법률정보원 이용행태에 기반한 주석서 정보서비스에 관한 연구
The law is essential for the development of the nation and the society as well as for the resolution of societal problems. In this aspect, a law practitioner is an expert who interprets, applies, and studies the law. The interpretation of the law may vary depending on individual perspectives; however, a unified construction should be derived based on such subjective interpretations. There is a range of references available for legal interpretation, which include various legal literatures such as legislation documents, law codes, legal commentaries, encyclopedias, textbooks, case reports, case explanation notes, articles and theses, and legal information search systems.
Among those references, legal commentaries are assumed to be the fundamental source of information for the interpretation of the law. It is a guidebook on trial practices, which takes a more systematic and professional approach in interpreting laws, cases, and legal theories. However, commentaries still have a drawback. Since the publication of the first edition until a revised edition becomes available, commentaries do not reflect updates including revisions, enactments, latest cases, and local or foreign theses of the corresponding law. Therefore, users have to take notes in the commentaries or refer to other documents and systems in order to interpret the latest law. Furthermore, it is impossible for a law practitioner to keep up on the latest trends in law without reading articles presented at law associations or seminars. Although a legal commentary is referred to as a unified treatise jointly written by multiple law practitioners, it hardly presents a consolidated interpretation of the law. This is largely because individual interpretations on each of the provisions of the law are written separately by individual law practitioners and are not completed through discussions with other writers.
The court has the right to provide the final interpretation of the law. The court hands down the final decision on disputes between individuals and on legal conflicts between individuals and the state. Regardless of discrepancies in legal interpretation among stakeholders or their representatives, such differences should be ironed out toward a unified direction to keep up with the digital environment. The unity of legal interpretation can be achieved by sharing opinions and studying new laws, cases, and legal theories among law practitioners. Legal commentaries will stay true to their intent of providing diverse legal theories and enabling a unified legal interpretation only when law practitioners are allowed to discuss laws, cases, and legal theories in depth within the boundaries set by commentary authors. If law practitioners can add the latest laws, cases, and legal theories as well as their opinions to existing commentaries while using such commentaries for their judicial roles and legal studies, they will be able to obtain a unified legal interpretation without referring to other legal literatures as up-to-date commentaries give them a broader picture of legal trends.
The questions that have been selected for this study on the use of legal commentaries among many other legal literatures required for legal interpretation by law practitioners are as follows: (i) What kind of legal information source do legal commentaries represent for law practitioners? (ii) Is there any difference in the use of commentaries depending on the characteristics (profession, number of years in practice, specialty, major, etc.) of law practitioners? (iii) How can we enhance the way commentaries provide information?
To answer those questions, the Leckie’s Model of information-seeking behavior has been served as a basis for extended model. As a general model established by incorporating existing research findings through a comprehensive review of literatures on the information-seeking of professionals, the Leckie’s Model is used as a theoretical ground for empirical research on the aforementioned subject. For example, once a research subject and debate issues are given to a law practitioner, he/she continues to review information-seeking behaviors targeting legal information sources until he/she reaches a conclusion then combines such outcome with existing research findings. In the course of incorporation, legal commentaries are used to understand the current legal situation, whereas information-seeking behaviors are repeatedly committed in order to find legal principles.
Interviews and surveys of law practitioners were conducted based on the Leckie’s Model. First of all, preliminary interviews were carried out with four law professionals including a judge, a prosecutor, a lawyer, and a jurist. Then, the interview items were confirmed and responded to by 58 people including commentary writers, publishers, and users. For the survey, 47 questions were selected based on the interview items and asked to 753 people; among them, 173 people responded, and their answers were used for the analysis of the information-seeking behaviors of law practitioners.
