디지털시대 방송법제 정비의 방향과 과제 = Direction and Problem of Fixing Broadcasting Rules and Regulations in the Digital Age

This article aims at examining the need of revising rules and regulations concerning digital broadcasting that are under discussion in these days and, for that purpose, at investigating foreign law-making examples and directions and problems when altering them.
The paradigm of our society has already changed from analogue to digital. But, most broadcasting rules and regulations have been made suitable for the analogue age and do not reflect the realities. Considering new broadcasting formats such as digital broadcasting, there is an enormous gap between the rules and regulations and the realities.
Recently, our broadcasting environment has undergone so radical changes that it is hard for us to grasp the speed and directions of them. A new broadcasting law integrating every existing rules and regulations such as Comprehensive cable broadcasting law, Cable broadcasting management law, Korea Broadcasting System law is enforced on January, 2000, but this law does not cope with the rapidly changing trend of the broadcasting circumstances.
This law was made in a scissors and paste method as a result of power struggle among political parties and interest groups, so the need for revision is rising. And as the law has a lot of loopholes, norms applicable to the new technological media in the broadcasting field should be prepared as soon as possible. This necessity casts us a task of fixing the rules and regulations related to broadcasting that are the foundation of the broadcasting system without delay.
Taking account of the analytical results of our broadcasting realities and evaluating merits and demerits of them, we should try to secure social reasonability concerning a digital broadcasting regulatory institution which can affect the future of our nation and to find out the most appropriate alternative for the benefit of the people and the country's industries.
In this article, after raising a need to fix broadcasting rules and regulations and examining foreign law-making examples, I investigate directions and problems in revising them.
