“일대일로” 의 제창은 각 분야에서 차근차근 진행되고 자유무역협정이 체결 됨에 따라 한·중 양국은 경제·무역 협력에서도 끊임없이 새롭게 나아갈 것 이다. 실제로 코로나19의 먹구름 속에서도 양국 간 수출입 총량은 해를 가리킬 정도로 늘어났다. 2020년 10월 중국 해관총서에 따르면 같은 해 1계절 양국의 수출입액은 이미 약 1.45만억위엔으로 글로벌 경제 환경이 부진 속에서도 전 년 동기 대비해 1.1% 증가했다. 경제발전과의 상부상조는 확대한 시장과 성과를 확고히 하기 위하여 더욱 효율적이고 편리한 물류체계에 대한 요구이다. 전통적인 단일적 운송으로는 양국 교역의 수요를 모두 충족시킬 수 없는 지금, “종합운송체계”에 있어서 중 요한 부분으로서 복합운송은 더 통합적이고 효율적인 ‘도어 투 도어(door to door)’ 모델 덕에 화물 운송에서도 “강심제”가 될 수 있다. 복합운송을 크게 발 전시키기 위하여 다식연결운송 해운국가는 각종 국제 조약에 근거하여 복합운 송에 대한 입법 역량을 분분히 높였다. 한·중 양국 모두 ‘해양 강국’ 건설이라 는 큰 목표를 갖고 있지만 복합운송 입법에서는 다소 보수적이다. 양국이 서로 다른 정치제도와 문화적 배경을 갖고 있기 때문에 입법상의 일 부 차이와 서로의 법 제도에 대한 이해가 부족한 측면이 있다. 그렇기 때문에 양국의 복합운송법 체계를 정비하는 의미와 필요성이 있었다. 이중 한국의 복 합운송 및 그 운송구간의 입법은 “상법전”의 각 장에 분포된 반면, 복합운송에 대한 맞춤형 규제를 가하는 “2010상법개정안”은 여전히 연구단계에 머물러 한 국 국회를 통과하지 못했다. 반면 중국의 복합운송 및 그 운송구간의 입법은 “민법전”, “해상법” 및 각 단식운송법률체계에 산재하여 있으며 비교적 느슨한 복합운송법률 체계를 형성하였다. 화물 복합운송의 발전 요구가 강하여 국제 화물 복합운송 분쟁에 관한 양국간의 수량도 끊임없이 증가할 것으로 예상된다. 그러나 관련 법규를 살펴보니 나날이 복잡해질지도 모르는 새로운 형세에 직면 에 있어서 현 법체계는 부분 적인 미비로 갈수록 더 많은 도전에 대처하기에 미흡하다는 것을 알 수 있다. 문제 해결의 전제조건은 우선 문제를 발견하는 것이다. “비교법 연구”의 수단 을 통해 양국 입법의 다른 점을 찾는 것이다. 그 결과는 한중 양국은 복합운송 에 관한 규정에서 서로의 문제점도 있고 함께 극복해야 할 법적 어려움도 있는 것으로 나타났다. 이 같은 법적·제도적 부족을 확실하게 개선한다면 양국 내, 특히 양국 간 화물 복합운송, 나아가 종합운송체계 발전에서도 적지 않은 기여 를 할 수 있을 것이다. 또 한·중 양국이 자국 법규를 제정할 때 자국의 실정과 각자의 다목적 연계 운영의 실속을 고려한 맞춤형 보완이 필수적이라는 점도 고려됐다. 이를 통해 양국 간의 국제화물 복합운송을 발전시킬 때 “한·중 FTA”가 구축한 상호 신뢰 와 협력·상생의 기초를 전제하에서 같은 지역적 특성을 지닌 ‘한·중 복합운 송 협정’을 제정하여 양국의 입법상의 차이를 효과적으로 조정하고 기한을 정 하여 한중 화물 복합운송을 위한 법제 건설에 힘을 보탠다.
더보기With the “Belt and Road” Initiative and the signing of the Free Trade Agreement, Korea and China will continue to enter a new phase of economic and trade cooperation. In fact, even under the impact of COVID-19, the total volume of imports and exports between the two countries has been able to grow despite the difficulties. According to data from China’s General Administration of Customs in October 2020, the import and export trade between the two countries had reached RMB 1.45 trillion in the first three quarters of the same year, an increase of 1.1% year-on-year against the backdrop of the global economic downturn. The economic development is complemented by the demand for a more efficient and convenient logistics system in order to secure the results and continuously expand the market. As an important part of the so-called “comprehensive system of transport”, multimodal transport of cargoes, which is an integrated and efficient “door to door” mode, can undoubtedly become a “strong force” in the field of cargo transportation, as traditional unimodal transport is no longer able to meet all the needs of trade between the two countries. In order to vigorously develop multimodal transportation of cargoes, many shipping countries have increased the legislation on multimodal transportation of cargoes in accordance with various international conventions. Both Korea and China have the ambitious goal of building a “maritime power”, but they are somewhat conservative in the legislation related to multimodal transportation. The different political systems and cultural backgrounds of the two countries have led to some differences in legislation. Both sides also lack a certain degree of understanding of each other’s legal systems. Because of this, it is meaningful and necessary to sort out the legal systems of multimodal transport in both countries. In particular, the Korean legislation on multimodal transport and its various transport sections are distributed in various chapters of the Commercial Code. The 2010 Commercial Law Reform Bill, which regulates multimodal transportation, is still at the study stage and has not been passed by the Korean National Assembly. China’s legislation on multimodal transportation of goods and its various transport sections are scattered in the Civil Code, the Maritime Code and the laws and regulations on unimodal transportation, forming a loose legal system of multimodal transportation. There is a strong demand for the development of multimodal transportation of cargoes. The number of disputes on international multimodal transportation of goods between two countries is also expected to increase. However, after examining the relevant laws and regulations, it is easy to see that the existing legal system is inadequate to meet the increasing challenges due to partial deficiencies in the face of a new situation that may become increasingly complex. A prerequisite for solving the problem is to identify it. By means of “comparative law studies” to find the similarities and differences between the two countries’ legislation, Korea and China have both their own problems and legal dilemmas that need to be overcome jointly in terms of multimodal transport-related regulations. If this series of legal system deficiencies can be effectively improved, it can make a non-negligible contribution to the development of multimodal transportation of goods within the two countries, especially between the two countries, and even the entire integrated transport system. In addition, taking into account that the two countries must give priority to their own national conditions and the actual needs of their respective multimodal transport development in the formulation of domestic laws and regulations, the two countries will make targeted complements. Therefore, in the development of international intermodal transportation of goods between the two countries, based on the basis of mutual trust and mutual benefit and win-win cooperation of the “Korea-China Free Trade Agreement”, a “Korea-China Multimodal Transportation Agreement” with the same regional nature can be formulated. The “agreement” will effectively harmonize the differences in legislation between the two countries and cover all the systems that should be involved in order to promote the legal construction of multimodal transportation of goods between Korea and China.
