본 논문은 연안국의 추적권 행사와 결합되어 작동하는 존재의 의제 법리의 개념 구조와 법적 기능을 규명하고, 1995년 R. v. Mills and Others 사건과 2015년 Arctic Sunrise호 중재재판을 중심으로 그 적용을 분석한다. 이를 통해 (i) 존재의 의제 원칙의 적용 범위와 한계, (ii) 추적의 즉시성(개시) 요건 해석, (iii) VHF 무선 통신에 의한 정선 명령의 적법성에 관한 시사점을 도출한다.
존재의 의제 원칙은 외국 선박이 연안국의 관할수역 밖에 있으면서 보조선 등을 통해 그 관할수역 내에서 위법행위를 실현하는 경우, 모선의 존재를 관할권 내에 구성적으로 귀속시키는 법리이다. 이는 범법행위 개시와 결과 발생 장소를 분리해 법집행을 회피하려는 시도에 대응하기 위한 것으로 객관적 속지주의로 정당화될 수 있으며, 관습법적 형성 이후 1958년 공해에 관한 협약 제23조 제3항과 UNCLOS 제111조 제4항에 의해 성문화되어 추적권의 실효성을 보완한다.
다만 이 원칙은 추적권 요건을 포괄적으로 완화하는 근거가 아니라, UNCLOS 제111조의 엄격한 요건 틀 안에서 제한적으로 기능한다. R. v. Mills and Others에서 영국 법원은 모선과 보조선의 사전 협의에 기초한 조직적 협력관계를 근거로 존재의 의제를 인정했으나, 보조선의 위법행위가 관할수역 내에서 실현되었고 그 사실이 추적선에 의해 실질적으로 확인되었다는 점을 전제로 했다. 또한 추적의 즉시성은 단순한 시간적 근접성보다 단속 환경과 사실 확인에 필요한 합리적 지체를 고려하는 기능적 해석이 가능함을 시사했다.
Arctic Sunrise 중재재판도 존재의 의제 원칙을 명시적으로 원용하며, 추적은 외국 선박 또는 그 소속 보트(보조선)가 관련 관할 해역 내에 있을 때 개시되어야 함을 확인했다. 나아가 제111조 제4항의 ‘이용 가능한 실질적 수단’을 인식 가능성의 기준으로 해석하여, 추적 개시 요건을 사후적으로 경직된 위치 기준에만 종속시키지 않도록 했다. 동시에 추적의 계속성 요건 불충족을 이유로 러시아의 조치를 위법으로 판단함으로써, 존재의 의제 법리가 추적권 남용을 정당화할 수 없음을 분명히 했다.
정선 명령과 관련해서는, 두 사건 모두 1958년 당시 기술을 전제로 한 형식적 해석을 지양하고 현대 해상통신 환경을 반영하는 해석을 취했다. 특히 SOLAS상 VHF 채널 16 상시 청취 의무와 무선 통신의 실효성은 VHF 정선 명령을 UNCLOS 제111조 제4항의 ‘청각 신호’로 평가할 수 있다는 해석을 뒷받침한다.
결국 존재의 의제 법리는 추적권의 본질적 요건을 해체하는 예외가 아니라, 관할수역 내 위법행위에 대한 실효적 법집행을 가능케 하는 보완 법리로 이해되어야 한다. 그 적용은 보조선과 모선의 실질적 연계성, 추적 개시 시점의 인식 가능성, 추적의 계속성 및 비례성 충족 여부 등을 종합해 판단되어야 하며, 기술 변화에 따른 기능적 해석도 UNCLOS 제111조의 요건과 한계를 전제로 한다. 이는 한국과 같이 해상 법집행 수요가 큰 연안국의 추적권 기준 정립과 국제법・국내법 정합성 확보에 참고가 될 수 있다.
This paper elucidates the conceptual structure and legal function of the doctrine of constructive presence as it operates in conjunction with a coastal State’s exercise of the right of hot pursuit, and analyzes its application with a focus on the 1995 R. v. Mills and Others decision and the 2015 Arctic Sunrise arbitration award. In doing so, it aims to draw implications regarding (i) the scope and limits of the doctrine of constructive presence, (ii) the interpretation of the immediacy (or commencement) requirement for hot pursuit, and (iii) the legality of stop orders issued via VHF radio communications.
The doctrine of constructive presence is a legal doctrine whereby, when a foreign vessel remains outside the coastal State’s waters of jurisdiction yet carries out unlawful conduct within those waters through auxiliary craft or similar means, the presence of the mother ship is constructively attributed to the jurisdictional waters. The doctrine responds to attempts to evade enforcement by artificially separating the place of conduct from the place where its effects occur; it can be theoretically justified on the basis of the objective territorial principle. Having developed in customary international law, the doctrine was subsequently codified in Article 23(3) of the 1958 Convention on the High Seas and in Article 111(4) of UNCLOS, thereby reinforcing the effectiveness of the hot pursuit regime.
At the same time, this doctrine does not provide a basis for broadly relaxing the requirements for hot pursuit; rather, it operates only in a limited manner within the strict framework established by UNCLOS Article 111. In R. v. Mills and Others, the UK court accepted the doctrine of constructive presence on the basis of an organized cooperative relationship grounded in prior coordination between the mother ship and the auxiliary craft. That acceptance, however, was premised on the auxiliary craft’s unlawful conduct being carried out within the coastal State’s jurisdictional waters and on those facts being substantively verified by the pursuing vessel. The case also suggests that the “immediacy” requirement should not be governed solely by mechanical temporal proximity, but may be interpreted functionally in light of reasonable delays necessitated by the operational environment and the time required to ascertain the facts.
The Arctic Sunrise arbitration likewise expressly invoked the doctrine of constructive presence, confirming that pursuit must be commenced while the foreign vessel—or its boats (auxiliary craft) belonging to it—is within the relevant waters of jurisdiction. Moreover, by interpreting the wording of Article 111(4) in terms of “available practical means” as a benchmark for the target vessel’s ability to perceive that pursuit is being initiated, the tribunal indicated that the commencement requirement should not be made to depend ex post on rigid positional criteria alone. At the same time, by finding Russia’s measures unlawful due to a failure to satisfy the continuity requirement of pursuit, the tribunal made clear that the doctrine of constructive presence cannot be used to justify abuses of the right of hot pursuit.
With respect to the means of communicating stop orders, both cases eschewed a formalistic interpretation tied to the technological conditions prevailing in 1958 and instead adopted an interpretation reflecting modern maritime communications and developments in international maritime norms. In particular, the SOLAS obligation to maintain a continuous watch on VHF Channel 16, together with the practical effectiveness of radio communications in conveying stop demands to the target vessel, supports construing VHF radio stop orders as an “auditory signal” within the meaning of UNCLOS Article 111(4).
