1. 연구 배경 및 목적
최근 국민 소득 증대, 주5일 근무제의 정착, 물환경 접근성 향상 등으로 친수공간에 대한 수요가 매년 꾸준히 증가하고 있다. 더불어 취수원 수질보호를 위해 그동안 개발이 제한되어 왔던 자방자치단체들은 지역경제 활성화와 낙후된 환경개선을 목적으로 환경규제완화를 점차 공론화시키고 있으며, 특히 하천 및 호소 내 유도선 및 수상레저 선박 이용, 뱃길복원사업추진 등이 새로운 환경이슈로 부각되고 있다. 하지만, 아직까지 하천 및 호소내의 유도선 및 수상레저 선박의 운항에 대한 수질오염 방지를 위한 제도적 관리는 미흡한 실정이다. 현재 “유선 및 도선 사업법”에서 하천·호소 또는 바다에 유류·분뇨·폐기물을 버리는 행위를 금하는 규정만이 선언적으로 언급되고 있고, “해양환경관리법”에서 선박에서의 오염방지에 관한 내용을 규정하고 있으나 해안환경에 국한되어 있어 내수면의 유도선 운항에 따른 수질관리방안은 아직 제도화되어 있지 못하고 있다. 따라서 본 연구에서는 내수면 유도선 운항에 따른 수질오염에 미치는 영향과 수질오염방지를 위한 제도적 관리현황을 파악하고 국외 사례조사를 통해 체계적이고 합리적인 내수면 수질관리 제도개선 방안을 도출하여, 내륙 수상활동 증가로부터 지속가능한 수상레저 산업을 위한 선도적 수질관리정책 추진에 기여하고자 한다.
2. 주요 연구내용
국내의 유선 및 도선 현황을 살펴보면, 유선의 경우 2011년 기준으로 등록척수가 전체 2,309척으로 이중 유선은 2,139척, 도선은 170척으로 선박수로는 대부분 유선이 차지하고 있다. 유선의 경우 대부분의 선박이 5톤미만의 동력선이나 모터보트인데 반해, 도선의 경우에는 무동력선이 전체 선박의 98%를 차지하고 나머지 8%가 동력선 또는 모터보트로 나타났다. 최근 4년간의 유도선 척수와 선착장의 수의 변화 추이를 살펴보면 뚜렷한 변화를 찾을 수 없다. 다만 해수면 경우를 보면 최근의 어려워진 경기불황에 따라 관광객의 감소가 주된 원인으로, 특히 작은 규모의 유선사업에 보다 큰 영향을 미치는 것으로 판단되고, 도선의 경우도 급증하는 섬과 육지를 잇는 연육교의 건설로 도선의 필요성이 적어짐에 따라 점차 감소하고 있는 추세이다. 하지만 수상레저사업자의 수는 다소 증가되고 있다. 2007년부터 사업장 수의 증가가 뚜렷하고 최근의 경기불황에도 불구하고 일정하게 사업장의 수를 유지하고 있다. 특히 팔당호 및 대청호 수질보전 특별대책지역내의 사업자등록수를 보면 유도선업은 2000년 이후 큰 변화를 나타내지 않지만 수상레저업은 2.5배 달하는 증가를 나타내고 있다. 선박 운전을 위한 면허취득자수의 변화를 보면 다소 기복이 있지만 2000년 이후부터 꾸준히 증가하는 추세가 확실하다. 2010년 현재 전체 조종면허 인구수는 11,500명에 이르고 있다. 이러한 증가 추세는 여가 또는 수상스포츠로서 수상활동에 대한 관심이 증가된 결과로 볼 수 있다. 한편, 향후 정부의 해수면 및 내수면을 모두 포함하는 레저보트의 장래 수요 추정을 살펴보면, 2019년도에는 17,435척으로 예측된다.
그동안의 선박 운항과 관련된 수질오염 사고에 대한 기록은 선박의 운항이 활성화되어 있는 해수면에서의 오염사고에 대한 기록이 전부로, 주요 원인으로는 유조선, 화물선, 어선 등의 선박에 의한 석유류 유출사고로서 갑작스런 사고유발에 의해 발생하여 그 피해의 범위와 영향은 광범위하고 지속적인 만성적인 특성을 동시에 가지고 있다. 반면에 내륙에서의 선박운항에 따른 수질 사고는 체계적인 기록이 관리되고 있지 않는 실정이다. 단지 소방방재청에서 재난관리 측면에서 유도선 운항에 따른 안전사고에 대한 통계만을 집계하고 있어, 내수면에서의 선박운항에 따른 수질사고 사례에 대한 기록을 찾을 수 없다.
