시각장애인의 선거정보에 접근할 권리에 관한 헌법적 고찰 - 헌법재판소 2014.5.29. 2012헌마913 결정에 대한 비판적 검토를 중심으로 - = A Constitutional Study on the Right to Access the Election information of the People with Visual Disabilities

The Interest in the Interest in the voting rights people with disabilities is increasing, due to the opportunities for social participation of the people with disabilities are expanding and continuous efforts to ensure their rights. The right to vote is a necessary right for individuals to become upstanding members of the community and establish themselves as a community. This article critically reviewed the Constitutional Court`s decision on the constitutionality of the clause related to the duty to print campaign brochure in braille. The Constitutional Court did not separately decide on the right to access electoral information, which constitute part of the voting rights. However, the right to access electoral information should be considered more important, especially considering the fact that it is more important for people who have access to the right to vote, especially those who find it difficult to learn more about information acquired through regular media. The clause allows the candidates the margin of discretion whether to print the campaign brochure in braille or not. It is to respect the candidates` freedom to decide how they design their election campaign and to reduce the financial burden of the government. While the aim itself can be justified, the clause is still unconstitutional because it breaches the fundamental right of the visually disabled voters by unfairly depriving them of their way to access information on election. It is also important to note that the duty to print campaign brochure in braille does not guarantee the right to access the election information for the People with Visual Disabilities. Even if a compulsory provision were introduced, obstacles such as lack of printing facilities and social consent would remain. It has to be noted that not all persons with visual impairment can read braille. Various efforts are needed to enable the people with disabilities to exercise freely and to become members of society.
