to surface water, so systematic management from groundwater development to follow-up measures such as restoring unused water. For the efficient treatment of failed balls, it is necessary to establish a cooperative system with local residents and receive support for groundwater facilities in jurisdiction, including completion inspections. Third, in order to expand and revitalize groundwater management resources, local governments that impose and collect charges for groundwater use of the special groundwater management account are obligated to establish a special groundwater management account, and central ministries and cities and provinces should strengthen their management and inspection. In addition, in order to revitalize the groundwater usage charge, the upper limit of the groundwater usage charge shall be adjusted and the subject of imposition and collection shall be expanded. Fourth, it is necessary to continuously develop technologies related to alternative water resources such as rainwater, sewage, and seawater desalination for efficient use of limited water resources to establish and activate optimal alternative water resources. In addition, the National Water Management Basic Plan, the highest legal plan in the water sector, shall establish basic directions and goals for establishing a sound water circulation system, and shall be embodied in the comprehensive plan for watershed management.
