Most accounts of the origins of racial segregation in the United States have focused on the renewed system of white supremacy that took shape in the south following the abolition of slavery. The persistence of variegated forms of racial segregation long after the demise of Jim Crow, however, point to the necessity of examining segregation’s roots from a broader and longer-term historical perspective. Elements of racial segregation already began to emerge with the growth of settler societies and institutions in pre-revolutionary North America, but it was with the founding of the United States that these elements hardened into systemic constraints on the mobility and settlement of non-white persons. The driving force behind this transformation was white Americans’ tireless pursuit of free mobility as a racial privilege, underpinned by institutional support at every level of governance. While segregation of both black and indigenous populations became deeply entrenched not just at the national but also state and local levels of state formation, thus making it extremely difficult to eradicate with subsequent reforms, there were also notable differences in the specific forms of segregation that came to constrain the two groups.
In restricting the movement and settlement of black people, local institutions and practices played a critical role, as the broad application of police power and poor laws seamlessly bridged customary acts of discrimination with localized control of mobility. State governments buttressed local communities’ efforts by passing so-called black laws discouraging black in-migration, while national leaders’ promotion of black expatriation, accompanied by racial discourse defining black people as a threat to white society, helped legitimize local-level discriminatory practices. Consequently, not only in the south but also in many parts of the north, micro-level segregation in residence, education, and public facilities became firmly entrenched in the early national period. While segregation targeting indigenous peoples also stemmed from white Americans’ bottom-up insistence on racial privilege, the powerful resistance of Indian nations quickly made it clear that settler communities could not realize their goal of free movement into indigenous lands without state support. State governments responded by asserting territorial sovereignty, thereby conferring legal status on the frontier settlers’ often dubious land claims, and redefining their lawless violence against indigenous peoples as patriotic acts in defense of the state. The federal government, with increasing success, strove to break up Indian nations and confederations, confining them to isolated tribal possessions and rendering them dependent on federal authority. This spatial segregation, which powerfully underpinned the settlers’ violent colonial expansion, was portrayed by the national government as a humanitarian act protecting indigenous peoples from inevitable and destructive clashes with white settlers, and thus legitimized, went on to form the bedrock of U.S. territorial policy.
미국 인종분리의 기원에 대한 논의는 통상 남북전쟁-노예해방 이후 남부 사회에 자리잡은 백인우월주의 체제에 집중되어 왔다. 그러나 짐 크로우(Jim Crow) 체제가 해체된 후에도 미국 사회에서 다양한 형태의 인종분리가 지속되어 오고 있다는 점을 설명하려면, 보다 길고 넓은 역사적 맥락 속에서 그 기원을 파악할 필요가 있다. 인종분리의 요소들은 북미에 유럽계 정착민 중심의 사회와 제도가 성장하는 과정에서 이미 조금씩 형성되기 시작했지만, 특히 미국 건국과 더불어 백인들이 인종적 특권으로서 이주의 자유를 적극 추구하고 여러 층위의 공권력이 이를 뒷받침하면서 비백인들의 이동과 거주에 대한 광범위한 제약으로 구체화되었다. 흑인과 원주민에 대한 인종분리의 기반은 공히 지역 사회, 주 정부, 연방 정부 차원에서 다층적으로 형성되었고 그렇기에 후대의 어떤 개혁으로도 뜯어고치기 힘든 영속성을 가지게 되었는데, 구체적인 차별의 방식에서는 중요한 차이도 나타났다.
흑인들의 이주-정착을 통제하는 데에는 치안과 구빈 제도를 활용하며 백인 주민들의 관행적 차별을 공권력과 긴밀히 연계하는 지역 사회 차원의 인구통제가 중심적인 역할을 하는 가운데, 흑인들의 이주-정착을 제어하는 주 차원의 흑인차별법, 흑인들을 백인사회에 대한 위협으로 간주하는 연방 차원의 담론과 흑인송출사업이 지역화된 차별에 힘을 실어주었다. 그 결과 남부 뿐 아니라 북부에서도 흑인들이 백인과 동등한 주거, 교육 환경과 공공시설을 누리지 못하게 하는 미시적 인종분리가 건국기부터 확고히 자리잡을 수 있었다. 원주민들에 대한 인종분리 역시 출발점은 백인사회 아래로부터의 인종차별 욕구였으나, 지역 단위 공권력만으로는 내륙 원주민들을 효과적으로 제압하며 정착민들의 자유로운 침투와 정착을 도모하기 힘들다는 것이 곧 분명해졌다. 그렇기에 건국기에 주 정부들은 영토적 주권 천명을 통해 정착민들의 불안한 사법적 입지를 해소하고 그들의 대원주민 폭력에 애국적 정당성을 실어주며 지원하였고, 연방정부는 원주민 정치체들을 작게 분열시켜 협소한 공간에 몰아넣고 오로지 미국 연방정부에만 의존하는 개별적 집단들로 격하시키려 노력했다. 연방정부는 정착민들의 폭력적 식민팽창을 거들어주는 이런 정책이 백인과 원주민 사이의 불가피한 분리를 위한 인도주의적 조치라 정당화하며, 인종분리를 미국 영토-인구 정책의 자연스러운 일부분으로 고착화시킬 수 있었다.