The findings of the analysis are as follows: (i) The main reason that legal commentaries are published in Korea is to receive obtain help for trial practices as these commentaries serve as a guide for trials. Legal commentaries help create a theoretical basis of the law and a legal mind. Given that legal commentaries deal with the application and interpretation of the law, which are the most important factors in trial practices, they are essential to law practitioners. Two representative commentary publications are the Commentary on the Civil Law by Korea Judiciary Administrative Publishers Ltd. and the Annotated Civil Law by Parkyoungsa. (ii) A legal commentary contains all information about the law, including case explanation notes and legal theories, enabling its users to get hold of the latest law without searching for other legal literatures. For the best use of legal commentaries, law professionals, such as judges, prosecutors, lawyers, and jurists, should join efforts to revise legal commentaries continuously. (iii) Law practitioners use legal commentaries to find legal principles in judicial practices or to conduct research and write papers. However, they face difficulties in obtaining the latest or revised laws, cases, and legal theories since the initial publication of such commentaries. (iv) With regard to ways to improve the use of legal commentaries, law practitioners suggested that there should be online services for law professionals to congregate and share diverse opinions, which would help them obtain fundamental information for legal judgement. They also proposed that the publication and management of legal commentaries need to be led by professional publishers in the private sector following the current protocol.
Despite the fact that law practitioners should, at all times, be aware of the present legal situation and information both in Korea and abroad, it is difficult to achieve such with hard-copy documents and off-line activities. In this regard, existing commentary services should be transformed into online legal information services in the form of a collective intelligence through which law professionals, including judges, prosecutors, lawyers, and jurists, can share different perspectives on legal interpretation and develop the law in a more unified way.
법률은 국가와 사회의 발전, 그리고 사회문제 해결을 위해 필요하다. 법률가는 이러한 측면에서 법률을 해석하여 적용하고 연구하는 전문가이다. 법률해석은 각각의 입장에서 이루어질지라도 통일된 접근이 필요하다. 법률해석 참고자료는 입법자료, 법전, 주석서, 백과사전, 교과서, 판례집, 판례해설, 학술논문, 학위논문 등 다양한 법률문헌과 법률정보를 검색할 수 있는 시스템이 있다.
본 논문은 이 중에서 기본이 되는 자료는 주석서라고 가정하였다. 주석서는 법령, 판례, 법이론 등을 보다 체계적이고 전문적으로 해석한 재판실무 해설서이다. 그러나 주석서는 초판 간행 이후 개정판이 간행되기 전까지 해당 법률의 개정 및 제정 정보, 최근 판례 및 국내외 학설 등을 반영하지 못하여 이용자가 해당 책자에 메모하거나 또 다른 문헌과 시스템 등을 이용하여 현재의 법을 파악해야 하는 단점이 있다. 법률가는 법률관련 학회 및 세미나 발표 논문을 읽지 않고는 최신 동향을 알 수 없다. 그리고 해당 법률에 대한 주석서는 법률가들의 공동 집필로 개별 조문에 대한 각각의 해설들은 담당 집필자 개인의 저작물이다. 주석서는 다른 집필자와의 논의를 통해 완성된 것이 아니므로 법률가의 의견을 종합적으로 파악하여야만 이해될 수 있다.
법률에 대한 최종 해석 권한은 법원에 있다. 법원은 개인과 개인의 분쟁, 개인과 국가 사이의 법률적 다툼에 대하여 최종적인 판단을 내린다. 사건의 당사자나 대리인들은 쟁점사항에 대하여 같은 법조문을 놓고 다른 법률해석을 주장 하더라도, 궁극적으로 서로 다른 법률해석은 디지털 환경의 흐름에 따라 통일된 방향으로 변화되어야 한다. 주석서의 견해에 대하여 법률가들이 다양한 의견을 나누고 새로운 법령, 판례, 법이론 등을 확인하는 과정을 통해 법률해석에 통일을 이룰 수 있다. 법률가는 주석서 저작자의 의견을 존중하는 가운데 법령, 판례, 법이론 등을 보다 구체적으로 논의할 수 있어야만 다양한 법이론을 제공하고 이를 통해 통일된 법률해석을 가능하게 하는 주석서가 될 수 있다. 법률가가 재판업무 및 법학연구를 위하여 주석서를 활용하는 과정에서 최신의 법령과 판례, 법이론의 현재와 법률가의 다양한 의견을 추가하여 집적할 수 있다면 상당한 이점이 있다. 현재 법의 상황이 무엇인지 다른 법률문헌을 보지 않더라도 전체적인 흐름을 파악할 수 있으므로 법률가에게 통일된 법률해석을 제공할 수 있다.
