토석채취에 따른 환경문제에 관한 법적 고찰

본 연구는 최근 문제가 되고 있는 골재공급의 부족과 골재채취로 인한 환경문제에 관하여 고찰하였다. 골재수급 분야는 건설과 환경 분야의 연구대상이지만 제도적으로는 법학의 영역임에도 이에 관한 법실무적 연구가 부족한 상황이다. 이런 관점에서 세 가지 측면으로 분석하였다. 첫째, 골재채취 절차에 관하여 골재채취법의 내용을 정밀하게 분석하였다. 시행령과 시행규칙과의 세부적인 관련성을 종합하여 체계적으로 정리한 기존 자료가 없으므로 이에 대한 작업을 선행하였다. 관련 법규의 내용 파악이 우선되어야 제도적 문제점과 개선방안을 찾을 수 있기 때문이다. 둘째, 현재의 골재채취 현황과 골재수급 실태를 정리하며 산림골재 자원의 현황을 파악하였다. 현재 상황에 미루어 장래 문제를 예측할 수 있기 때문이다. 셋째, 골재 채취로 인한 전반적인 환경문제를 살피고 산림골재 채취로 인한 문제로 초점을 맞추어 제도적인 개선방안을 정리하였다. 제도적 개선방안으로는 허가요건을 개선하여야 한다. 5만㎡ 미만으로 토사를 굴취 · 채취하는 경우 산지관리위원회의 심의에서 제외되는 예외 기준을 강화하여 재량권의 남용을 막아야 한다. 채석단지를 지정할 경우 환경영향평가제도가 부실하게 운영되는 경우가 많아 문제가 된다. 환경영향평가제도의 내실을 기해야 한다. 골재채취 후 원상복구가 되질 않아 발생하는 환경 피해는 인근 지역주민의 피해와 직결된다. 따라서 채석이 완료된 지역의 환경보전을 위해서는 복구가 우선 중요하다. 하지만 복구가 어렵거나 지연됨으로써 발생하는 피해도 크므로 복구 전에 산업용지 등 다른 용도로 활용이 가능한지의 여부를 판단한 후 복구 유무를 결정하는 것을 고려하여야 한다. 이에 따라 토석채취허가시 예치하는 복구비의 일부를 타용도로 전환하는 데에 필요한 조사비용으로 사용할 수 있도록 허용하는 것도 하나의 방법이 되겠다. 그러나 무엇보다 순환골재의 활용을 확대하여 모래와 자갈에 의존하던 기존의 골재공급원을 친환경적으로 바꾸는 것이 근본적인 해결방안이다.

Therefore, this study focuses on three things. First, the aggregate extraction procedure was analyzed in detail through the Aggregate Extraction Act. Since there is no existing data systematically summarizing the detailed relevance of the Enforcement Decree and the Enforcement Regulations, the work on this was preceded. Second, the status of current aggregate extraction and aggregate supply and demand are summarized and the status of the mountainous aggregate resources is identified. Third, it reviewed the overall environmental problems caused by the mountainous aggregate extraction and focused on the problems caused by the collection of forest aggregates. As institutional improvement measures, first, permission requirements should be improved. The exceptional criteria excluded from the deliberations of the Mountainous District Management Committee should be strengthened to prevent the possibility of abuse of discretion. However, there may also be a problem of delays in permitting or aggregate extraction work. Therefore, it is desirable to apply the period flexibly differently according to the classification by type, size, etc. of mountainous districts prescribed by Presidential Decree than to define the deliberation period of the mountain management committee as a uniform 30-day period. In the case of the Mountainous District Management Committee, it will be more expeditious to facilitate the operation of the subcommittees. Second, if the Stone Collection Complexes is designated, the environmental impact assessment system will often operate poorly. Therefore, the environmental impact assessment system should be enriched. Third, since the recovery of the aggregate extraction is not done properly after the collection of the aggregate, the environmental damage caused by it is directly related to the damage of the residents in the neighborhood. Therefore, for the environmental preservation of the quarried area, quick restoration is most important. However, since damage caused by difficult or delayed recovery is large, it should be judged whether or not it can be utilized for other purposes such as industrial paper before recovery. It would therefore be a good idea to allow some of the money for restoration to be used for the necessary investigation costs. But most of all, it is a fundamental solution to expand the use of recycled aggregate and to change the existing aggregate supply source that is dependent on sand and gravel to environmentally friendly.