선박에서 발생되는 주요 배출오염원으로는 배의 밑바닥에 고인 더러운 물(bilgewater), 갑판 청소 및 유출수, 추진 엔진 폐수, 발전기 엔진 폐수, 소화주관 시스템, 어류 보관 및 청소 폐수, 선박의 생활 잡오수, 선박 코팅용 페인트 등이 있다. 또한, 이들 배출오염원으로 배출되는 오염물질을 살펴보면 기름류, 일반오염물질 (온도, 전도도, 염도, 탁도, 용존산소, 총 부유물질, 생물학적 산소요구량, 화학적 산소요구량, 총 유기탄소, pH, 황화물, 총 잔류염소 등), 영양물질, 병원균지표, 중금속류, 휘발성 유기물질, 노니페놀, 폐기물류, 그리고 기타 유해물질로 선저용 방오 도료 등이 있다. 특히, 오일유출, 중금속, 산소고갈 유기물질, 영양물질, 내분비성 미량화학물질 등에 대해 일반 수질기준을 초과시킬 수 있는 정도로 배출될 수 있으며, 선박에 사용되는 방오제, 비소와 구리 등은 유출로 인한 환경영향에 우려될 수 있다. 또한, 낚시 등으로부터 획득한 어류에 대한 보관 용수로부터의 총인, BOD, COD, 총질소, 병원성 미생물 등에 대한 수질오염과 그로 인한 부영양화에 미치는 영향이 나타날 수 있다. 선박으로부터의 오염배출 부하량에 대한 잠재적 영향을 팔당 특별대책지역을 대상으로 살펴보면, 전체 배출 오염부하량 대비 선박에서 배출되는 오염부하량은 BOD 기준으로는 0.6~0.9%정도로 결코 적지 않은 부하량을 나타내는 것으로 평가되었다.
유도선의 수질관리 제도를 살펴보면 「유선 및 도선에 관한 법률」에서 수질관리와 관련된 조항이 행정처분 사항의 하나로 구체적인 위반내용에 대한 명시 없이 「수질 및 수생태계 보전에 관한 법률」을 준수할 것을 언급하고 있다. 하지만 동법에서 정의된 오염원의 규정에 오염원으로서의 유도선에 대한 명시가 불명확하여 유도선에 대해 기타 오염원으로 명시가 우선적으로 필요하다. 한편, 내수면에서의 유도선 운항은 상수원보호에 관한 법 및 제도에 의해 특정지역에서의 운항이 금지 또는 제한되어 있다. 특히, 「수도법」의 상수원보호구역에서의 선박운항에 대해서는 원칙적으로 선박운항과 수면레저행위를 금지하고 있고, 「환경정책기본법」에 따른 「팔당·대청호 상수원 수질보전 특별대책지역 지정 및 특별종합대책」에서도 특별대책지역 I권역에 대해 유도선 사업 및 수상레저사업의 신규 면허·신고 및 등록을 허용하지 아니하고, 다만 지역주민의 교통불편 해소를 목적으로 전기동력선을 이용하는 도선사업만을 허용하고 있다.
3. 정책 제언
하천 및 호소 등의 공유수면에서의 유도선 운항으로부터 배출되는 오염물질의 종류와 그 양은 매우 다양하며, 지역적 특성에 따라 수질과 물환경에 잠재적 영향을 미칠 수 있을 것으로 판단된다. 상대적으로 큰 규모의 물환경에서 선박으로부터 일시적이고 순간적인 오염물질의 유출이 일반적 물환경 수질기준을 초과하지도 수상활동을 하는 인체와 수생물에 급성 혹은 만성적 악영향을 주지도 않을 것으로 판단된다. 그럼에도 불구하고 기존 외국사례를 보면 선박 유출에서 존재하는 많은 오염물질이 배출지점에서 일반적 수질기준을 초과하고 있는 것으로 조사되었기 때문에 한정된 지역 내에서는 잠재적 악영향을 유발할 수 있을 것으로 평가하고 있다. 특히 이러한 상황은 다른 오염원들을 갖고 있는 한정된 물환경의 배경농도가 높고, 선박으로부터 배출되는 오염물질의 농도가 높은 경우에는 영향이 크게 나타날 수 있다. 도시지역의 유역 내 각 가정의 오염원과 같이, 대부분의 선박은 물환경에 최소한 영향을 미칠 수 있다. 그러나, 수질오염이 심각한 정체수역에 여러 선박으로부터 높은 농도의 오염물질의 배출은 의미있는 악영향을 초래할 수 있다. 따라서 오염물질 유입에 민감한 물환경에서는 선박으로부터 특정 오염배출량을 저감하기 위한 방안의 수립이 중요하다 하겠다.
