자율주행자동차 사고시 법적 쟁점에 관한 연구 = A Study about Legal Issues as to Accidents of Autonomous Driving Vehicle

자율주행자동차(Autonomous Vehicle)는 “운전자 또는 승객의 조작 없이 자동차 스스로 운행이 가능한 자동차”로서 주행환경을 인식하여 자동차 스스로 운행하는 자동차를 말한다. 주요 자동차 제조 선진국인 미국, 영국, 독일 등은 최종적인 시험을 하고 있으며, 우리나라는 2016년 2월에 “자율주행자동차의 안전운행요건 및 시험운행 등에 관한 규정”을 마련하고 이 규정에 따라 각 제조업자들 및 연구기관들이 낮은 자율주행 수준부터 높은 수준의 자율주행자동차를 시험적으로 운행하고 있다.
우리나라 및 외국의 글로벌 자동차 업체와 IT업체들이 목표로 하는 자율주행자동차의 상용화는 2020년이고, 이에 맞추어 자율주행기술을 개발하고 있으나, 완전한 자율주행이 가능한 자동차의 상용화는 2030년 이후 가능할 것으로 보이며, 그 이전에는 일반자동차와 자율주행자동차가 혼용되어 사용될 것이다. 이런 측면에서 볼 때, 인간이 자동차의 조향장치를 지배하여 운전하는 자동차는 운전자 개인의 과실에 따라 법률적 책임이 주어지고 현재의 법체계(도로교통법, 자동차관리법, 자동차손해배상보장법)에 따라 그 책임을 부담하면 되나, 인간의 지배 없이 운행되는 자율주행자동차로 인한 사고는 현행 법률의 적용에도 한계가 있다. 예컨대 자율주행자동차의 경우 제조상의 결함 또는 설계상의 결함으로 인한 사고 발생 가능성이 있으나, 이러한 결함에 대한 사고원인 규명에 많은 문제와 어려움이 있는 만큼 제조물책임법을 어떻게 적용할 것인지도 문제가 된다.
자율주행자동차는 인간에게 편의성과 안전성을 제공할 것으로 예상되나, 그 이면에 발생 가능한 위험에 대해 충분한 검토가 필요하다. 위험요소를 예측하여 사고 예방과 손해의 감소 및 피해자에 대한 구제방안 등이 최우선적으로 마련되어야하기 때문이다.
본 논문은 자율주행자동차와 일반자동차와의 차이점 등을 규명하고 앞으로의 발전 단계를 살펴보고, 자율주행자동차의 도입에 따른 사회적 변화와 자율주행자동차로 인한 사고 유형 등을 검토한 후 이에 대한 법적 책임부담, 그 책임에 따르는 새로운 법률의 제정과 관련보험의 변화 가능성을 논의하고 손해사정 실무경험을 통한 방향성을 제시하고자 하며, 더불어 자율주행자동차와 관련한 논의가 정부, 국회, 제조사를 포함한 관련 연구단체 등에서 다양하게 이루어져야 함을 제시하고자 한다.
Autonomous Vehicle is a “vehicle that is capable of sensing its environment and navigating without human input” as it can drive on its own without driver’s or passenger’s mechanical handling.
U.S., England, and Germany, major developed countries in manufacturing automobiles are undergoing final inspection, whereas Korea established “The Regulation on Safety Driving Requirement and Test Run for Autonomous Vehicles” on Feb. 2016 and in accordance with this regulation, automobile manufacturers and research institutes are test-driving from low-level autonomous vehicles to high-level ones.
The target year for commercialization of autonomous vehicles that Korean and foreign global automobile manufacturers and IT companies are aiming at is 2020, and to achieve this, they are developing autonomous driving technology, but the commercialization of autonomous vehicles that are fully autonomous is expected to be possible only after 2030. Before that year, regular engine- operated cars and autonomous vehicles will be mixed. In this respect, if a driver controls the steering apparatus in driving a car, the driver him/herself assumes legal responsibilities according to the person’s fault and the responsibility can be burdened in accordance with the current legal system (Road Traffic Act, Automobile Management Act, and Automobile Accident Compensation Security Law), but if an accident occurs by the autonomous vehicles driven without human control, there is a limitation in applying the current legal system. In autonomous vehicles, for example, an accident can occur due to manufacturing or design defects, but there are many problems and difficulties in investigating the cause of the accident resulting from such defects. Thus how to apply the Product Liability Act can be the problem.
Autonomous Vehicles are expected to provide humans with convenience and safety, but there is an element of danger involved. Thus sufficient review is required. Accident prevention, damage reduction, and relief of victims must be considered as top priority by predicting the potential risk factors.
This paper aims to identify the differences between autonomous vehicle and regular engine-operated car and look at the future development stages, review the social changes after introducing the autonomous vehicles and types of accident caused by such autonomous vehicles, discuss relevant legal responsibility, establishment of new laws to bear the responsibility, and possibility of change in related insurances, and provide directions through hands -on experience with adjustment of damage. At the same time, it aims to suggest that the matters on the autonomous vehicle need to be discussed in various ways among the government, the assembly, manufacturers, and related research institutes.
