영화산업의 변화에 따른 법제의 대응 : OTT 플랫폼과 저작권법 중심의 비교법적 고찰
최근 OTT(Over The Top) 플랫폼의 급성장과 함께 영화산업은 전통적인 극장 중심의 배급 구조에서 벗어나 스마트 디바이스 기반의 구조로 빠르게 변화했다. 특히 2021년, 국내 <오징어게임>이 흥행을 이루게 되어 K-콘텐츠가 글로벌 OTT 플랫폼을 통해 전 세계로 확산되는 새로운 전환점을 맞이하게 되었다. 이는 국내 영화 제작 및 유통방식에 변화를 가져왔다. 그러나 이러한 산업적 변화에도 불구하고 현행 저작권법은 창작자들의 권리를 충분히 보호하지 못하고 있다는 문제가 나타났고 이에 대한 제도적 개선이 필요하다는 주장이 제기되고 있다.
영화산업이 OTT 플랫폼 제작 구조의 영화로 확장됨에 따라 창작자의 모든 권리가 플랫폼으로 귀속되어 창작자들은 자신이 만든 콘텐츠가 성공하더라도, 그에 대한 정당한 보상을 받지 못하는 구조에 놓이게 되었다. 대표적인 예로, 넷플릭스와 같은 글로벌 OTT 플랫폼은 콘텐츠 제작비를 사전에 투자하지만, 작품의 흥행으로 얻는 초과 수익을 독점하는 경우가 많다. 현행 저작권법 제5장에 규정하고 있는 ‘영상저작물에 관한 특례’의 제100조는 영상물의 저작자가 저작권을 양도한 경우, 특약이 없는 한 복제·배포·방송 등 모든 권리를 양도한 것으로 추정하기 때문이다. 이때 특정한 영상저작물의 제작에 협력하기로 한 창작자와 실연자들은 자신들의 저작물이나 실연에 대하여 정당한 대가를 받을 수 있는 계약을 하기 위해 영상제작자와 협상을 시도할 수 있다. 다만, 영상제작자가 이에 응하지 않아 협상이 결렬될 경우에도 동조에 의해 영상저작물의 이용에 필요한 범위 안에서 자신들의 권리가 영상제작자에게 양도된 것으로 추정된다.
‘영상저작물에 관한 특례’는 영화산업이 극장 중심으로 운영되던 시절에 도입된 법률이기 때문에, 현재의 디지털 및 OTT 환경을 충분히 반영하지 못한다는 문제를 가지고 있다. 특히, 최근 국내 영화산업이 해외 시장으로의 확장을 통해 글로벌 흥행을 경험하면서 현행 저작권법의 적용에 관한 문제들이 부각되고 있는 것이다. 이에 국회에서는 저작권법 개정안을 발의하여 대응하고자 하였으나 국회임기만료로 폐기된 상황이다. 영화산업의 변화에 따라 창작자들의 권익 보호에 대한 문제가 제기되고 있는 만큼, 외국의 입법례만을 비교검토하여 국내의 법적 대응방안을 제시하기 보다는 현재까지의 영화산업의 변화를 함께 고려하여 법제의 대응양상을 검토하고자 했다.
따라서 본고에서는 법제의 대응을 논하기 위해 산업적 측면의 변화과정을 함께 검토한다. 전 세계 영화산업에서 역사적, 문화적, 제도적 측면에서 중요한 위치를 차지하는 4개국(미국, 프랑스, 독일, 일본)의 사례를 중심으로 각국의 영화산업 변화에 따른 법제의 대응, 특히 저작권법의 양상을 중심으로 비교 분석한다. 해당 국가들은 한국에서 논의되고 있는 창작자의 정당한 보상 문제에 대해서도 단체협약이나 특례규정을 통해 창작자의 권익을 보호하고 있다는 점에서도 눈여겨볼만 하다. 한국 역시 최근 OTT로의 변화로 인한 법제의 대응을 논하기 위해 산업적 측면과 제도적 측면의 연혁적 변화과정을 검토하고자 했다. 이에 영화산업은 빠르게 변화하는 예측 불가능한 산업에 있어 플랫폼이자 제작사를 규제하는 법적 근거가 확립될 경우 오히려 다양한 영상저작물을 제작하기에 부담을 느끼는 사업자가 증가함에 따라 영화산업의 발전이 더뎌질 것이라고 보았다. 시장의 자율적 판단과 경쟁 논리에 따라 결정되는 사안인 수익 분배 문제는 내부 구성원이 공존할 수 있는 구조를 형성하여 상생을 도모할 수 있는 정책적 지원을 통해 모두가 정당한 수익을 확보하면서 산업의 지속 가능한 성장을 이룰 수 있을 것이다.
With the recent rapid growth of over-the-top (OTT) platforms, the movie industry has rapidly changed from a traditional theater-based distribution structure to a smart device-based one. In particular, in 2021, the success of the Korean film <!-- Not Allowed Tag Filtered --><Squid Game> marked a new turning point where K-content has spread around the world through global OTT platforms. This has changed the way Korean movies are produced and distributed. However, despite these industrial changes, the current copyright law has been criticized for not sufficiently protecting the rights of creators, and it has been argued that institutional improvements are necessary.
As the movie industry has expanded to OTT platforms, all creators’ rights have been transferred to them, leaving creators without fair compensation even if their content is successful. For example, global OTT platforms like Netflix invest upfront in content production but often monopolize any excess profits from a movie's success. According to Article 100 of the ‘Special Provision for Audiovisual Works’ in Chapter 5 of the current Copyright Act, when the author of an audiovisual work transfers the copyright, it is presumed that the creator has transferred all rights, including reproduction, distribution, and broadcasting unless otherwise specified. At this point, creators and performers who have agreed to cooperate in the production of a particular video work may try to negotiate with the video producer to make a contract that allows them to receive fair compensation for their works or performances. However, if negotiations are unsuccessful due to the failure of the video producer to respond, it is presumed that they have transferred their rights to the video producer to the extent necessary for the use of the video work.
The ‘Special Provision for Audiovisual Works’ was introduced when the movie industry was operated mainly in theaters, so it does not fully reflect the current digital and OTT environment. In particular, as the Korean movie industry has recently experienced global success through expansion into overseas markets, issues regarding the application of the current copyright law have been highlighted. The National Assembly attempted to respond by proposing an amendment to the Copyright Act, but it was abandoned due to the expiration of the National Assembly’s term. As the changes in the movie industry are raising issues about protecting the rights and interests of creators, this study aims to investigate the legal system’s response in light of the changes in the movie industry to date rather than suggesting Korean legal responses based on a comparative review of foreign legislative examples alone.
Therefore, to discuss the legal system’s responses, this study examines the process of change in the industry. Focusing on the cases of four countries (the United States, France, Germany, and Japan), which occupy important positions in the global film industry in terms of historical, cultural, and institutional aspects, this paper compares and analyzes the legal system’s response to the changes in the movie industry, especially the aspects of copyright law. It is also noteworthy that these countries protect the rights and interests of creators through collective agreements or special regulations, which are also being discussed in Korea on the issue of fair compensation for creators. Korea also tried to review the historical industrial and institutional change process to discuss the legal system’s response to the recent shift to OTT platforms. It was concluded that in a rapidly changing and unpredictable industry, establishing a legal basis for regulating platforms and production companies would slow down the development of the film industry, as more business operators would feel under pressure when making various video works. The issue of revenue distribution, which is determined by the autonomous judgment of the market and the logic of competition, will be a matter of forming a structure where internal members can live in a win-win relationship. The industry could achieve sustainable growth through policy support while securing fair profits for all.
