재판의 전제성에 관한 헌법재판소 결정에 대한 헌법적 고찰 = A Constitutional Consideration of the Korean Constitutional Court’ Decision concerning preconditional relevant to the underlying case

The court requires the preconditional relevant to the underlying case when it proposes an unconstitutional legal trial or when the claimant requests an unconstitutional review type constitutional appeal because of the characteristics of the specific normative control system. Preconditional relevant to the underlying case means that, first, a specific case must have been or is pending in the court, second, the law in question as to whether it is unconstitutional must apply to the trial of the litigation case, and third, this means that the court in charge of the litigation case decides differently depending on whether the Act is in violation of the Constitution. A trial with a different content refers to a case in which the order of trial is different or the legal meaning of the content and effect of a trial is different depending on whether the trial is unconstitutional. The Constitutional Court of Korea is an exception to the preconditional relevant to the underlying case. First, if there is an internal relationship between directly applied legal provisions and indirectly applied legal provisions, second, if a retrial can be requested, and thirdly, objective protection and maintenance of constitutional order and cases where a trial is necessary for the relief of the rights of the parties concerned. If the Constitutional Court broadly recognizes the exception to the preconditional relevant to the underlying case, it will examine the provisions of the law that do not apply to specific litigation cases, thereby undermining the essence of the specific normative control system and excessively exercising the normative control of the Constitutional Court. In other words, the Constitutional Court can exercise the right to normative control that are not based on the Constitution, thereby violating the principle of separation of powers.
In determining the preconditional relevant to the underlying case, the Constitutional Court in principle respects the legal opinion of the requesting court, but as an exception, when the legal opinion of the requesting court on the preconditional relevant to the underlying case cannot be maintained, the Constitutional Court ex officio can be investigated, so it directly determines whether the underlying case is preconditioned. Looking at the case where the legal opinion of the requesting court regarding the preconditional relevant to the underlying case cannot be maintained, it is not the case where the entire legal opinion of the requesting court is problematic and difficult to accept, but rather a case where the requesting court made a request by misunderstanding the legal provisions applicable to the case.
Looking at the decisions related to the preconditional relevant to the underlying case made by the Constitutional Court of Korea, it is not the case that the order of trial or the legal meaning of the content and effect of trial does not change depending on whether the relevant statutory provision is unconstitutional. There are often cases where there is not preconditioned relevant to the underlying case because the relevant statutory provisions do not apply to the trial of the relevant case. In addition, in a case belonging to the legal relation of civil law, the judgment on the validity of the legal relation of civil law is a matter for the court to decide in an private case, and therefore the order of the trial of the case changes depending on whether the relevant statutory provision is unconstitutional. Because it is difficult to judge, there are cases where the preconditional relevant to the underlying case is not satisfied.
