성소수자 혐오의 범죄화와 사법적극주의: 브라질 연방대법원의 ADO 26, MI 4733 병합사건을 중심으로 = The Criminalisation of homotransphobia and Judicial Activism: Analysis on the Consolidated Cases of ADO 26 & MI 4733 (2019) of the Brazilian Federal Supreme Court

지난 2019년, 브라질 연방대법원(Supremo Tribunal Federal)은 브라질 사회주의인민당(Partido Popular Socialista)과 브라질 게이, 레즈비언, 트랜스젠더 연합(Associacao Brasileira de Gay, Lesbica, e Trans-genero)에 의해 제소된 입법부작위위헌직접소송인 ADO 26 및 입법부작위명령인 MI 4733 병합사건에 대한 판단을 통해 브라질 내 성소수자에 대한 혐오와 차별행위를 범죄화하는 획기적인 결정을 내렸다. 이러한 결정은 특히 최근 자이르 보우소나루(Jair Bolsonaro) 대통령이 이끄는 극우파 정권의 수립 이래 브라질 사회 내 성소수자 혐오가 지속적으로 심화되어왔음을 고려할 때 성소수자 인권 보호의 관점에서 더욱 유의미한 사법적 결단이라 평가될 수 있다.
이 사건 결정의 요지는 결국 성소수자 대상 혐오범죄를 기존에 이미 존재하고 있던 인종차별범죄 처벌에 관한 특별법인 Lei 7.716/1989로 포섭함으로써 그 처벌의 근거를 마련한다는 것에 있다. 연방대법원은 성소수자 혐오가 이른바 사회적 인종주의(racismo social)의 한 태양에 해당한다는 전제 하에 이와 같은 결론에 다다랐는데, 따라서 이 사건 결정을 이해함에 있어 자연히 가장 우선적으로 요구되는 과제는 과연 성소수자에 대한 혐오를 인종차별로 바라볼 수 있는 논리적 근거가 어디에 있는지에 대한 점검이다. 연방대법원은 인종차별이란 단지 생물학적·형질학적으로 정의될 수만은 없는 정치적이고 사회적인 개념으로서, 이는 어떠한 취약집단을 특정의 사회구조속에서 열등한 지위에 위치시키고, 그러한 위계화로 말미암아 당해 집단에 속한 이들의 존엄성과 인간성이 부정되는 상황을 정당화하며, 이들을 변태적이고 일탈적인 타자적 존재로 묘사함으로써 그 사회의 법체계가 제공할 수 있는 온당한 법적 보호로부터 괴리시키는 권력적 표상으로서의 이데올로기라고 판시하였다. 그렇다면 성소수자에 대한 차별을 정당화함으로써 이들을 사회적 다수집단으로부터 배제시키는 성소수자 혐오의 작동방식은 인종차별과 일치한다는 점에서 성소수자를 사회적 인종의 하나로 보아 인종차별처벌법을 적용할 수 있다는 결론이 도출된다.
한편 이처럼 인종차별처벌법의 적용을 통해 성소수자 혐오를 형사적으로 규제하겠다는 이 사건 결정의 내용은 권력분립의 원칙과 죄형법정주의에 관하여도 일련의 물음을 제기한다. 민주적 헌정질서의 근간을 이루는 권력분립의 원칙으로부터 의회의 입법형성재량이 존중되어야 한다는 요청이 도출되고, 동시에 죄형법정주의는 오직 의회의 입법권에 의해 제정된 법률만이 새로운 범죄를 창설할 권한을 가진다는 제한을 가한다. 그럼에도 연방대법원이라는 사법기관의 결정을 통해 성소수자 혐오에 기인한 차별행위를 형사적으로 규율할 수 있는 근거는 어디에서 도출되는가· 이러한 의문에 대하여 연방대법원은 이른바 사법적극주의를 통해 답하였다. 즉 권력분립의 원칙이란 단지 국가권력기관 사이의 상호배타적 분리를 넘어 서로가 헌법적 가치에 부합하는 방향으로 움직이게끔 추동하는 상호통제 역시 포함하는 개념이고, 그렇다면 사회 내 취약집단의 보호를 위한 법률을 제정할 헌법적 책무를 의회가 스스로 저버린 경우 사법부는 헌법재판 내지 사법심사를 통해 개입할 수 있다는 것이다. 특히 다수결제 의사결정기관인 의회는 본질적으로 소수자의 권익 보장에 있어 어려움을 겪을 수밖에 없다는 점에서, 이 사건 결정이 사법적극주의적 태도에 기반을 두고 헌법규범의 수호자로서의 연방대법원이 이른바 헌법합치적 해석을 시도한 것이라 평가할 여지가 존재한다.
