비오톱 1등급 토지 절대적 보전을 규정한서울특별시 도시계획조례의 위헌성 검토 = Review on Unconstitutionality of Urban Planning Ordinance of Seoul Metropolitan Government regulating Utter Preservation of Grade 1 of Biotope

서울특별시에서는 2009. 11. 11. ‘서울특별시 도시계획조례’ 제24조 [별표 1] 제1호 가목(4)으로 “비오톱(특정한 식물과 동물이 하나의 생활 공동체를 이루어 지표상에서 다른 곳과 명확히 구별되는 생물서식지)”이라는 새로운 유형의 개발행위허가 기준을 마련하면서, 비오톱 유형평가 1등급이고, 개별 비오톱 평가 1등급인 토지는 “대상지 전체”에 대하여 “절대적으로 보전하여야 한다”는 강력한 개발제한 규정을 신설하였음에도 불구하고, 절대적 보전 대상이 되는 토지에 대하여 세금 감면 등의 세제 혜택은 물론 일체의 보상에 관한 규정은 마련하지 않았다. “절대적으로 보전한다”는 의미는 문언 그대로 기존의 일체의 개발허가를 허용하지 않고 지금 현재의 상태를 그대로 유지한다는 것으로, 적어도 비오톱 유형평가 1등급이고, 개별 비오톱 평가 1등급인 토지에 대해서는“개발 제한”이 아니라, “개발의 절대적 금지 내지는 개발의 절대적 불허”조례에 해당하게 된다. 위와 같은 비오톱 평가를 이유로 개발을 제한하는 서울특별시 도시계획조례는 국토의 계획 및 이용에 관한 법률 제58조 제1항, 제3항, 동법 시행령 제56조, 국토교통부 훈령 제524호 개발행위허가운영지침 1-2-2 등에 근거를 두고 있는 것으로 보이지만, 국토의 계획 및 이용에 관한 법률 및 시행령 등에서 개발행위 자체를 절대적으로 금지하는 구체적인 별도의 규정이 없는 상태에서 유형평가 및 개별 비오톱 평가 모두 1등급인 해당 토지 전체에 대하여“절대적 보전”, “절대적 금지”를 하겠다는 것은 일정한 요건을 갖춘 경우 개발을 허가할 수 있는 기준을 마련한 위임규정의 목적을 초과한 것으로 볼 여지가 있다고 판단된다. 한편, 이미 개발제한구역에 관한 구 도시계획법 제21조나, 도시계획 구역 지정에 따라 행위 제한을 받은 토지소유자들에게 아무런 보상에 관한 규정을 두지 아니한 구 도시계획법 제4조에 대한 위헌소원에서 헌법재판소는 “재산권의 제한은 해당 토지를 원칙적으로 지정 당시의 지목과 토지현황에 의한 이용방법에 따라 사용할 수 있는 한, 재산권에 내재하는 사회적 제약을 비례의 원칙에 합치하게 합헌적으로 구체화한 것이라고 할 것이나, 종래의 지목과 토지현황에 의한 이용방법에 따른 토지의 사용도 할 수 없거나 실질적으로 사용·수익을 전혀 할 수 없는 예외적인 경우에도 아무런 보상 없이 이를 감수하도록 하고 있는 한, 비례의 원칙에 위반되어 당해 토지소유자의 재산권을 과도하게 침해하는 것으로서 헌법에 위반된다”고 판단하였다. 그런데 비오톱 유형평가 및 개별 비오톱 평가 1등급을 받았다는 이유로 개인 소유의 사유지에 대한 절대적인 보전을 강제하는 것은 해당 토지에 대하여 실질적인 사용·수익을 전혀 할 수 없도록 조례에서 규정하고 있는 것인데, 서울특별시 도시계획조례에서는 이러한 재산권의 침해와 공익간의 비례성을 회복할 수 있는 방법을 전혀 규정하고 있지 않다. 결국 개인의 재산권에 대한 강력한 제한(절대적 보전을 통한 개발의 일체 불허)을 통해 자연풍광 등의 환경보전이라는 그 이익이 반사적으로 사회 구성원 전체에게 돌아가는 것 임에도 불구하고 금전보상, 지정해제, 매수청구권, 재산세 감면 등과 같은 보완조치 없이 절대적 보전을 감수하도록 하는 것은 결국 해당 토지소유자의 재산권을 과도하게 침해하는 것으로서 헌법에 위반된다 할 것이다. 따라서 서울특별시 도시계획조례는 이러한 보완책을 마련하는 방법으로 시급히 수정되어야 할 것이다.
더보기On November 11, 2009, Seoul Metropolitan Government (“SMG”) added Paragraph 1 Ga (4) of Exhibit 1 to Clause 24 of Urban Planning Ordinance of SMG to set up new type of criteria for development permit by introducing “Biotope (i.e., an area of uniform environmental conditions providing a living place for a specific assemblage of plants and animals)” wherein a land falling into a category of both Grade 1 in Classification of Biotope and Grade 1 in Evaluation of Respective Biotope is strictly restricted in development by addressing “the entire place” under such category shall be “preserved absolutely”. However, any and all compensation including tax relief, such as tax abatement or exemption is silent in the Urban Planning Ordinance of SMG (the “Ordinance”). The term “preserved absolutely” in the Ordinance means remain an area as it is not allowing any development at all, and therefore the Ordinance results in “utter prohibition of development or no permit in development whatsoever” on at least an area of both Grade 1 in Classification of Biotope and Grade 1 in Evaluation of Respective Biotope. The Ordinance restricting development as a result of evaluation of Biotope is likely to be based on Clause 58 (1) and (3) of the National Land Planning and Utilization Act (the “NLPUA”), Clause 56 of the Enforcement Decree of the NLPUA, and the Permit and Operational Guideline on Development 1-2-2 of Order no.524 of the Ministry of Land, Infrastructure and Transport, wherein have no Clause to prohibit any development at all. Therefore, The Ordinance regulating “utter preservation” and “absolute prohibition” is beyond the power delegated by the NLPUA, the Enforcement Decree and the Order. Meanwhile, the Constitutional Appeals were made on Clause 21 regarding development restricted district of formerly known as the Act on Urban Planning and Clause 4 of the Act on Urban Planning due to absence of clause on compensation to those who own land restricted any development caused by establishment of urban planning district. The Constitutional Court of Korea decided that restriction on a property right is allowed on the ground that social restriction embodied in property right is consistent with the principle of proportionality as long as such property can be developed in accordance with zoning then determined and actual status of property, and therefore a restriction, with no compensation, not allow to use or develop property by zoning determined and actual status of property, or use or take benefit from property, is unconstitutional in that such restriction is violation of the principle of proportionality, which excessively infringes a property right of its owner. Enforcing utter preservation on a private land on the ground that such land falls into the category of both Grade 1 in Classification of Biotope and Grade 1 in Evaluation of Respective Biotope is what the Ordinance is regulating and at the same time the Ordinance regulates prohibition of actual use and benefit from such land. However, the Ordinance provides no way to achieve proportionality between public interest and an infringement of property right. Although a strong restriction on a property right (i.e., absolute prohibition of development by utter preservation) ultimately gives benefits to the entire member of society in the name of public interest of environmental preservation, such as preserving nature landscape, enforcing utter preservation with no measure of compensation, such as tax benefit in the name of tax abatement or exemption, monetary compensation, cancellation of restriction, or right of property owner to demand purchase, excessively infringes a property right of its owner, which is unconstitutional. Therefore, the Ordinance shall immediately be amended to provide a measure of compensation.
