아파트 단지 출입구 및 통행로의 주정차행위 단속을 위한 도로교통법 개정안에 대한 소고 = A Juridical Study on Amendment to the Road Traffic Act about Traffic Enforcement on Parking the Vehicles at an Angle at the Entrance and Passageway of the Apartment Complex

다국어 초록 (Multilingual Abstract)

Police officer or officer in City Hall can not take any action when a driver is blocking the passage of residents’ vehicles by parking the car at an angle at the entrance of the apartment complex or on the passageway in the complex. This is because it does not fall under ‘road’ under the Road Act or the Road Traffic Act.
Police Officer may issue an order to move or change the parking method to a driver of an illegally parked vehicle. Otherwise, the police officer may move or change it himself in accordance with article 35 of the Road Traffic Act. But in order to take these measures, the place must be a ‘road’ under the Road Traffic Act. ‘Road’ in the Road Traffic Act means not only a road under the Road Act, but also an open place where an unspecified number of people or vehicles can pass freely. However, the above place is not a place where an unspecified number of people or vehicles can pass freely, so it is not a ‘road’ under the Road Traffic Act. And police officers cannot take the above measures, They just can apply the Criminal Law of general traffic obstruction.
Article 185 of the Criminal Law punishes “a person who damages or obstructs a land road, waterway, or bridge, or obstructs traffic in other ways” for the offense of obstructing general traffic. The criminality depends on whether the place is land road or not. Land road means a public place where an unspecified number of people or vehicles can pass freely, so the above places do not fall under this category and cannot be punished as a general traffic obstruction crime. In the end, it can only be punished as obstruction of business in the sense that it interfered with the work of the apartment management office or security guard. However, the action that apartment residents want is to secure safe and smooth traffic at the site, not post criminal punishment.
This is why the definition of road by the Road Traffic Act must be reinterpreted. For this purpose, I used 3 interpretation methodologies, namely historic, grammatical and teleological interpretation method. As a result of this analysis, it’s found reasonable to interpret the concept of ‘road’ in the Road Traffic Act as a place for the passage of unspecified or a large number of people or vehicles as a place where it is necessary to secure safe and smooth traffic realistically. However this leads to burden of expenses. For this reason, I propose to insert a provisoclause in the article No-Parking Zone as an amendment to the Road Traffic Act.
