기후정의 실현을 위한 정책 개선방안 연구(Ⅰ) = A Study on Improving Policy for Achieving Climate Justice (1)
Ⅰ. 서 론
ㅇ 기후변화협약 파리협정 서문에 기후정의의 중요성이 명시되는 등 국내 기후변화 대응정책을 수립함에 있어 기후정의의 개념이 점차 중요시됨
ㅇ 기후정의에 관한 종래까지의 논의는 주로 온실가스 배출의 역사적 책임을 묻는 국관계의 관점에서 전개되었으며, 기후변화 대응을 위한 국내정책과 관련하여 기후정의 관점에서 논의된 바는 없었음
ㅇ 기후변화는 다양한 사회영역에서 불평등 문제를 불러올 수 있으며, 특히 기후위기 취약 계층에 대한 분배적 정의의 관점에서 우선적 보호정책의 시행이 시급함
ㅇ 기후정의를 기본원칙으로 하는 체계적인 기후변화 대응정책의 확대·강화가 필요함
ㅇ 본 연구의 목적은 기후정의 개념을 구체화하고 현행 관련 법제도와 사례를 분석하기 위한 분석틀 마련, 그리고 분석 결과를 바탕으로 한 정책 개선방안을 제안하고자 함.
- 총 3개년간의 연구과제로 기획되었음. 1년차인 이번 연구에서는 기후정의의 개념을 구체화하여 분배적·절차적·생산적·인정적 정의의 세부정의로 구성된 분석틀을 제시 하고 분배적 정의의 관점에서 법제도·사례를 분석해 법제 개선방안을 제시함
Ⅱ. 기후정의에 관한 이론적 배경 및 요소
1. 기후정의의 배경과 필요성
ㅇ 기후정의는 기후변화협약의 “공동의 그러나 차별적 책임” 원칙, 환경정의 운동 및 이론에 기반한 국제적 수준의 기후정의 운동, 학계의 기후정의 및 윤리 논의로부터 영향을 받음
ㅇ 기후정의는 환경정의의 문제의식을 공유하면서도 기후변화 문제가 갖는 특징으로 인해 정의의 범주가 국가 간으로 확장되며, 해결의 주체 또한 개별국가를 넘어선 국가 간 협력체계를 강조함
2. 기후정의의 구성요소
□ 분배적 기후정의
ㅇ 기후변화를 불러일으킨 원인 제공자와 피해자 사이의 불일치 및 그로 인한 기후변화에 대한 책임의 분배문제와 기후변화로 인한 영향과 그 대응 능력에 있어서의 차이에 따른 불평등 해소
□ 절차적 기후정의
ㅇ 기후변화 정책의 수립 및 시행, 검토 과정에서 이해당사자들의 의미 있는 참여를 어떻게 이끌어내고, 보장하며, 되먹임(피드백) 과정을 구축할 것인가에 관한 문제점 인식과 해결방안 모색
□ 생산적 기후정의
ㅇ 기후변화의 직접적 원인인 이산화탄소 등 대량의 온실가스를 배출하는 현재 산업구조의 전환과 그러한 전환과정에서 노동(자)을 포용하는 정의로운 전환의 실현
□ 인정적 기후정의
ㅇ 인간이 아닌 비인간생물들을 인정하고 포용하는 생태적 관점에서의 기후변화 대응정책의 수립과 실현
ㅇ 국내 산업보호 등 자국 중심의 이해관계를 넘어서 지구적 차원에서의 공동의 노력과 협력 실현
Ⅲ. 기후정의 관련 법제도 검토
1. 분배적 기후정의
□ 온실가스 감축목표 설정 및 이행
ㅇ 온실가스 감축목표의 설정은 법률이나 시행령에서 규정하지 않고 『녹색성장국가전략』과 이에 근거한 『기후변화대응 기본계획』 및 『온실가스감축로드맵』에서 정하고 있으나, 감축목표의 적정성을 판단할 수 있는 구체적 기준이나 지침의 입법을 통한 규정 필요
ㅇ 구체적인 감축목표 설정과 이행대책의 수립 등에 있어 지불 능력 원칙, 부문별 및 세대간 형평성 등을 고려하여 기후정의의 시각에서 전면적인 개선책이 마련될 필요가 있음
□ 기후변화의 영향과 피해 - 기후변화적응
ㅇ 기존의 기후변화 적응정책은 기후변화로 인한 취약계층의 파악과 지원에 집중해옴
ㅇ 보건분야 및 재난분야에 대한 현행 법제도를 분석한 결과, 기존에 시행해오던 취약계층 대상 보건정책 또는 통상적 재난과 구분되는 기후변화에 따른 영향과 특수성을 반영한 정책과 대응이 부재하며, 기존의 보건·재난분야 정책과 기후변화정책의 통합 시행 필요
2. 절차적 기후정의, 생산적 기후정의, 인정적 기후정의
ㅇ 절차적 기후정의: 현행 법제도는 환경정책 수립시의 의견 청취 등에 그치나, 많은 기후변화 대책은 정부의 정책 시행만으로 이루어지지 않고 사업자, 국민 등 이해관계자의 이해와 협조를 통한 변화와 행동을 필요로 하므로, 이를 고려한 정책 수립과 시행 필요
ㅇ 생산적 기후정의: 신기술의 개발과 사업화에 대한 지원정책이 논의 및 시행되고 있으나, 화석연료 등 자원의 투입단계부터 기후변화에 대한 영향을 고려하는 생산구조의 전환이 필요함. 이 과정에서 전환대상 업종에 종사하는 노동자에 대한 배려와 전환교육 필요
ㅇ 인정적 기후정의: 국내 기후변화 대응정책의 입안 시 국제적 차원의 연대와 협력을 강화하고 보다 적극적이고 전향적인 방안을 모색하며, 기후변화 영향에 취약한 비인간 생물을 포함한 생태계 전반의 관점을 고려한 대응 필요
Ⅳ. 기후부정의 사례 검토
1. 기후부정의 사례 도출
ㅇ 학술 및 언론 영역에서의 기후정의 관련 텍스트의 빅데이터 분석 결과, 불평등과 양극화, 취약계층 등과 높은 연관성을 보이고 있음. 특히 폭염과 한파, 수온 상승 등 기후변화로 인한 피해와 매우 밀접한 연관성을 보이고 있어 이를 바탕으로 보건, 재난 및 재해, 대기환경 및 교통, 해양 및 수자원, 산업 및 에너지의 5개 분야로 사례를 분류함