법률가가 법률해석을 위하여 필요로 하는 문헌 중 주석서 이용행태를 연구하기 위한 연구질문은 첫째, 주석서는 법률가에게 어떤 법률정보원인가? 둘째, 법률가의 특성(직업, 근무연수, 전문분야, 전공 등)에 따라 주석서 이용행태는 차이점이 있는가? 셋째, 주석서의 정보제공은 어떤 방식으로 개선되어야 하는가? 로 설정하였다.
연구질문을 해결하기 위해 접목한 정보추구행태의 연구모형은 Leckie 모형이다. Leckie 모형은 전문가 집단의 정보추구행태를 연구한 문헌들을 광범위하게 검토하여 기존 연구결과들을 통합해서 구축한 일반 모형이기 때문에 다양한 전문가 집단의 정보추구를 연구하기 위한 경험적 연구의 이론적 근거로 사용된다. 즉 법률가는 연구과제 및 쟁점사항이 부여되면 결론에 이르기까지 계속하여 법률정보원에 대한 정보추구행위를 광범위하게 검토하여 기존 연구결과들을 통합한다. 통합과정에서 주석서는 현재 법의 상황을 파악하고자 이용하고 법리를 찾기 위해 정보추구행위를 반복하면서 결론에 이른다.
법률가를 대상으로 하는 면담과 설문조사는 Leckie 모형을 근거로 실시하였다. 우선, 면담은 법관, 검사, 변호사, 법학자 각 1명씩 4명을 대상으로 사전면담을 실시하고 이후 면담 항목을 확정하여 집필자, 발행자, 이용자 58명에게 답변을 받는 과정을 거쳤다. 설문조사는 면담항목을 통해 47개의 설문항목을 만들어 753명에게 요청한 결과 173명에게 답변을 받는 방식이었다. 이를 통해 법률가의 정보추구행태를 분석하였다.
분석결과는 다음과 같다. 첫째, 국내 주석서의 간행 경위는 주석서가 법조 실무와 관련하여 재판을 이끄는 지침서의 역할을 하므로 재판실무에 직접적으로 도움을 받고자 간행하고 있다. 주석서를 통해 법률에 대한 이론적 근거 및 리걸 마인드(legal mind)를 형성할 수 있다. 주석서는 재판 실무에 있어서 가장 중요한 법적용과 해석에 관한 문제를 다루고 있기 때문에 법조인과 법학자들의 필수 도서이다. 대표적인 주석서로는 한국사법행정학회의『주석민법』등 주석서 시리즈와 박영사의『민법주해』가 있다. 둘째, 주석서는 법령, 판례해설과 법이론 등 학설이 집적된 문헌으로 다른 법률문헌을 찾지 않아도 현재의 법을 확인할 수 있는 유력한 자료다. 따라서 법률가인 법관, 검사, 변호사, 법학자가 협력하여 지속적으로 주석서를 공동 개정하는 작업이 필요하다. 셋째, 법률가는 재판업무 중 법리를 찾기 위해서 또는 연구 및 집필을 위하여 주석서를 이용하고 있으며 주석서 간행 이후의 개정 법령 및 판례와 법이론 파악에 어려움이 있다. 넷째, 법률가는 주석서 이용에 따른 개선 방안에 대하여 주석서 집필자의 의견을 존중하는 선에서 온라인으로 법률가의 다양한 의견을 나누는 방안을 제시했다. 또한, 법적 판단의 기초적인 정보를 손쉽게 파악하고 법률가가 서로 융합할 수 있는 온라인 서비스의 필요성에 대하여 의견을 피력했다. 주석서에 대한 출판과 운영의 주관은 국가기관이 아닌 현재와 같이 민간에서 전문출판사가 출판하는 방안이 타당하다고 법률가들은 지적했다.
결론적으로 법률가는 법의 변동 상황을 항상 인지해야 하고 그와 관련된 국내외의 법률정보를 파악하여야 하지만 인쇄물 등 오프라인에서는 어려운 현실이다. 따라서 주석서 서비스는 법률가인 법관, 검사, 변호사, 법학자가 온라인상에서 다양한 법률해석의 의견을 나눔으로써 현재 법의 상태를 통일된 방향으로 발전시킬 수 있는 집단지성형태의 주석서 법률정보 서비스로 전환되어야 한다.
