민사소송법은 “법원에 계속되어 있는 사건에 대하여 당사자는 다시 소를 제기하지 못한다.”라고 규정함으로써(제259조) 기판력의 모순·저촉을 방지하기 위하여 당사자로 하여금 중복하여 같은 소를 제기하지 못하도록 하고 있다. 한편 민사소송법 제218조 제3항은 “다른 사람을 위하여 원고나 피고가 된 사람에 대한 확정판결은 그 다른 사람에 대하여도 효력이 미친다.”라고 하여 제3자 소송담당의 경우 그 확정판결의 효력(기판력)이 본인에게 미친다는 것을 규정하고 있다. 그런데 판례는 채권자대위소송과 추심소송을 다 같이 제3자의 소송담당으로 보면서도 중복제소의 문제에 관하여는 서로 달리 취급하고 있다. 즉, 채권자대위소송의 경우에 관하여는 채무자의 이행소송과 채권자대위소송이 이중으로 제소된 경우 후소가 중복제소에 해당한다는 입장을 취하고 있다. 이는 채권자대위소송이 제기되더라도 채무자의 소송수행권이 상실되지 않음을 전제로 한 것이다. 반면 추심소송의 경우에 관하여는 대상판결에서 보는 바와 같이 양 의견 모두 채무자의 소송수행권이 추심명령에 의하여 상실됨을 전제로 하고 있지만 채무자의 이행소송이 계속 중 추심소송이 제기된 경우 후소인 추심소송이 중복제소에 해당하는지 여부에 관하여는 견해가 갈린다. 즉, 소수의견은 채권자대위소송이 이중으로 제기된 사안에서 설령 그 전소가 소송요건을 흠결하여 부적법하다고 할지라도 후소의 변론종결시까지 취하·각하 등에 의하여 소송계속이 소멸되지 아니하는 한 후소는 중복제소금지에 위배하여 각하를 면치 못하게 된다는 종전 판례에 따라 채무자가 제기한 이행의 소가 추심명령에 의하여 당사자적격이 없어 부적법하게 된다고 하더라도 현실적으로 각하되어 전소의 소송계속이 소멸되지 않는 한 후소인 압류채권자의 추심소송은 중복제소에 해당되어 부적법 각하되어야 한다고 한다. 이에 반하여 다수의견은 그렇게 되면 압류채권자로서는 채무자의 이행의 소가 당사자적격이 없다는 이유로 각하 확정됨으로써 그 소송계속이 소멸됨을 기다려 다시 추심의 소를 제기하여야 하는 것이 되는데 이는 소송경제에 반하므로 추심소송이 중복제소에 해당하지 않는다고 한다. 채무자의 소송수행권이 추심명령에 의하여 상실됨을 전제로 할 경우에는 다수의견이 현실적으로 타당한 선택으로 보인다. 그러나 추심소송 관계자들의 이익조화를 위한 보다 근본적인 해결책은 추심명령이 내려지더라도 채무자의 이행소송에 관한 소송수행권이 상실되지 않는다고 보아 해결하는 것일 것이다.
더보기The code of civil procedure provides that “Parties cannot bring a lawsuit again for a case that is under court proceedings”, prohibiting parties from bringing the same suit repeatedly to prevent abuse and conflicts of materielle Rechtskraft. On the other hand, Article 218, Section 3 of the code of civil procedure states that “Decisions entered for plaintiffs or defendants on behalf of others are binding on the others” to rule that the effect of decisions (materielle Rechtskraft) in third-party claims are valid on the parties. However, precedents view creditors’ consolidated action and collection action to belong to third-party claims while differentiating them in terms of the issue of double lawsuit. In other words, in cases of creditors’ consolidated action, the court holds that when debtors’ action for injunction and creditors’ consolidation action are filed together, double lawsuit applies by the latter. This is based on the fact that a debtors’ right to bring a suit does not lapse even when creditors’ consolidated action is filed. However, in cases of collection action, relevant court decisions reveal that both decisions are based on the premise that a debtors’ right to bring a suit lapses by an order of collection while in cases collection actions are filed in the course of debtors’ action for injunction, opinions are divided as to whether the latter collection action constitutes a double lawsuit. Namely, the minority opinion says that even when creditors’ consolidated action is filed in duplicate and the former suit lacks the requirements of a lawsuit to be illegitimate, the latter suit will be dismissed for the violation of the prohibition of a double lawsuit as long as the legal proceeding does not lapse by means of withdrawal and dismissal until the conclusion of argument of the latter suit under existing precedents. Therefore, a debtors’ lawsuit for collection will be dismissed in reality even when it becomes illegitimate for the lack of standing to sue by the order of collection leading to the dismissal of seizing creditors’ collection action for illegitimacy by the application of a double lawsuit as long as the proceedings of the former suit does not lapse. On the contrary, the majority claims that such a scenario produces a result where seizing creditors have to wait while debtors’ action for injunction to be dismissed for lack of standing to sue and the proceeding of which to lapse and file a collection action repeatedly which violates judicial economy to rule that a double lawsuit does not apply to collection action. Based on the premise that a debtor’s right to bring suit lapses by the order of collection, the majority is deemed to be a rational choice. However, the fundamental solution for the harmonized interests of parties in a collection action is to decide that the right to bring action does not lapse with regard to a debtor’s action for injunction in spite of the order of collection and provide solutions.
