ADR을 통한 통신 분쟁 해결의 현황 및 개선방안 = A Study on the Current Situation and the Improvement Plan of Communication Dispute Resolution through the ADR

본 연구는 최근 국내·외 방송과 통신서비스 시장에서 방송과 통신시장 간의 융합, 서비스 간의 융합 및 결합판매 방식이 보편화되고, 그에 따라 방송통신서비스 사업자와 이용자 사이에 발생하는 크고 작은 분쟁의 해결방안 중 법원 이외의 기구 또는 제도에 의한 분쟁해결 방안으로서의 ADR(Alternative Dispute Resolution) 제도를 검토하고 그 개선방안을 논의하였다. 국내에서 방송통신서비스 사업자와 이용자 간에 발생하는 분쟁을 해결하기 위한 제도는 사업자들의 고객센터, 시민단체의 조정 또는 중재, 한국소비자원에 민원제기 및 소비자분쟁조정위원회에의 회부, 방송 통신위원회의 재정 및 알선 등이 있다. 그러나 방송과 통신서비스와 같이 일정 부분 전문적인 지식이나 경험이 필요한 분쟁을 해결하기 위해 서로 다른 설립 목적 및 지향점을 가진 기구들이 그 분쟁해결을 시도하는 경우, 그 결과도 다양하게 도출될 수밖에 없다. 이러한 분쟁해결 절차 및 결과의 도출 방식은 분쟁 사실은 비슷하거나 동일하지만 그 분쟁해결 결과가 천차만별일 수 있다는 점에서 가장 큰 문제점이 있다. 따라서 본 연구에서는 우리나라와 영국의 방송통신 규제기관에 행해지고 있는 ADR 제도의 운용 현황 등을 중심으로 비교·검토하여, 분쟁해결 제도의 문제점을 도출하고 그 개선 방안을 제시하였는바, 그 주요 내용은 다음과 같다. 우선, 국내 방송통신서비스 분쟁해결에 이용되고 있는 ADR 제도 전반에 대하여 개괄적으로 살펴 본후, 방송과 통신서비스에 대한 전문규제기관인 방송통신위원회에 의한 재정 및 알선제도에 대해서 살펴 보았다. 그 결과 방송통신사업자와 이용자 사이에 발생하는 분쟁의 해결에 있어 방송통신위원회의 재정과 알선에는 그 한계가 있어 개선이 필요하다고 판단되었다. 둘째, 국내 방송통신위원회의 방송통신 분쟁해결을 위한 ADR 제도 개선에 도입할 수 있거나 참고가 될수 있는 제도로서 영국의 Ofcom에서 도입하고 있는 ADR 제도를 분석하여 그 시사점을 도출하였다. 영국에서 방송통신 분쟁해결을 위한 현행 ADR 제도는 2002년 EU에서 제정한 6개의 지침 중 기본지침의 준수를 위한 통신법의 개정과정에서 탄생하였다. 즉, 2003년에 개정된 영국 통신법은 종래 5개로 분할되어 있던 방송통신 관련 규제기관을 Ofcom으로 통합하였고, Ofcom은 개정 통신법 Chapter Ⅱ. Section 52의 규정에 따라 재정제도 외에도 Telecom Adjudicator 및 Ombudsman에 의한 ADR 제도의 운용이 가능하게 되었다. 따라서 2003년부터 통신사업자와 소비자 간의 분쟁을 처리할 수 있는 독립기관으로 Otelo와 CISAS가 Ofcom에 의해 승인되었으며, Ofcom은 Otelo와 CISAS가 운용하고 있는 ADR 제도의 성과분석, 의견수렴, 개선된 권고안의 마련 및 그 시행 등을 담당하고 있다. 이에 본 연구에서 영국의 Otelo와 CISAS의 권한, ADR 절차 및 그 효력 등에 관해 심층적으로 분석한 결과, 영국의 Otelo와 CISAS도 ADR에 의한 방송통신 분야의 분쟁해결 절차를 수행함에 있어 많은 시행착오를 거치면서 개선되어 신속성, 공정성, 투명성, 편리성 및 효율성이 있는 분쟁해결 제도로 정착되었다는 사실은 우리나라의 분쟁해결 제도 개선에 많은 시사점을 주고 있다. 셋째, 국내 방송통신위원회의 재정 및 알선제도와 영국 Ofcom의 ADR 제도를 비교·검토함으로써 우리 나라의 방송통신서비스 분쟁해결을 위한 ADR 제도의 개선방안을 제시하였다. 우리나라의 ADR 제도의 신뢰성, 공평성 및 효율성을 유지하면서 간이·신속·저비용의 장점을 살릴 수 있는 개선방안으로 방송 통신 분야의 분쟁해결을 전담할 수 있는 소수의 분쟁해결 기관의 설립 또는 지정, ADR을 통한 분쟁해결 처리결과의 효력 차이에서 나타나는 문제점의 개선 그리고 분쟁해결 사례의 공표 방안 등을 제시하였다. 최근 방송통신위원회는 방송통신서비스 시장의 발전과 더불어 다양·복잡해지고 있는 분쟁의 해결을 위해 이용자의 피해구제 측면에서 ADR 제도를 개선하고자 노력하고 있다. 특히 통신 분쟁에 대하여 오래 전부터 전담기구에 의한 ADR 제도를 운용해 온 영국의 사례에서 보는 것과 같이, 향후 신속·공평·저비용의 편리한 ADR 제도의 장점을 살리면서 정부, 사업자 및 이용자 모두가 수긍할 수 있는 분쟁해결 제도의 개선이 있기를 기대한다.
