북한의 법체계와 북한법 이해방법 : 북한 헌법상의 법령·정령·결정 등 입법형식을 중심으로 = North Korean Legal System and the Method of Understanding North Korean Law

이 글은 북한 헌법의 입법체계를 ‘법령’, ‘부문법’, ‘정령’, ‘규정’ 등을 중심으로 하여 살펴보았다. 북한법의 ‘법령’은 최고인민회의가 채택하는 최고의 법문건으로서 그 입법형식에는 성문법 체계를 갖춘 ‘법’과 문건 형식의 ‘...에 대하여’가 있는바, ‘법령’이 시행령을 포함하는 것이 아니라 성문법 형식의 ‘법’(1998년 헌법의 ‘부문법’)을 채택하는 방법이라는 점, 문건형식으로 되어 있는 ‘...에 대하여’가 법령으로 채택되는 점 등은 북한법상 ‘법령’이 남한에서의 의미와 다름을 보여주는 것이다. ‘정령’은 1998년 헌법 시행 이후 법의 채택, 수정시 최고인민회의 상임위원회가 내는 것으로서 그 대상은 헌법이 최고인민회의 상임위원회의 권한으로 정한 사항(내각의 구성, 행정구역 지정 및 개편, 훈장 등)이다. 1972년 헌법 개정 이후 1998년 헌법 개정 전까지 법이 모두 최고인민회의 상설회의 ‘결정’에 의하여 채택 또는 수정보충되었는데, 이는 최고인민회의 상임위원회에 정령권이 없었기 때문이었다. ‘부문법’은 북한 헌법이 남한법의 성문법 체계를 갖춘 법을 지칭할 때 사용하는 용어로서 최고인민회의의 ‘법령’ 또는 최고인민회의 상임위원회의 ‘정령’에 의하여 채택되고 ‘중요부문법’이 아닌 경우 최고인민회의 상임위원회가 독자적으로 채택하며 1998년 헌법 시행 이후 ‘부문법’의 수정보충은 모두 ‘정령’에 의하여 이루어지고 있다. ‘규정’은 두 가지가 있는데, 최고인민회의 상임위원회의 ‘결정’에 의하여 채택되는 ‘부문법’의 하위규정과 내각의 ‘결정’으로 채택되는 것이 있다. 하위법규의 명칭 및 형식과 관련하여 개성공업지구법제에 나오는 것은 ‘시행세칙’과 ‘사업준칙’인바, 이러한 명칭이 하위법규에 일반적으로 사용되는지는 확실하지 않으며 다양한 규범성 문건의 명칭과 형식이 사용되고 있을 가능성을 배제할 수 없으나, 1990년대 이후 하위법규에 대하여는 개성공업지구법과 관련한 것(시행세칙, 사업준칙) 등을 제외하고는 거의 알려진 바가 없다.
북한의 법체계를 남한 법체계와 비교하여 보면, 남한법의 경우 입법형식과 공포방법이 동일하지만(헌법, 법률, 대통령령), 북한법의 경우 입법형식과 채택방법이 다름을 알 수 있다. 즉 입법형식이 ‘법’인 경우 채택방법은 ‘법령’ 또는 ‘정령’이고, ‘규정’인 경우 채택방법은 최고인민회의 상임위원회의 ‘결정’ 또는 내각의 ‘결정’으로 되어 있다. 북한법체계의 또 다른 특징은 동일한 입법형식을 위계질서가 다른 기관이 채택할 수 있도록 되어 있고 동일기관에서 위계가 다른 법규를 채택할 수 있도록 되어 있는 점을 들 수 있다. ‘부문법’은 위계가 다른 최고인민회의와 최고인민회의 상임위원회가 채택할 수 있고, 최고인민회의 상임위원회는 위계가 다른 ‘부문법’과 ‘규정’을 채택할 수 있는 것이다. 나아가 동일한 기관이 위계가 다른 채택방법을 취할 수 있는데(최고인민회의 -‘법령’과 ‘결정’, 국방위원회 - ‘결정’과 ‘명령’, 최고인민회의 상임위원회 - ‘정령’, ‘결정’과 ‘지시’) 이들 사이의 관계가 명확하지 않다. 과거에 비하면 입법형식을 명확하게 정리한 측면은 진일보하였다고 할 수 있으나, 채택방법이 복잡하여 법체계의 불명확성을 불러오는 측면이 있으므로 법체계의 정합성과 통일성을 위하여 남한법과 같이 채택방법을 단순화시키는 방향으로 정비할 필요가 있을 것이다. 또한
법규의 공포절차를 명확히 규정하는 ‘부문법’을 채택하여 공개성과 투명성을 확보하여야할 것이며 궁극적으로 ‘법치주의’를 헌법적으로 선언하고 국가운영의 기본원칙으로 정립하는 방향으로 나아가야 할 것이다.
