비교법연구(比較法硏究) : 프랑스의 법조인 양성제도의 현황과 비교법적 함의 = The System to Raise the Legal Professionsin France and its Implication in Korea

In 2007, the law school is adopted in South Korea, as a system to raise the legal professions such as judge, prosecutor, attorney etc. From 2017, the law school will be the unique way to raise the legal professions, being supposed to be abolished the National Judicial Examination(NJE), which is now an alternative way. But the question is that the abolition of NJE is righteous and desirable in the regard of justice and efficient education for the future lawyer. Therefore, the purpose of this article is to introduce the french system as comparative review, which will give an new point of view to approach to the question. The french system to raise the legal professions is known for its dualism. The judge and the prosecutor have to pass the national concours to enter the school of Magistrate(Ecole national de Magistrate), then, the lawyer should pass the exam to enter the School of Lawyer(Ecole d’avocat). This french dualism has lots of advantage to make sure the fairness and the efficiency to raise the legal professions. Regarding that the current law school system is criticised about its unfairness and inefficiency in Korea, the French system can be one of the excellent comparative models for the korean system which is on the discussion about the abolishment of NJE. To solve the justice deficiency and unfairness, NJE sould be sustained only as the system to raise the national magistrate, which will help the law school to be more efficient education for the lawyer.