국민의 소득 증대와 주 5일 근무제의 정착, 그리고 물환경 접근성의 향상 등은 내륙 수상활동 증가를 예상하고 있다. 하지만 아직까지 내수면의 유도선 운항 및 수상레저 선박 의 이용에 따른 수질관리는 아직 제도화되어 있지 못하고 있다. 따라서 지금가지 살펴본 유도선 수질관리 제도와 수질영향에 대한 평가를 통해 지속발전 가능한 유도선 및 수상레저 산업을 위한 선도적 수질관리제도 정책방안을 다음과 같이 제언하고자 한다.
첫째로 내수면 선박운항에 따른 수질오염 실태 조사 및 물환경 영향평가에 대한 기초자료의 수집이 우선적으로 선행되어야 한다. 아직까지 국내에서 내수면과 해수면을 포함하는 모두 공유수면에서 활동하고 있는 선박으로부터 발생되는 수질오염원에 대해 조사된 사례는 없다. 하지만, 미국 EPA의 조사결과를 살펴보면 소규모 선박으로부터 오일유출, 중금속, 독성 유기물질, 산소고갈 물질, 영양물질, 내분비성 미량화학물질 등에 대해 지역의 특성에 따라 일반 수질기준을 초과시킬 수 있는 정도로 배출될 수 있음을 보고했다. 특히, 선박에 사용되는 방오제, 비소와 구리의 유출로 인한 환경영향에 우려하고 있다. 선박으로부터 배출되는 오염물질에 대한 조사는 잠재적 환경영향을 분석하기 위해 중요하다. 우선적으로 선박의 운항으로부터 발생되는 오염물질의 규명과 그 영향 검토를 배출되는 유량, 빈도, 양, 위치 등에 대한 객관적인 정보의 제공이 절실히 요구된다. 특히, 선박엔진 유출수, 선박 내 청소, 샤워, 조리 등 일상 활동으로부터 발생되는 오수, 어류 등 저장에 사용되는 물 등에 수질 및 물환경에 대한 평가가 필요하다. 이를 위해서는 선박의 종류와 규모에 따른 배출수의 특성, 유형 및 조성 등의 요소에 대한 과학적 조사가 선행되어야 한다. 또한 이를 바탕으로 선박으로부터 배출수의 잠재적 환경영향과 선박배출수의 규제를 통한 환경개선 효과, 그리고 수질관리 법규에 미치는 영향과 범위를 체계적으로 검토하는 것이 필요하다.
두 번째로는 내수면에서 활동하고 있는 유선 및 도선, 그리고 수상레저 선박에 대해 사전 예방적 차원의 체계적인 오염원 관리제도가 필요하다. 이를 위해서는 「수질 및 수생태 보전에 관한 법률」에서 유도선 오염원 관리 규정의 강화가 요구된다. 특히, 유도선을 기타수질오염원의 하나로서 규정하여 전국 지자체별 오염원 조사시 유도선 및 수상레저 선박에 대한 오염부하량을 파악하도록 할 필요가 있다. 또한, 동법에서 “배출 등의 금지” 조항에 유도선으로부터의 배출금지를 명확히 함으로서, 「유선 및 도선 사업법」에서 내수면에서의 오염물질 무단배출에 따른 위반내용을 구체적으로 명시할 수 있을 것이다. 그리고 기타오염원 설치·관리 신고(수생태법 시행규칙 제86조)에 따라 유도선 및 수상선박에 대해 체계적인 수질 관리 규정을 제시할 수 있다. 수질오염행위에 대해 오염원인자 부담원칙을 적용하여 기타 오염원 설치·관리자의 시설설치 등 필요한 조치(시행규칙 제87조)를 규정함으로서 선박 안에서 발생하는 폐기물 및 분뇨는 규정에 의한 선박 안에 저장한 후 오염물질저장시설의 설치 운영자 또는 청소업자에게 인도 처리 원칙으로 하고, 유성혼합물의 저장, 처리 규정과 유해도료 사용금지를 적용할 필요가 있다. 또한, 오염예방을 위한 관리규정으로 선박의 오염방지를 위한 선박검사와 선박오염기록부 및 선박오염 비상계획서의 관리제도를 적용할 수 있을 것이다.
