과학기술분야 정부출연연구기관의 연구사업화에 관한 이해충돌 법적 검토

국문 초록 (Abstract)

본 연구는 과학기술분야 정부출연연구기관(이하 ‘과기출연기관’)의 연구사업화와 이에 따른 이해충돌방지 법제도를 검토하고, 연구현장에서의 인식 조사를 통해 법적 개선 방향을 도출하고자 하였다. 과기출연기관은 과학기술 연구에 그치지 않고, 연구 결과의 확산과 활용을 위해 기술이전 및 사업화 촉진의 의무를 가지고 있다. 그러나 이 과정에서 개인의 이익과 사업적 성격이 개입됨으로써 이해충돌 문제가 발생할 수 있다. 특히 2022년 「공직자의 이해충돌 방지법」이 시행된 이후, 기술이전 및 사업화와 관련된 여러 문제가 제기되고 있어 이에 대한 면밀한 검토가 요구된다.
연구현자에서의 인식 조사 결과, 출연연과 기타 조직 간 연구사업화에 대한 인식에 치이가 있으며, 출연연의 경우 이해충돌 우려가 주요 장애요인으로 작용할 가능성이 더 큰 것으로 나타났다. 또한, 연구소 기업과 연구자 창업기업에서도 이해충돌 우려로 인해 협력에 제약을 받은 경험이 보고되었다.
법적 개선 방향으로는 첫째, 과기출연기관법 등에 연구자 창업과 관련된 명시적인 규정을 마련하여, 이를 적극적으로 추진할 수 있는 법적 근거를 마련할 필요가 있다. 둘째, 과기출연기관에 대한 이해충돌방지법의 적용을 재검토하고 연구개발의 특성을 반영한 예외 규정이나 적용 제외 조항을 마련하는 방안을 고려해야 한다. 셋째, 국가연구개발혁신법 등 기존 법령을 활용하여 자체적인 이해충돌 관리 체계를 구축함으로써, 공공연구기관의 특성과 연구성과의 사회적 활용 간의 균형을 유지하면서도 연구자들이 연구성과를 사업화하는 과정에서 윤리적 책임을 다할 수 있는 환경을 조성해야 한다.
이러한 제도적 개선은 과기출연기관의 연구성과가 사회적 가치를 창출하고, 국가 과학기술 발전에 기여할 수 있도록 하는 데 중요한 역할을 할 것이다.

다국어 초록 (Multilingual Abstract)

This study examines the commercialization of research conducted by government-funded science and technology research institutes (hereinafter referred to as 'science and technology research institutes') and the associated legal frameworks for preventing conflicts of interest. The aim is to analyze the perceptions within the research community and propose legal improvements. Science and technology research institutes are tasked with not only conducting scientific research but also promoting technology transfer and commercialization for the dissemination and utilization of research outcomes. However, this process may involve personal interests or commercial activities, which can lead to conflicts of interest. Notably, since the implementation of the Act on the Prevention of Conflict of Interest in 2022, issues related to technology transfer and commercialization have been raised, necessitating a thorough review.
The perception survey conducted within the research community revealed differences in views on research commercialization between science and technology research institutes and other organizations, with the potential for conflict of interest concerns posing a more significant barrier in the former. Additionally, research-oriented companies and researcher-founded startups reported experiencing limitations in collaboration due to conflict of interest concerns.
The proposed legal improvements include: first, the establishment of explicit provisions related to researcher entrepreneurship within the Act on the Establishment, Operation and Fostering of Government-Funded Science and Technology Research Institutes to provide a clear legal basis for proactive efforts; second, a reconsideration of the application of the Act on the Prevention of Conflict of Interest to science and technology research institutes, with the consideration of exceptions or exclusions reflecting the unique nature of research and development; and third, the suggestion to utilize existing laws, such as the National Research and Development Innovation Act, to establish autonomous conflict of interest management systems within these institutes. These measures aim to strike a balance between the public responsibilities of research institutions and the social utilization of research outcomes, ensuring that researchers can actively commercialize their research while fulfilling their ethical responsibilities.
