민사소송상 상소라 함은 당사자, 기타의 소송관계인이 하급법원이 자기에게 불이익하게 내린 미확정의 재판에 대하여 상급법원에 그 서정을 구하는 볼복신 칭의 방법이다. 소의 경우와 마찬가지로 상소의 경우에도 적법요건이 구비되어 있는 경우에 한하여 그 이유유무를 심리하게 되는데 이러한 상소의 적법요건을 상소요건이라고 한다. 이러한 상소요건 중의 하나인 상소의 이익은 상소인이 원재판에 의하여 불이익을 입고 있어야 한다. 상소의 이익은 소송요건인 소의 이익과 동일하게 상소 인의 불복산청을 선별함으로써 파상소인과 법원의 부담을 일정정도 억제하는 기능을 한다. 그러므로 법원은 상소의 이익이 있는 상소에 대해서만 본안의 재판을 할 것이고, 그 이익이 없는 상소는 배척하여야 하며, 상소이익의 존재에 그 흠이 있는 상소는 부적법한 상소로서 각하되는 것이다. 이러한 상소의 이익에 대하여 민사소송법은 명문의 규정이 없이 흠결하고 있지만, 상소제도의 목적과 상소심의 구체적인 존재방향을 결정하는 중요한 개남으로서 기능한다. 그리하여 상소인이 어떠한 경우에 상소의 이익이 존재한다고 할 갓인가, 그 존부를 판정하는 기준을 어디에서 구할 것인가 하는 점은 문제점으로 지적된다. 즉, 상소의 이익은 권리보호의 이익의 특수한 형태로서 무익한 상소권행사를 견제하자는 것이다. 그 구체적인 내용에 관하여는 학설의 변경과 대립이 있다. 이에 반하여 어느 당사자가 상소기간 대에 상소를 제기하지 아니하여 도과되었거나 상소권의 포기에 의해 상소권을 상실한 피상소인이 상소심 계속후에 심판의 대상을 확장하고, 원재판을 자기에게 유리하게 변경할 것을 구하는 불복신 청을 할 수 있는데 이러한 불복신청을 부대상소라고 한다. 상소인은 스스로 불복신청에 의에 상소심의 심판대상을 한정할 수 있으므로 원재판보다 불이익한 재판을 받을 위험이 없고, 공격방법으로 불복의 범위를 변 경할 수 있다. 이에 반하여 피상소인이 심판대상의 변경권을 갖지 못한다고 하 면 방어에 최대한 성공하여도 원재판유지에 그치게 되고, 상소제기에 관하여 피상소인이 예측을 잘못한 것을 고려하여도, 상소인에 비하여 절차적 지위가 현저 하게 약화된다. 그리하여 상소심에서 당사자간의 평등을 도모하고, 소송경제를 도모하기 위하여 피상소인에 대하여도 변론의 종결에 이르기까지 불복의 신청을 할 수 있도록 부대상소제도가 만들어진 것이다. 이러한 제도가 피상소인에게 마련됨으로서 양당사자가 상대방을 의심하여 상 소를 제기할 염려가 적어져 상소심의 부담경감에 기여하고, 상소심이 원판결을 불이익하게 변경하는 것이 작당한 경우에 심판대상변경의 석명도 용이하게 된다. 그러나 부대상소의 성질론에 관하여는 다툼이 있다. 이에 본고에서는 어떠한 경우에 상소의 이익이 존재하는가의 문제와 상소의 이익의 존부판정에 관한 문제를 학설과 판례를 중심으로 살펴본다. 또한 공평의 원칙에 입각한 피상소인의 불복신창방법인 부대상소의 성질을 살펴봄으로서 부대상소에서도 상소의 이익이 요구되는가의 문제를 검토하고자 한다.
더보기Appeal in a civil suit is a motion to challenge against non-final judgment of lower court filed with a higher court by a party or other relevant person who was disadvantaged from such judgment As the instant of original [ding, the higher court grants a motion to appeal in order to review of the case appeal until a person filing such motion satisfies certain requirements. We call those requirements as ``appeal filing requirements``. One of ``appeal filing requirements`` is redressability. This means that the appellant must be disadvantaged from the judgment of lower court so that the appeal court decision favoring appellant can redress him or her. This requirement of redressability functions to ease both the appellee`s burden and the court`s case load to some extent. Thus, the court must review on merits only for the appealed case satisfying the redressabiliry requirement and deny motions to appeal otherwise so that an appeal not-satisfying that requirement is dismissed as an appeal not-satisfying legal prerequisite. While the Civil Procedure Act does not expressly prescribe this redressability requirement, that requirement plays an important role with respect to the purpose of appeal system and the practice of the higher courts taking motions to appeal. Thus, the following matters become important issues: In which instances the cowl finds that redressabiht3- requirement met: Where the court finds the criteria for such decision. In other words, while the requirement of redressahility is intended to prevent a frivolous exercise of right to appeal, there have been divergent theories on the details of that requirement, in other hands, an appellee. who did not file a motion to appeal until the expiration of appeal filing or lost his or her right to appeal by signing a waiver of right of recourse, can file his or her own motion to appeal during appeal proceeding initiated by the other party`, appellant. In that motion, the appellee can extend the subject matter of the case at issue and require the court to vacate the original judgment of lower court and to deliver a decision in favor of him or her. We can call this appellee`s motion to appeal as a collateral appeal. It is not likely that the appellee will be more disadvantaged in the appeal than in the lower court. The appellee can also change the subject matters for higher court`s review so that he or she can easily dispute with the other party. Otherwise, although the appellee is successful in defending against the appellant`s claim, the appellee will not be granted more favorable decision from die higher court. Thus, even considering the appellee`s own fault in his or her expectation of appeal, the status of appellee in terms of the exercise of his or her procedural right becomes substantially week compared with the appellant. This is the backgrounds to the process of ``collateral appeal`` where even an appellee can file a motion to challenge until the end of oral argument enhancing the equality between the parties in appeal proceedings. By allowing an appellee to file a ``collateral appeal.`` the number of appeals filed due to distrust between die parties is likely to decrease and thus a higher court can be relieved its burden of case load. In addition, for the case where the decision of lower court shall he changed in favor of an appellee, it is easy for the appellee to make his or her argument and provide evidence to support that argument. However, there are different views about the nature of collateral appeal In this paper, I will examine theories and case laws to explore following matters: in which instances the court finds the redressability requirement met; what is the court criteria to decide whether such redressability is satisfied or not. Also, I would like to examine the nature of ``collateral appeal``, which is based on the principle of equality, allowing the appellee to challenge against the decision disfavoring him or her in order to find out the question whether the redressahilitv requirement must be also required for a ``collateral appeal.``