한편, 정령권의 귀속은 헌법개정에 따라 변동되어 왔는바, 1998년 헌법은 정령권을 최고인민회의 상임위원회에 복귀시킴으로써 1948년 헌법체제로 복귀하였다. 이러한 정령권의 최고인민회의 상임위원회 복귀와 1990년대 이후 ‘부문법’ 채택과 법 수정보충의 급격한 증가는 아직 법치주의라고 부를 정도까지는 이르지 못하였으나 과거와 달리 법이 “국가관리의 기본무기”(1998년 헌법 제18조)가 되어가고 있음을 보여준다. 북한법을 단순히 억압적 도구이거나 정치의 수단에 불과하다고 보고 위계상으로도 수령과 노동당의 교시의 하위법규에 불과하여 최근 북한법의 변화가 큰 의미를 갖지 못한다고 보는 것은 일면만을 봄으로써 실체를 놓칠 위험이 크다. 북한법의 변화와 그에 따른 북한법의 사회적 기능과 역할의 확대, 그것이 북한사회 및 향후 남북관계에 갖는 함의에 대하여 바로 보는 균형 잡힌 시각이 필요하다. 한편, 2009년 헌법은 북한법의 역할 확대라는 변화의 흐름을 1972년 헌법으로 되돌리는 퇴행적인 성격을 가지고 있는바, 이러한 2009년 헌법의 퇴행성이 향후 북한입법에서 어떻게 나타날지에 대하여 주목할 필요가 있다.
This paper examines the legislative system under the North Korean Constitution (“Constitution”) with an emphasis on bub-ryeong, bu-moon-bub, decree (jung-ryeong) and regulation (kyu-jeong). In the North Korean law, bub-ryeong is the foremost legal document adopted by the Supreme People’s Assembly. North Korea has a different usage of the term bub-ryeong from South Korea. Legislative form of bub-ryeong includes “law” from the civil law system and “with regard to…” which takes the form of document. Compared to the same word in South Korea, (a) bub-ryeong does not include enforcement ordinances or regulations and (b) “law” is adopted by bub-ryeong as the civil law form while the document form “with regard to….” is also adopted by bub-ryeong.
Since the enforcement of Constitution amended in 1998, decree (jung-ryeong) is issued when the Presidium of the Supreme People’s Assembly adopts or amends law. Any matter that the Constitution prescribes to be under the authority of the Presidium of the Supreme People’s Assembly (the organizing of the Cabinet, the designation or reform of the administrative district, bestowal of a medal, etc.) is subject to decree (jung-ryeong) issued by the Presidium of the Supreme People’s Assembly.
During the periods between the 1972 amendment of the Constitution and the 1998 amendment of the Constitution, every law had to be adopted, amended, and supplemented by the “decision” of the Standing Committee of the Supreme People’s Assembly because the Standing Committee of the Supreme People’s Assembly did not have the power to issue decree (jung-ryeong) during such periods.
Bu-moon-bub under the Constitution is equivalent to the law under the formalities of the civil law system of South Korea. It is adopted by either the Supreme People’s Assembly’s bub-ryeong or the Presidium of the Supreme People’s Assembly’s decree (jung-ryeong). In case where it is not the ‘important bu-moon-bub,’ the Presidium of the Supreme People’s Assembly may independently adopt the bu-moon-bub. Since the enforcement of the Constitution amended in 1998, the amendment and supplement of the bu-moon-bub is achieved through decree (jung-ryeong). There are two types of regulations: subordinate regulations of bu-moon-bub which is adopted by the decision of the Supreme People’s Assembly and those adopted by the decision of the Cabinet. Regarding the terms and forms of the subordinate regulations, the Kaesong Industrial Zone Act stipulates the Enforcement Regulations and Operating Rules. It cannot be said for certain that these terms are generally used as subordinate regulations. Also, the possibilities that terms and forms of various normative documents are used cannot be excluded.
However, there is little information on subordinate regulations since the 1990s, except for those related to the Kaesong Industrial Zone Act.
In comparison with the South Korean legal system where promulgation form of the law is the same as its legislative form (constitution, act and enforcement decree), North Korea’s legislative form differs from its mode of adoption. In other words, when the legislature passes a “law,” it can be adopted by either bub-ryeong or decree (jung-ryeong). When the legislature passes a regulation, the adoption is made by either the decision of the Presidium of the Supreme People’s Assembly or the Cabinet. Another different aspect of the North Korean legal system is that
institutions with different hierarchy can adopt the same legislative form and one institution can adopt legislative forms with different hierarchy. Bu-moon-bub can be adopted by either the Supreme People’s Assembly or the Presidium of the Supreme People’s Assembly, which have different hierarchy. Also, the Presidium of the Supreme People’s Assembly can adopt both bu-moon-bub and regulation, which have different hierarchy. Furthermore, one institution can take adoption methods with differing hierarchies, (Supreme People’s Assembly - bub-ryeong and ‘decision,’
the National Defense Committee - ‘decision,’ and ‘order,’ Presidium of the Supreme People’s Assembly - ‘decree,’ ‘decision,’ ‘direction’), but the relationship among them
is not clear. Although, compared to the past, the legislative form became clearer, which can be seen as improvement, the complicated mode of adoption makes the legal system obscure. In order to achieve coherence and unity, North Korea needs to simplify its mode of adoption like that of South Korea. In addition, North Korea should adopt a bu-moon-bub that clearly stipulates the procedure of promulgation in order to achieve transparency and openness. Ultimately, the country should constitutionally declare “the rule of law” which must serve as the principle of
governing the country.
As the Constitution has been amended, the jurisdiction of decree-adopting power has changed. The 1998 Constitution has restored the decree-making power to the Presidium of the Supreme People’s Assembly, which is a return to the 1948 constitution system. However, despite the restoration of the decree-making power to the Presidium of the Supreme People’s Assembly, the adoption of the bu-moon-bub in the 1990s and the sudden increase in the amendment and supplement of law, the current North Korean legal system cannot be viewed as being at the stage of “rule of law.” Rather, the aforementioned changes may be viewed as implication that law became “the basic weapon for governance” in North Korea.