2. 분야별 기후정의 사례 분석
□ 보건
ㅇ 폭염과 한파로 인한 온열 및 한랭질환 때문에 발생한 환자 및 사망자 수를 분석한 결과, 연령대 및 지역에 따라 불평등의 정도가 통계적으로 유의미한 차이가 있음이 확인됨
□ 재난 및 재해
ㅇ 기후변화로 인한 강수패턴 변화로 봄·가을은 강수량이 감소하여 가뭄이 증가하는 한편, 여름은 강수량 증가와 집중호우 등으로 인해 계절적·지역적 편중현상의 심화가 예측됨
ㅇ 부산광역시 기장군에서 2014년 8월에 발생한 폭우 및 침수 사례를 분석한 결과, 같은 읍면동 내에서도 침수 발생 구역과 그렇지 않은 구역 사이에 사회취약성 차이가 발견됨
□ 대기환경 및 교통
ㅇ 미세먼지: 기후변화로 인한 한반도 대기 정체로 미세먼지 농도 악화가 우려되는 가운데, 사회경제적 환경과 미세먼지로 인한 피해 사이의 상관관계가 복수의 연구로 확인됨
□ 해양 및 수자원
ㅇ 수온 및 해수면의 상승으로 인해 어종 변화, 적조 등 어업 피해와 해안침식과 범람에 의한 재난이 예상되나, 장기간에 걸친 변화가 예상되어 구체적인 대책이 없는 실정임
□ 산업 및 에너지
ㅇ 에너지 생산/소비지역의 불균형과 이로 인한 건강 피해, 에너지 복지 등의 과제 확인
□ 기타
ㅇ 사회시스템: 기후변화로 인한 영향, 특히 재난과 같은 단기적 영향으로 인해 2019년 9월 일본 치바현에서의 태풍으로 인한 장기 정전 사례처럼 통상적인 대비와 대응을 넘어 사회시스템 전반의 붕괴를 가져올 수 있어 이에 대한 고려가 필요함
Ⅴ. 결론 및 제언
ㅇ 본 연구에서 기후정의란 분배적, 절차적, 생산적, 인정적 정의의 네 가지 부분적 정의가 모두 구현된 상태 또는 가치로 정의하며, 이러한 관점을 바탕으로 올해 1차 연도 연구에서는 분배적 정의의 관점에서 국내의 기후정의와 관련된 법제도 및 사례 분석을 실시함
ㅇ 기후변화 발생에 대한 책임, 즉 온실가스 감축과 관련한 목표 설정을 법령에서 규정하고 있지 아니하여, 그 적정성을 판단할 수 있는 법적 근거 마련과 함께 그 책임의 이행에 대해 부문별·세대간 형평성 등을 고려한 전면적 개선책이 마련될 필요 있음
ㅇ 기후변화 적응과 관련하여 보건분야 및 재난분야의 법제도를 분석한 바, 통상적인 해당분야의 정책과 구분되는 기후변화 대응정책의 고려 및 수립이 이루어져 있지 않은 반면, 사례를 분석했을 때 보건분야(폭염, 한파 등) 및 재난분야(홍수 등)의 기후변화의 영향이 취약계층에서 더욱 심각하며, 적응 및 대응능력에도 차이가 있음이 확인되어, 기후정의 및 분배적 정의의 관점을 고려한 정책 개선의 필요성이 대두됨
ㅇ 한편, 분배적 정의를 제외한 절차적 정의, 생산적 정의, 인정적 정의에 관한 내용은 법제도 및 사례 분석에서 쉽게 드러나지 않음. 이에 따라 차년도 이후 해당 부분적 정의에 기반한 법제도 및 사례분석을 실시하여 그 결과를 바탕으로 기후변화 대응정책과 관련해 기후정의를 실현하기 위한 종합적인 정책 개선방안을 제시하고자 함
Ⅰ. Introduction
ㅇ The concept of Climate Justice is growing in importance for the measures for climate change, reflected in the preamble of the Paris Agreement.
ㅇ Climate Justice is mainly discussed in the context of international relations, stressing the historical responsibility of GHGs emissions, and at the domestic level, the discussion was limited only to the vulnerable groups.
ㅇ Climate change may occur unequally in various social area, so an extensive policy which reflects the concept of Climate Justice is needed.
ㅇ The objective of this research is to form a concrete concepot of Climate Justice, build an analytical framework for an analysis of the current legal system and related cases, and make suggestions for improving climate change policy.
- This research was planned as a three-year research project, and in this year we clarified the concept of Climate Justice with an analytical framework which describes the distributive, procedural, production, and recognition justice.
Ⅱ. Theoretical Background and Constituents of Climate Justice
