OECD와 G20은 2015년 디지털경제의 발전과 더불어 다국적 IT기업의 세원잠식과 소득이전에 대응하기 위하여 15개의 BEPS 프로젝트를 승인하였고, 디지털경제 활동에 대하여 합리적인 과세 제도를 만들기 위해 계속 노력해 왔다. 2015년 기존 OECD 모델조약이나 국제조세 체계를 근간으로 고정사업장 개념을 디지털경제에 적용할 때 발생되는 문제점에 대하여 공감하고 단편적인 조치들을 모색하였다면, 2018년에는 다국적기업의 세원잠식과 소득이전 방지보다 연계성(nexus)과 이익배분(profit allocation)을 기준으로 한 과세방법 개발이 더 중요하다는 데 인식을 함께하였다.
이후 2019년에는 위 내용을 보완하여 연계성(relevance)을 과세기준으로 하고, 개별국가에 이익을 배분(profit allocation)하기 위한 세 가지 방안을 제시하였다. 그중 두 가지 제안에 대하여 주로 초점이 맞춰지는데, 먼저 물리적 실재의 여부와 상관없이 시장소재지 국가(user jurisdiction)에 초과이익(non-routine profit) 또는 잔여이익(residual profit)에 대한 과세권을 배분하는 것이다. 다음으로, 연계성 규칙에 근거하여 마케팅 무형자산 및 그와 관련된 이익에 대한 과세권도 시장소재지 국가에게 부여하는 것이다. 마지막 세 번째는 최근에 개정된 것인데, 물리적 실재가 없는 비거주자라도 디지털 기술 및 기타 자동화된 수단을 통해 시장소재지 국가에서 의도적이고 지속적인 상호작용이 있는 경우로써 이를 근거로 경제적 실체가 인정된다면 해당 국가에서 과세권을 행사할 수 있게 하는 것이다. 이 기본적인 개념을 토대로 만들어진 통합접근법(Pillar One)과 나머지 BEPS 문제를 해결하기 위해 다국적기업에게 최저한세를 부과시키는 방안(Pillar Two)이 2020년 1월 BEPS 다자간협의체를 통해 합의되었다.
이하에서는 2020년 1월 파리에서 협의된 BEPS 다자간협의체의 2가지 접근법(Two Pillars)의 내용을 자세히 분석하고 디지털세의 도입과 관련하여 발생되는 논쟁과 해결 방안을 검토하고자 한다. 또한 임시조치로서 유럽연합의 디지털서비스세가 미국(통상법)과 마찰을 일으키게 된 과정과 이유를 소개하면서 OECD가 추진하는 디지털세의 발전에 비추어 국내 디지털서비스세 도입이 필요하지 않다는 의견을 제시하였다. 아울러 현행 국내 세법상 문제점을 검토하고, 새로운 디지털세제 개편을 위한 방안을 함께 제시하고자 한다.
The Organization for Economic Cooperation and Development(OECD) and G20 approved 15 Base Erosion and Profit Sharing (BEPS) project actions in 2015 to cope with the tax challenges of the digitalisation of the economy. These challenges were identified as one of the main areas of focus of the BEPS by huge Multinational Enterprises. The interim report in 2018 made by the Inclusive Framework focused on the two outstanding issues;the nexus and profit allocation rules compared with the Action 1 2015 final report which discussed two previously identified direct tax issues, namely the exacerbated BEPS issues and the broader tax challenges.
In 2019 the Inclusive Framework examined three proposals, which sought to expand the taxation rights of the user or market jurisdiction for revising the profit allocation and nexus rules in response to these challenges posed by digitalisation. The discussion has focused primarily on two of these proposals. First, the user participation proposal would be to reallocate a proportion of the non-routine profit of the business, from the entities that are currently realizing that profit, to the jurisdictions in which users are located. Second, the marketing intangible proposal would provide that some or all of the non-routine profit allocable to marketing intangibles associated with the market jurisdiction would be taxable by that market jurisdiction. Further, it would ensure that the nexus rules allow the market jurisdiction to exercise the right of taxation over this marketing intangible profit. The latest, a detailed discussion of the concept of significant economic presence is also taking place, but this concept was revised more recently. Under this proposal, a taxable presence in a jurisdiction would arise when a non-resident enterprise has a significant economic presence on the basis of factors that evidence a purposeful and sustained interaction with the jurisdiction via digital technology and other automated means. However, this sustained basis proposal would potentially be used only when combined with other factors to establish nexus in the form of a significant economic presence in the country concerned. Based on these concepts, the Inclusive Framework agreed to undertake work on the following two pillars in January 2020. Pillar one focuses on the allocation of taxing rights, and seeks to undertake a coherent and concurrent review of the profit allocation and nexus rules. Pillar two focuses on the remaining BEPS issues and seeks to develop rules that would provide jurisdictions with a right to “tax back” where other jurisdictions have not exercised their primary taxing rights or the payment is otherwise subject to low levels of effective taxation.
In this paper I will analyse in detail the two pillars agreed by the BEPS Inclusive Framework in January 2020 and then review the controversies and solutions of the issues. Moreover, I will introduce the process and source of disputes between temporary digital service tax in European Union countries and the US Trade Act and suggest that the introduction of digital service tax would be useless to the Republic of Korea based on the development of digital (income) tax by the OECD. I will discuss resolutions to the new digital taxation system after inspecting current domestic taxation problems in the digital economy.
