행정법학의 발전과 행정학과의 관계의 재형성 - 정책법학 = Development of administrative law and reconstruction of relationships with administrative science - public policy law

국문 초록 (Abstract)

세계적으로 민주적 법치사회가 정착단계를 지나 새로운 도약단계에 접어들면서 행정법학이 정책설계역량의 강화를 위해 행정학과의 융합연구를 발전시켜 행정학과의 관계를 재설정해가고 있다. 독일의 신행정법학, 일본의 자치체 정책법무론 등은 기존 행정학의 주제나 연구내용 등을 융합시켜 행정법을 개혁시킴으로써 국가와 사회의 새로운 수요에 대응해가고 있다. 이 글에서는 우리나라의 행정법학과 행정학의 비교의 유용성과 정확성을 보다 높이고자 선행연구들과는 다른 접근을 하였다. 행정연구에 대한 접근방법과 시기의 차이라는 두가지 기준에 따라 나누어 서술한 다음, 지금까지 양 학문의 연구자들이 달성하고자 했던 목표들을 집약시켜 선진한국시대에 필요한 학문분야로서 ‘정책법학’을 제시하였다. 접근방법에 있어서는 미국 행정학에서 나누는 분류방법에 따라 정치-행정 이원론을 취하는 관리적 접근방법, 법적 접근방법과 정치-행정 일원론을 취하는 정치적 접근방법으로 나누어 서술했다. 시기와 관련해서는 건국시기, 산업화시기, 민주화시기 그리고 선진한국시기로 나누었다. 민주화시기 우리 사회에서 진행된 ‘권리혁명’은 그 시간의 압축성이나 강도에 있어 세계사적으로 유례를 찾아볼 수 없을 만큼 단기에 혁명적으로 국가에 대한 국민의 권리는 물론 사회구성원 상호간에도 권리를 크게 확대시켰다. 이제 어떤 정부도 이렇게 신장된 국민의 권리와 권리의식을 성찰적으로 배려하지 않는다면 정책의 설계도 점점 어려워지는 시대가 되었다. 그 동안 정책학에서 개별 정책이 추구하는 실질적 내용에 대한 탐구는 학문대상에서 제외하고 모든 정책에 공통적으로 적용되는 “정책과정”에 대한 탐구에 집중한 것은 심각한 한계를 맞고 있다. 실체적 내용을 학문의 탐구대상에서 제외하는 것은 시대의 절실한 과제의 탐구에서 그만큼 멀어질 수밖에 없기 때문이다. 이 글에서는 주로 공익 또는 정책과 연결시켜 객관적 법령의 설계와 집행에 있어 헌법적 가치의 효율적인 실현을 목표로 하는 연구분야의 명칭을 ‘정책법학’으로 부를 것을 제안했다. 정책법학은 정치-행정 일원론의 입장을 따르면서, 미국식 분류에 따를 때, 법적 접근방법과 정치적 접근방법을 통합시킨 학문의 성격을 갖는다고 볼 수 있을 것이다. 선진한국사회에서 공공부문을 위한 새로운 개혁방향은 적극적 발전국가에서 민주적 법치사회로의 성공적인 전환의 완성이라 할 수 있을 것이다. 정책법학은 헌법전문에서 지향하고 있듯이 “자율과 조화를 바탕으로”, “국민생활의 균등한 향상”을 위해 교육열이 높은 한국인들의 높은 성취욕구가 작동되도록 목표, 절차와 방법들이 체계화되고 구조화되도록 하는데 기여하여야 할 것이다. 헌법전문이 제시한 헌법의 이념과 국정의 목표를 현시대와 상황의 제약속에서 구체적 정책목표로 구체화하는 프로그램을 제시하거나 규제기준, 조직과 절차를 규정함으로써 헌법에 규정된 이념의 실현정도와 실현방법을 최적으로 실현하는 방법을 제시해야 할 것이다. 이러한 목표의 달성을 위해 기존의 연구성과들을 수용하면서도 개방적이면서도 한국적 상황을 충분히 고려한, 주체적인 태도로 접근해가야 할 것이다.

다국어 초록 (Multilingual Abstract)

As the democratic rule of law around the world enters a new leap beyond the settlement stage, administrative law is re-establishing its relationship with administrative science by developing a convergence study to strengthen its policy design capabilities. Germany s new administrative law and Japan s self-governing policy law are responding to new demands from the nation and society by reforming the administrative law to combine research subjects and contents of existing administrative science. In this article, we took a different approach from the preceding studies in order to increase the usefulness and accuracy of comparisons between administrative law and administrative science in Korea. After dividing the two criteria, the approach to administrative research and the timing difference, “policy law” was presented as a necessary field of study in the advanced Korean era by aggregating the goals that researchers of both disciplines have been trying to achieve so far. In terms of approach, managerial approach and legal approach (political-administrative dualism), political approach(political-administrative one-pronged approach) was described in accordance with the classification method in U.S. administration. Regarding the period, the period was divided into the period of national foundation, industrialization, democratization, and advanced Korea. The “rights revolution” that took place in our society during the democratization period was unprecedented in world history after World War II in the compression and intensity of the time, revolutionizing not only the rights of the people against the country but also between members of society. It is now an era in which it becomes increasingly difficult for any government to design policies without reflective consideration of the people s rights and their consciousness. In the meantime, the focus on the “policy process” commonly applied to all policies, in exploring individual policies in policy studies, excludes the substance from the subject of the research, and it will inevitably be further removed from the quest for the urgent tasks of the times. This article suggested that the name of the field of research, which aims to efficiently realize constitutional values in the design and execution of objective statutes primarily in connection with public interest or policy, should be referred to as ‘public policy law’. ‘Public policy law’, following the stance of political-administrative monism, may be considered to have the academic nature of incorporating legal and political approaches, according to the American classification. The new direction of reform for the public sector in advanced Korean society is the completion of a successful transition from an active developing country to a democratic rule of law society. Public policy law should contribute to organize and structure goals, procedures and methods for Koreans with high educational zeal, for “based on autonomy and harmony” and “equal improvement of people s lives” in the Preamble to the Constitution. It should present a program that embodies the constitutional ideology and goals of state affairs in the current era and circumstances, or provide a way to realize the principles stipulated in the Constitution optimally by defining regulatory standards, organization and procedures. To achieve this goal, while accepting existing research achievements, korean researchers should study in an open and subjective manner, that fully considers our situation.