마지막 세 번째로는 취수원 보호구역에서의 선박운항과 관련된 규제 조건의 표준화와 과학화가 필요하다. 우리나라 취수원의 수질보호를 위한 정책은 입지규제, 배출 규제, 오염총량관리, 조류경보제 등 다양한 사전 및 사후 수질관리 정책이 추진 중에 있으며, 과거의 입지규제에서 배출규제로의 전환을 시도하고 있는 상황이라 할 수 있다. 이러한 다양한 수질보호 정책은 규제에 있어 배출물질의 제한과 더불어 관련된 행위 제한을 중복되는 문제를 내포하고 있어, 하나의 법률로 통합 및 조정하는 방안의 필요성이 제기되고 있다. 앞에서 살펴본 선진 외국의 취수원 관리 규제에서도 대부분 직접적인 선박의 운항의 제한과 같은 행위규제보다는 배출규제를 통해 취수원관리 구역에서의 엄격한 오염물 배출을 차단하고 있다는 점은 규제방식의 단순화 및 과학적인 적용이 필요함을 시사하고 있다. 외국의 취수보호구역의 지정기준과 비교할 때 국내의 상수원보호구역지정과 입지 및 행위 규제는 매우 강력한 규제임에는 틀림없다. 그럼에도 불구하고, 우리나라의 특성을 살펴보면, 단일 지표수 취수원에 의존하고 높은 인구밀도와 개발압력으로 인해 취수원의 수질오염에 취약한 구조를 가지고 있는 상황에서는 신중하고 엄격한 수질관리가 필요하다 하겠다. 하지만 상수원 보호구역의 개발욕구와 지역적 형평성을 고려할 때, 단순한 규제를 고집하기에 앞서, 규제방식을 표준화, 과학화하는 것이 중요하다 하겠다. 상수원 보호구역의 지정과 지정구역에서의 행위제한은 유도선 및 수상레저선박의 운항을 원칙적으로 금지하고 있다. 그럼에도 불구하고, 지속적인 유도선 및 수상레저의 활성화가 기대되고 국민의 욕구가 증대되고 있는 것 또한 분명하다. 따라서 선박운항에 따른 수질오염원을 조사·분석하여 그 영향을 객관적으로 판단할 수 있는 기초자료를 마련하는 것은 이해 당사자 간의 상호이해와 일방적 규제로부터 합의된 배출규제를 통한 취수원 수질관리정책에 기여할 수 있을 것이다.
Recreational boats and ferries in the rivers and lakes discharge varied type and amount of pollutants. They can have a potential effect on water quality and water environment, according to the regional features. It is also judged that pollutants temporarily and spontaneously discharged from the vessels under a relatively large scale of water environment do not have an acute or chronic adverse effect on the human bodies and water creatures doing water activities without exceeding the general standards of water quality in the water environment. Nonetheless, according to the existing cases abroad, they are investigated as the cause potential adverse effect within the limited areas, because many pollutants existing in the discharged water from the vessels exceed the general standard of water quality in the point, on which they are discharge. This can have a huge effect, when a high background concentration of limited water environment with other pollution sources and high concentration of pollutants discharged from the vessels.
In recent, demand for waterfront has been consistently increased annually due to increase of national income, settlement of weekly 5-days work, and accessibility to water environment. In addition, the local autonomous entities have gradually publicized their discussion on easing the environmental regulations for the purpose of activating the local economy and improving outdated environment. Especially, the use of recreational boats and ferries, and propelling restoration project, are being recognized as new environmental issues. However, the reality is that there has still been a lack of systematic management for preventing water quality pollution from the recreational boats and ferries. Therefore, policy measures for proactive water quality management system for vessel operation and water leisure industries that can be in sustainable development are intended to be proposed as follows.
