꿈의 해석으로서 공판절차와 회복적 사법으로의 발전에 대한 법정신분석학의 접근 - 영화 <더 헌트> 속 아동성추행 무고 사건을 소재로 하여 - = Criminal Justice System as the Interpretation of Dreams and Its Development Towards Restorative Justice - Using the Film <The Hunt> as a Case Study -

The film 'The Hunt' tells the story of a man falsely accused of child molestation. In this film, we witness a witch hunt driven by mass hysteria against one man, the limitations of rational law that proved powerless in the face of this hysteria, recovery through spirituality, and the scars that nevertheless remain. This paper aims to expand on these themes through the approach of law and psychoanalysis. Through psychoanalytic examination of the witch hunt against a person falsely accused of child molestation, it discusses how reality can be constructed like a dream from the unconscious (II), and argues that in legal cases where unconscious dynamics operate strongly, judicial procedures should be therapeutic and restorative in understanding the unconscious (III). To achieve such judiciary, it must transcend its identity that remains formal and rational, and dream of 'restoration of its wholeness' that communicates with emotions and the unconscious. Through procedures that restore wholeness, a community once gripped by irrational madness can achieve the restoration of reason through the conscious awareness of the unconscious, rebuild itself on the foundation of truth, and only through such process can true recovery for victims be achieved. Finally, this paper presents a new vision of the judge who enters the unknown realm of the unconscious, explores the unconscious of litigation participants together, as an evolved version of Dworkin's 'Judge Hercules' (IV). Through these discussions, this paper argues that in crimes where unconscious fantasies strongly operate, community recovery beyond simple guilty/not guilty verdicts is necessary for victim’s recovery, and while judicial procedures cannot complete this recovery alone, they need to develop in ways that contribute to it. The paper examines how the interdisciplinary approach of law and psychoanalysis can contribute to this development.
