최근 사내하도급 근로자에 대한 불법파견 판결이 잇따라 나오면서 산업현장에서 혼란이 가중되고 있다. 불법파견을 둘러싼 문제를 거슬러 올라가 보면 1998년 파견법 제정에까지 연유한다. 파견법은 IMF 금융위기를 극복하는 과정에서 고용유연성을 제고해달라는 국제통화기금(IMF)의 요구를 받아들여 제정된 것이다. 요즈음 문제가 되고 있는 도급・파견의 구별문제는 이미 파견법 제정당시에 예견된 것이다.
도급과 파견은 태생적으로 그 구조가 비슷하여 구분하기가 용이하지 않다. 그래서 행정관청은 일찍부터 양자를 구별하는 기준(지침)을 만들어 이에 대응해 왔다. 이 지침에 따라 하청회사가 원청회사로부터 독립하여 독자적인 경영권과 인사권을 행사하는 경우에는 도급으로 보고, 그렇지 않는 경우에는 파견으로 보는 판단기준이 실무상 정착되어 있었다.
그런데 2000년대에 접어들어 사법부가 불법파견소송에 본격적으로 개입하게 되면서 상황이 달라졌다. 사법부는 종전의 행정부의 유권해석에 더해 하청근로자들에 대한 원청회사 조직에의 편입 정도, 지휘・명령 및 인사・명령의 행사 여부, 업무의 전문성과 조직・설비의 유무 등 더욱 세분화된 독자적 기준을 제시하면서 사내하도급의 인정기준이 더욱 엄격하게 되었다.
문제는 이러한 사법적 판단기준만으로는 불법파견 여부를 판단하기가 쉽지 않다는데 있다. 특히 제조업에서 널리 활용되고 있는 노무도급의 경우에는 도급(적) 요소와 파견(적) 요소가 복잡하게 착종(錯綜)되어 있어 양자를 구분하기란 지난한 일이다. 또한 산업별로 작업공정이 상이할 뿐만 아니라 점점 분업화・고도화되고 있는데 비해 사법부의 판단은 너무 경직되어 있다 보니 종전까지 적법한 도급이 소송에서 불법파견으로 판단되는가 하면, 동일한 사안을 두고도 심급과 담당판사에 따라 결론이 달라지는 경우도 적지 않다.
본고에서는 위와 같은 문제의식 하에서 점점 분업화・전문화・고도화되고 있는 산업현장의 상황을 반영하기 위해서는 기존의 사법적 판단기준만으로는 한계가 있다고 판단하고, 이에 대한 보다 구체적이고 현실적인 해결방안을 행정서비스에서 모색하는 것을 목적으로 한다. 본고에서 연구방법으로는 우리와 비슷한 문제를 안고 있는 일본에서는 이 문제에 어떻게 대응하고 있는지, 비교법적 연구를 통하여 검토하고자 한다. 특히 일본의 파견과 도급의 구별에 대한 기준은 우리나라에 답습된 경위도 있고 하여 일본과의 비교법적 연구는 유의미한 시사점을 제공하리라 판단된다.
The recent series of illegal dispatch rulings against in-house subcontract workers has added to the confusion in the industrial field. Looking back on the issues surrounding illegal dispatch, it is due to the enactment of the Dispatch Act of 1998. The Dispatch Act was enacted in response to the International Monetary Fund's (IMF) request to improve employment flexibility in overcoming the IMF financial crisis. The current problems, such as the distinction between contracting and dispatching, were already foreseen at the time of the enactment of the Dispatch Act.
Contracting and dispatching are inherently similar in structure, making them difficult to distinguish. Therefore, the administrative agency has been responding to this by creating a standard (guideline) that distinguishes between them. When a subcontractor exercises its management and personnel rights independently from the original contractor per this guideline, it would be regarded as contracting. Otherwise, it would be considered dispatching.
However, in the 2000s, the situation changed when the judiciary became involved in illegal dispatch litigation in earnest. In addition to the previous administration's interpretation, the judiciary presented more detailed criteria such as the degree of incorporation of subcontractors into the organization of the original company, the exercise of command, order, or personnel, the work expertise, and the presence or absence of organization and equipment.
The problem is that it is not easy to determine whether to be illegally dispatched based only on the judicial judgment standards. In the case of labor contracts, which are widely used in manufacturing, it is difficult to distinguish between them because the contracting and dispatching elements are complicated. In addition, not only are the work processes different by industry, but they are becoming increasingly divided and advanced, and the judiciary's judgment is too rigid. Moreover, the conclusion varies depending on the trial level and the judge in charge, even with the same case. Thus, the legitimate contract so far is judged to be illegal dispatch in the lawsuit.
This paper judges that there is a limitation to the existing judicial judgment standards to reflect the situation of industrial fields becoming more divided, specialized, and advanced under the above problem. In addition, this paper aims to explore a more specific and realistic solution to this in administrative services. The paper conducts comparative legal research to examine how Japan, which has a similar problem as Korea, is responding to this problem. In particular, since the Korean criteria for the distinction between dispatching and contracting have referred to the Japanese standards, a comparison with Japan's legal system offers significant implications.