1. Background and necessity of Climate Justice
ㅇ Climate Justice arises from the “Common but Differentiated Responsibilities” principal of the UNFCCC, international climate justice movements based on the theories and movements of Environmental Justice, and academic discussions related to Climate Justice.
ㅇ Climate Justice shares commonalities with Environmental Justice, but its definition of justice is comparably larger owing to the fact that it is fundamentally an international issue, for which the main solution is transnational cooperation.
2. Constituents of Climate Justice
□ Distributive Justice
ㅇ Mismatch between contributors to and victims of climate change, distribution of responsibilities for climate change, inequality of the effects, capacities, and benefits related to climate change
□ Procedural Justice
ㅇ How to promote and guarantee the meaningful participation of the stakeholders, build a feedback mechanism for the policy-making process related to climate change
□ Production Justice
ㅇ Transition of the current industrial structure which emits massive carbon dioxide, the direct cause of climate change as the environmental harm, and a just transition including labor policy in the transition process
□ Recognition Justice
ㅇ Establishment and implementation of climate change policy based on a global perspective including the recognition, respect and inclusion of minorities, vulnerable groups, and all living things
Ⅲ. Review of the Legal System related to Climate Justice
1. Distributive Climate Justice
□ Setting and implementation of GHGs emission reduction targets
ㅇ The GHGs emission reduction targets are not stipulated by law or enforcement decree and provided by the “National Strategy for Green Growth” and its subsidiary plans such as the “Basic Plan for Coping with Climate Change” and the “Greenhouse Gas Mitigation Target of the 2030 Reduction Roadmap”.
ㅇ Specific regulations including detailed standards and guidelines of legislation are necessary to verify the validity of the emissions reduction targets.
ㅇ Policy improvement is needed based on the concept of Climate Justice, including the principle of the ability to pay, and sectoral and generational equity is needed in the establishment of concrete mitigation targets and implementation plans.
□ Impact and damage of climate change - climate change adaptation
ㅇ Current adaptation policy mainly focuses on understanding and supporting groups vulnerable to climate change.