더보기With more and more broadcasting and communication service providers offering their combined services in domestic and overseas markets, this study aims to review and find potential improvements to the ADR(Alternative Dispute Resolution) system as a method independent from the court or any current system of justice involving small and large scale disputes between service providers and consumers. Domestically, there are systems and measures for resolving disputes between service providers and consumers such as contacting customer service centers, arbitration from civil organizations, filing civil complaints with the Korea Consumer Agency or its Consumer Dispute Arbitration Committee and consulting the Korea Communication Commission. Attempts towards resolution by organizations with different purposes, however, will inevitably lead to different results since communication and broadcasting services require professional knowledge and experience in dispute resolution, at least to some degree. The biggest problem is that, even though procedures towards resolutions are mostly similar or identical, the resolutions themselves tend to differ extremely. Therefore, this paper makes comparisons between the current status of the ADR system in Korea and that of the U.K., the details of which are following: First, an overview of the ADR system is offered, which applies to local broadcasting service dispute, then this paper takes a deeper look at the budget and mediation system of the Korean Communication Commission(KCC hereinafter). We then explain why our conclusion is that the current limits on KCC``s budget and mediation system need to be lifted. Secondly, After a review of ADR in 2005, Ofcom recommended guidelines to improve the effectiveness of ADR in four aspects, that is ensuring complainants, providing transparency, assessing accessibility and consumer satisfaction and ensuring compliance. In addition, the Ofcom``s review of its ADR schmme policy is presently in progress from 20. October this year. we present an overview of the ADR system applied by Ofcom in the U.K. along with mentioned lessons from U.K. cases, such as Otelo and CISAS, which may be benchmarked or introduced by the KCC for the Korean market. Thirdly, we provide a direct comparison between KCC``s mediation system and ADR of Ofcom, and accordingly make suggestions for our local service dispute resolutions. and In this paper we emphasized the improving necessity of ADR scheme, especially in point of strengthen the strength and make up for the weakness of ADR scheme. we offer three improvement ways to apply the Ofocm`` case to our nation without sacrificing the merit and advantage of ADR scheme as follow: (1) the features of confidence, equity, and efficiency, (2) the advantage of low-cost, and (3) the procedures easy used and speed. The first improvement plan is to set-up independent organizations for dispute resolution in the field of broadcasting and telecommunications, and the second plan is to treat the effect of ADR``s result without discrimination, and the third plan is to release to the media, website, official report and etc. of the dispute resolution. Of course, three plans take care of countermeasure to prevent from the invasion of privacy or personal information. Lastly, as in the U.K``s cases mentioned above, the ADR scheme looks forward to materially improvement that the dispute resolution makes, which the consumer, service provider and government gets satisfied also in korea, more sense, more quickly, and more less cost. we highlight recent efforts by the KCC to improve the system to deal with more and more complex dispute in our growing communication and broadcasting market, and then conclude with brief insights on future outlooks, and we hope that the results of this paper will contribute to improve the communication dispute resolution system which resolve dispute between service providers and consumers and have a great implications for the Korea Communication Commission and common carrier.
