법관에 관한 연구 중, 특히 법관의 신분과 법적 지위에 관한 연구는 우리 헌법이 담고 있는 법관의 독립뿐만 아니라 사법부 내에서의 법관의 위상, 국민의 사법부에 대한 신뢰 및 좋은 재판과 밀접한 관련성이 있는 연구소재(素材)이다. 법관은 재판을 통해 국민의 권리를 보장하고, 헌법적 가치를 실현해야 하는 책무를 진다. 이러한 법관의 책무는 법관의 독립성이 보장되는 경우에만 달성 가능한 것이다.
독일 법관법은 1961년 9월 8일에 제정되어 현재까지도 운용되고 있는 법률로서, 이 법의 근본이념과 실현목표는 법관의 신분과 법적 지위의 보장을 통한 법관의 독립성 보장이다. 따라서 독일 법관법이 규정하고 있는 법관의 신분과 법적 지위에 관하여 종합적이고 체계적인 방식으로 연구할 필요성이 있다.
독일 법관법이 규정하고 있는 법관의 직무관계의 형성과 변경 및 종료, 법관의 복무내용, 법관에 대한 직무감독, 법관의 신분과 법적 지위를 보장하는 직무법원의 관할 사항과 역할, 법관의 의무의 유형과 그 내용, 법관징계, 법관대표기구를 통한 법관의 사법행정 참여 등에 관한 사항은 법관의 독립성 보장이라는 대원칙에 기반하고 있으며, 이 원칙에 부합될 수 있는 방식으로 규정되어 있다.
특히 독일 법관법은 직무감독권의 행사한계로서의 법관의 독립성을 명확히 하고, 법관에게 불이익한 처분을 적어도 법관의 자발적인 의사에 기반한 동의 또는 법원의 사법절차를 통하도록 하고 있다. 그리고 법관의 단축근무와 휴직을 법관의 권리적 측면에서 보고 있으며, 또한 직무법원을 설치하여 법관의 신분과 법적 지위 및 법관의 독립성에 영향을 주는 직무감독 처분, 기타 복무관계에 기반한 직무감독권자의 고권적 행위에 대하여 다툴 수 있는 폭을 획기적으로 넓히고 있다. 더 나아가 독일은 독일 법관법과 법원조직법을 통하여 법관 대표기구의 참여에 의한 사법행정을 보장하여 소수의 독점에 의한 사법행정을 원칙적으로 차단함으로써 사법행정의 공정성과 투명성을 확보하고 있다.
이 연구보고서는 독일에서의 법관의 신분과 법적 지위에 관한 가장 핵심적이고 포괄적인 내용을 담고 있는 독일 법관법의 주요 조문들을 바탕으로 한 이론적 논의와 실제 사례가 연구내용의 중심을 이루고 있다. 한편 독일 법관의 신분과 법적 지위에 관한 더 체계적이고 깊이 있는 연구를 위하여 독일 연방기본법과 법원조직법, 각 주의 헌법과 법관법 뿐만 아니라, 이와 관련된 기타의 법령 등도 연구내용의 상당 부분을 차지한다.
다만 이와 같은 연구 방법만으로는 독일에서의 실제 사례와 현황을 제대로 파악할 수 없으므로 독일 법관과 관련된 설문조사, 통계, 뉴스 기사 등도 참고하여 독일 법관의 신분과 법적 지위에 관한 다양한 사항들을 종합적이고 체계적인 방식으로 연구하였다. 더 나아가 독일 법관법이 직접 규정한 사항은 아니지만 독일 법관의 신분과 법적 지위에 관련된 사항, 예를 들어 외부에 의한 법관평가, 법원운영위원회를 통한 사무분담 및 독일 법관단체인 독일 법관연합의 활동 등에 관한 사항도 연구의 대상으로 포함하였다.
법관의 신분과 법적 지위의 강화는 법관의 독립성 확보를 통한 좋은 재판을 실현함으로써 국민의 사법 신뢰도를 제고하는 것에 끝나지 않는다. 이는 종국적으로는 국민의 자유와 권리의 보장에 기여하는 것이다. 따라서 법관의 신분과 법적 지위의 강화는 사법부만이 아닌 국회와 정부 및 사법 유관 단체 등이 법관의 의사에 기반하여 공동으로 추진해야 할 목표이다.
Among the studies related to the judiciary, studies on the status and legal position of judges are research materials that are closely related to the independence of judges in the Korean Constitution, as well as the status of judges within the judiciary, people's confidence in the judiciary, and good trials. Judges are responsible for ensuring the rights of the people through trials and realizing constitutional values. These responsibilities can only be achieved if the independence of judges is guaranteed.
The German Judiciary Act (Deutsches Richtergesetz), which was enacted on September 8, 1961, and currently remains in force, aims to secure the independence of judges by guaranteeing the status and legal position of judges. Thus, it is necessary to make a close study of the status and legal position of judges stipulated in the Act in a comprehensive and systematic way.
Matters prescribed by the German Judiciary Act, such as the formation, change, and termination of job relations for judges, the contents of their services, supervision of judges, the jurisdiction and role of the service court which ensures the status and legal position of judges, types and details of the obligations of judges, judicial discipline, and the participation of judges in judicial administration through the judicial representative body are based on the grand principle of guaranteeing the independence of judges, and laid down in a way that can be consistent with this principle.
In particular, according to the German Judiciary Act, the independence of judges are clarified as a limit on the exercise of supervisory authority and the unfavorable disposition of the judges are required to be made at least based on consent derived from the judge's voluntary will or judicial proceedings rendered by the court. Also, shortened working hours and leave of absence are viewed in terms of the rights of judges, and with the establishment of a service court, the scope of the supervisory disposition that affects the status and legal position of judges and the independence of the judges, and disputes over high-powered acts of the job supervisor based on other service relationships, has been widening dramatically. Furthermore, in Germany, fairness and transparency of judicial administration have been secured by ensuring the participation of the judicial representative body through the German Judiciary Act and the Court Organization Act thereby barring judicial administration controlled by a few monopolies.
This research focuses on theoretical discussions and actual cases based on the main provisions of the German Judiciary Act, which contains the most essential and comprehensive information on the status and legal position of judges in Germany. Furthermore, the research covers the Basic Law for the Federal Republic of Germany, the Court Organization Act, the constitutions and judiciary laws of each state, as well as other related laws and regulations for a more systematic and in-depth study on the status and legal position of German judges.
However, since it is difficult to properly grasp the actual cases and current situation in Germany with the aforementioned research method alone, various matters related to the status and legal position of German judges are reviewed in a comprehensive and systematic way by referring to surveys, statistics, and news articles related to German judges. Furthermore, although not directly regulated by the German Judiciary Act, matters related to the status and legal position of German judges, such as external evaluation of judges, division of affairs through the Court Steering Committee, and activities of the Association of German Judges are also included as the subject of the study. The reinforcement of the status and legal position of judges does not end by simply improving the people's confidence in the judiciary by realizing good trials by meas of securing the independence of judges. This ultimately contributes to the guarantee of the freedom and rights of the people. Therefore, strengthening the status and legal position of judges is a goal that should be jointly pursued not only by the judiciary but also the National Assembly, the government, and judicial organizations based on the will of the judges.