ㅇ According to the analysis of the current legal systems on health and disaster issues, policies and response systems that are differentiated from the current health policy for vulnerable groups and that reflect impacts and traits unique to climate change do not exist. There is a need to develop an integrated policy of the current health and disaster policy and climate change policy.
2. Procedural, Production, and Recognition Climate Justice
ㅇ Procedural Climate Justice: The current legal system is limited to the hearing processes during the establishment of environmental policy but since most climate change policy requires changes and action through the cooperation of stakeholders, including industry and individuals, consideration of those characteristics is needed during the policy-making process and implementation.
ㅇ Production Climate Justice: Supporting policies for the development and commercialization of new technologies are discussed and implemented but the transition of the industrial structure which takes into consideration the impact of the climate change in the stage of resource input including the fossil fuels is necessary, and also consideration and training for workers at target industries of the transition is needed during the transition process.
ㅇ Recognition Climate Justice: It strengthens international solidarity and cooperation and explores more assertive and future-oriented ways when formulating domestic climate change policy, and the design of policy responses that take the entire ecosystem of all living things vulnerable to the impact of climate change into account is needed.
Ⅳ. Case Studies on Climate Justice and Injustice
1. Identification of cases related to Climate Justice
ㅇ According to a big-data analysis of texts related to Climate Justice in academia and media, Climate Justice is strongly related to inequality, polarization, and vulnerable groups, especially the damage by climate change such as heat waves, cold waves, and increasing water temperature.
ㅇ Based on the analyses, the cases are categorized into 5 areas: health, disasters, atmosphere and transportation, ocean and water resources, and industry and energy.
2. Analysis of case studies by area
□ Health
ㅇ According to the analysis of deaths by heat waves and cold waves, statistically significant differences in inequality were recognized between age groups and regions.
□ Disasters
ㅇ According to changes in precipitation patterns due to climate change, it is predicted that the precipitation in spring and autumn will decline and drought will increase, while increased precipitation and heavy rains are predicted in the summer, which will contribute to intensifying the seasonal and regional patterns of disasters.
ㅇ According to a case study of heavy rains and flooding that occurred in August 2014 in Gijang-Gun, Busan, there exist differences in social vulnerability between the flooded areas and non-flooded areas even in the same town.
□ Atmosphere and transportation
ㅇ Fine dust: With concerns about increased concentration of fine dust due to air stagnation over the Korean peninsula caused by climate change, correlations between socioeconomic status and damage due to fine dust were found by a number of studies.
□ Ocean and water resources
ㅇ Changes in local fisheries’ species makeup and red tides caused by increasing ocean temperatures and the sea level rise along with coastal erosion and flooding are expected disasters, but there are no specific measures suggested as these are long-term changes.
□ Industry and energy
ㅇ Regional imbalance between the energy production and consumption, and related issues including health problems and energy welfare were recognized.
□ Other issues
ㅇ Social System: Climate change impacts, especially short-term impacts such as disasters, can cause not only the paralysis of the response systems but also the breakdown of the social systems on the whole as seen in the case of a long-term power outage due to a typhoon in Chiba Prefecture, Japan in September 2019, and this needs to be taken into consideration.
Ⅴ. Conclusion and Suggestions
ㅇ In this research, the concept of Climate Justice is defined as the state or value in which distributive, procedural, production, and recognition justice is achieved, and based on this framework, we analyzed the current legal system and case studies related to Climate Justice by distributive justice.
ㅇ In terms of the responsibility of climate change, or mitigation, there are no regulations that set mitigation targets in the legal system, so it is necessary to create legal basis to verify the validity of mitigation targets, and carry out comprehensive policy improvements that consider sectoral and generational equity in the assignment of the responsibility.
ㅇ According to the analysis of the legal system related to health and disaster issues, there is no consideration or establishment of climate change policies that are differentiated from usual policies in each issue.
ㅇ Also, according to the analysis of case studies, the impact of climate change is more severe among vulnerable groups in health (heat waves and cold waves) and disaster (heavy rains and floods) issues, and differences in capacity for adaptation and responses are recognized, so policy improvements considering Climate Justice and Distributive Justice is needed.
ㅇ However, the points related to procedural, production, and recognition justice are not readily apparent in the legal system or in the case studies, so further analysis of the legal system and case studies based on other constituent components of Climate Justice will be conducted and ways to implement comprehensive policy improvement to achieve Climate Justice will be suggested in further research.
