한국 아동ㆍ청소년 인권실태 연구Ⅳ = 한국의 유엔아동권리위원회 국가보고서 권고사항 이행실태

국문 초록 (Abstract)

이 연구에서는 2011년 유엔아동권리협약 제44조에 따라 제출된 국가보고서 심의결과 권고사항에 대하여 우리나라에서 현재 어느 정도 이행하고 있는 가를 사전에 점검하여 문제점을 파악하고 개선방안을 제시함으로써 향후 국가보고서 권고사항 이행 수준을 높이고 2017년에 제출해야 할 국가보고서의 작성에도 도움을 주고자 하는 목적에서 수행되었다.
교수 및 아동?청소년 인권단체 전문가로 집필진을 구성하여 인권영역별로 관련 내용을 집필하였다. 2014년 4월 2일~10월 30일 사이에 유엔아동권리위원회 국가보고서 권고사항 이행사항 점검계획 수립, 집필사항 검토, 자료 수집 및 검토, 초안 작성 및 검토, 수정안 검토 등 4차례의 오프라인 모임과 수차례의 온라인 협의 과정을 거쳐서 수행되었다. 유엔아동권리위원회의 국가보고서 이행 권고사항을 일반이행조치 및 일반원칙, 시민권과 자유, 가정환경 및 대안양육, 장애, 기초보건 및 복지, 교육, 여가 및 문화활동, 특별보호조치의 6개 영역으로 분류하였으며, 영역별로 주요 권고사항에 대하여 이행현황을 분석하고 향후 이행을 위한 개선방향을 제시하였다.
유엔아동권리위원회의 권고사항 이행을 위해서 아동정책조정위원회가 상설화 및 정상화, 국가인권위원회 내에 아동권리 관련 전문가 배치, 아동권리 모니터링 업무를 전담하는 부서 또는 아동권리 전문위원회 설치, 아동예산의 국고보조사업으로 환원, 아동?청소년관련 법에 아동이익 최우선의 원칙 명시, 저소득 아동의 의료서비스 전담 기관 지정, 아동청소년 의료서비스 전담 거점 기관 선정, 현행 경쟁중심의 고등학교 입학제도에 대한 재검토, 아동청소년 친화적인 시설 공간 확충, 소년전문법원설립 등의 과제가 제안되었다.

다국어 초록 (Multilingual Abstract)

The objective of this study is to contribute to the enhanced implementation of the recommendations of the United Nations Committee on the Rights of the Child and to the preparation of the State party report due in 2017 by reviewing the status of the implementation of the recommendations on the State party report submitted in 2011 pursuant to Article 44 of the United Nations Convention on the Rights of the Child, identifying issues to be addressed, and proposing ways to improve the level of implementation.
The study was conducted with the participation of professors and experts specializing in the rights of the child and youth, who reviewed the implementation status according to the different areas of human rights. During the period between April 2 and October 30, 2014, 4 offline meetings and numerous online consultations were held to establish a plan to review the implementation of the Committee recommendations, determine the content of the outcome paper, collect and review data, prepare and review a draft, and review the final draft. The Committee recommendations were divided into 6 categories: General Measures of Implementation and General Principles; Civil Rights and Freedoms; Family Environment and Alternative Care; Disability, Basic Health and Welfare; Education, Leisure and Cultural Activities; and Special Protection Measures. The authors studied the status of the implementation of the main recommendations under each category and presented a number of proposals to raise the level of implementation.
The proposals include the regular and normal operation of the Child Policy Coordination Committee, posting children’s rights experts to the National Human Rights Commission of Korea, establishing a department dedicated to monitoring the implementation of children’s rights or a special committee on children’s rights, reinstating children’s programs as the services subsidized by the state, clearly stating the principle of the “best interests of the child” in children- and youth-related legislation, designating organizations dedicated to medical services for low-income children, designating key organizations dedicated to medical services for children and youth, reviewing the current competition-based high school entrance system, expanding children- and youth-friendly facilities, and establishingaspecializedjuvenilecourt.