First of all, basic survey data on the status of water quality pollution and evaluation results of water environment, affected by vessels on inland, should be collected. Until now, there has been no case of surveying the water quality pollution sources from the vessels that are active on the public waters including both of inland and sea surface of territorial waters. However, seen with the result of research by EPA, U.S.A., it was reported that oil leakage, heavy metal, toxic organic substances, substances exhausting oxygen, nutritive substances, and trace endocrine disrupting chemicals, can be discharged in the degree that can exceed the general standards of water quality according to the local characteristics. Especially, it is concerned about environment impact due to leakage of antifoulant, arsenic, and copper that are used for the vessels. The investigation on the pollutants discharged from the vessels is important to analyze their potential environment impact. Most of all, it is desperately required to clarify pollutants occurring from operating the vessels and provide the object information about discharged influx, frequency, amount, and location. Especially, there remains a need for evaluation of water quality and water environment of the water used for storing fishes and wastewater generated from the daily activities, such as leaked water from vessel’s engine, cleaning up within the vessels, shower, and cooking. For this, scientific survey on the elements, such as characteristics, types and compositions of the discharged water according to the type and scale of the vessels should be preceded. Also, based on this, there remains a need for systematic review on the effect and extent on the water management regulations, the environment improvement effect through the regulations for the discharged water from vessels, and potential environment impact of the water discharged from the vessels.
Secondly, there remains a need for systematic pollution sources management system in the preventive level for recreational boats, ferries, and water leisure vessels that are active on the inland. For this, it is required to reinforce the regulation of pollution sources management for leading vessels in the Water System and Ecosystem Conservation Act. Especially, it is necessary to figure out pollution load for leading vessels and water leisure vessels in investigation on the pollution sources for each local autonomous entity worldwide by regulating the leading vessels as other water quality pollution source. Also, the contents of violation according to illegal discharge of pollutants on the inland can be specifically clarified in the Recreational Boats and Ferries Business Act by defining illegal discharge from the leading vessels in the provision of “Prohibition of Discharge” under the same Act. Also, the systematic management regulation for water quality management for the leading vessels and water vessels can be proposed according to Article 86, Enforcement Regulations in Water Ecosystem Act, which contains the duty of reporting installation/management other pollution sources. It is necessary to apply prohibition of using noxious paints, regulate storage and treatment of oil mixture. Moreover, following the necessary regulation such following the polluter pays principle for water pollution activities; it is possible to establish a regulation on installing facilities by the installer/manager of other pollution sources and get cleaning service provider or the installer and operator of pollution substances storage facilities to deal with waste and excrements generated in the vessels, after storing pollutants. Also, as management regulations for preventing pollution, the management system of vessel inspection, vessel pollution log, and vessel pollution emergency plan can be applied.
Finally, there remains a need for standardization and scientification of the regulation conditions related to vessel operation in the water source reservation. The situation is that various before and after water quality management policies, such as location regulations, discharge regulations, TMDL (total mass daily load) management, Algae Bloom Alert System have been propelled to protect the water quality in the water source in Korea and are currently switching from the past ‘location regulations’ to the ‘discharge regulations.’ As these various water quality protection policies have contained the problems overlapping limitations to the related activities with limitation of discharging substances, concerning regulations, necessity of the measures for integrating and adjusting them in one regulation has been proposed. As we have seen previously, the point of strict blockage of pollutants discharge in the water source management zone through discharge regulations, rather than activity regulations like direct limitation of vessel operation, mostly in the water source management regulations in the advanced countries, has suggested the necessity of simplified and scientific application of the regulating methods. Compared to standards in abroad, designating the water source protection district, there is no doubt that domestic regulations of designation, location, and activities in water source protection zone are a very strong regulation. Nonetheless, regarding the characteristics of Korea, cautious and strict water quality management is necessary under the situation of having a vulnerable structure to water pollution in the water source due to dependency on single surface water source, high population density, and development pressure. However, considering the desires for developing the water source protection areas and local equity, the standardization and scientification of the regulation methods should come before simply forcing the regulations. According to designation of water source protection districts and limitation of activities in the designated districts, operation of leading vessels and water leisure vessels has been prohibited in principle. Nevertheless, it is also clear that leading vessels and water leisure has been expected to be activated and public desire for them has been increased. Therefore, preparation of basic data that can judge their effect objectively by investigating and analyzing the water pollution sources generated by vessels can contribute to the policy of water quality management in the water source, through discharge regulation agreed from the mutual understandings between the related parties and unilateral regulation.