이와 같은 분석 위에서 이 글에서는 마지막으로 이 사건 결정이 대한민국의 인권 상황에 주는 함의에 대하여도 간략히 짚어본다. 성적 지향 또는 성별정체성에 기한 차별을 금지하는 명문의 법률규정이 거의 전무하는 법제도적 현실 속에서, 입법부는 물론 사법부 역시 국내 성소수자의 보호에 소극적인 태도로 일관해온 것이 사실이다. 그럼에도 불구하고 사법부의 주요한 존재이유, 나아가 민주헌법의 근본 가치는 결국 국민의 인권 보호에 있다는 점을 고려하면, 성소수자를 포함한 많은 사회적 소수자들의 인권 보장 문제를 다수결제 기관인 입법부에만 일임하기에는 그 한계가 분명하다는 사실을 소극적으로 묵과하여서는 안 된다. 따라서 이 사건 결정은, 사법적극주의적 태도를 취함으로써 성소수자가 처한 차별과 혐오의 현실에 대응할 수 있는 가능성을 보여주는 동시에 성소수자의 인권 보장이라는 과제 앞에 선 사법부의 역할이 무엇인지에 대한 논의의 필요성을 던져준다는 점에서 보편적 함의를 지닌다.
In 2019, the Federal Supreme Court of Brazil (“the Court”) criminalised discrimination and hate incidents against gay and transgender people in its ruling on the consolidated cases of ADO 26 and MI 4733, which were brought before the Court by the Popular Socialist Party and the Brazilian Association of Gay, Lesbian, and Transgender. The Court’s ruling is even more noteworthy in terms of the human rights protection of LGBTQ+ people as it came at a time where the political climate of Brazil is witnessing a resurgence in visible homotransphobia.
The Court ruled that homotransphobic acts can be penalised through application of the already-existing anti-racism law (“Lei 7.716/1989”). The Court’s ruling assumes that homotransphobia is an expression of ‘social racism.’ Therefore, an analysis of the ruling requires understanding of the logical grounds that constitute the Court’s assumption. According to the Court, racism is a socio-political notion which cannot simply be defined in a purely biological or physical sense. The Court saw that racism is essentially a political ideology which relegates certain vulnerable groups of people to an inferior status within the social structure by branding them as the perverted and deviant “Others” and alienating them from fair protection within the society’s legal system. From this viewpoint, since the mechanisms of racism and homotransphobia are homogeneous, it is logically plausible to liken homotransphobia to racism and to apply the anti-racism law to discrimination and acts of hate against gay and transgender people.
This ruling also bears a series of legal conundrums regarding the principles of separation of powers and rule of law, especially the principle of nulla poena sine lege in criminal law. These principles declare that one can only be penalised by laws established via legislative measures and that the legislative power of the parliament shall be respected. Then on what grounds could the Court in this case criminalise certain acts against LGBTQ+ people? Does this ruling inevitably violate the limitations set by these principles? Judicial activism may be the key towards answering these questions and reconciliating the tensions between the Court’s ruling and the aforementioned principles. As the separation of powers theory focuses on maintaining checks-and-balances rather than mere non-intervention among different branches of government, one can argue that the judiciary can engage in judicial activism, mainly using the measures of constitutional or judicial review, when the legislators fail to fulfill their constitutional duty to pass the laws that adequately protect the rights of social minorities. Since the parliament’s majoritarian nature poses serious challenges to its capability to solve the minority problems, it is plausible to view this ruling as the Court’s judicial attempt of constitutional interpretation on the basis of judicial activism.
Upon such analysis, this paper also briefly examines the probable implication of this ruling on the issues of human rights in South Korea. Besides the near absence of any written law that explicitly prohibits discrimination based on one’s sexual orientation or gender identity, both the National Assembly and the Judiciary have willingly neglected their constitutional duties of protecting the rights of the social minorities, including the LGBTQ+ people. However, given that both the main raison d’etre of the judicature and the fundamental values of democratic society are rooted in the human rights protection of its citizens, the South Korean courts should step up their role in protecting minority groups when the legislative institution is limited in its ability to deal with minority problems because of its majoritarian decision-making character.
Therefore, this ruling on the consolidated cases of ADO 26 and MI 4733 has rather universal implications in terms that it shows the possibility of protecting the human rights of LGBTQ+ citizens via judicial activism and opens up a discussion on the role the judiciary should play in guaranteeing protection of human rights of the sexual minorities.
