세무조사 선정은 조세순응을 유도하는가? -소규모사업자의 전기세무조사에 따른 가산세를 중심으로- = Do tax audits improve taxpayers` tax compliance? - Focusing on penalty by prior tax audit of small business operator-

조세순응을 위한 대표적인 정책인 세무조사와 세무조사에서 적발된 탈루세액에 대해 부과·징수되는 가산세는 납세자에게 납세의무 위반에 대한 심리적·경제적 부담을 부과하여 자발적인 납세의무수준을 향상시키는 것을 근본적인 목표로 한다. 이는 납세자가 사전에 납세의무를 위반하지 않도록 예방하고, 이후 납세자들의 위반행위가 재발하는 것을 방지하기 위한 것이다. 이를 위해 세무조사에서 탈세가 적발되었던 납세자들에 대한 세무조사 이후의 관리는 지속적인 탈세 예방 측면에서 중요하다. 실제로 최근 국세청은 세무조사를 받은 법인 중 조사 직후 신고소득률이 급격히 하락한 62개 법인을 중점관리대상으로 선정하고 그 사유를 분석하기로 한 바 있어, 세무조사 이후 납세자들의 신고성향에 대한 연구가요구된다. 세무조사 이후 신고성향에 대한 연구는 실험연구와 실증연구를 통해 이루어져왔다. 그러나 아직까지 많은 연구가 제시되고 있지 않으며, 분석결과 또한 일관되게 제시되지 않고 있다. 그러나 기존연구는 연구방법이나 분석자료의 차이가 존재하므로 결과 해석시 이러한 차이를 고려해야 하며, 선행연구에서 고려하지 않은 세무신고에 영향을 미칠 수있는 변수에 대한 추가적인 연구가 요구된다. 이에 본 연구에서는 기존의 연구에서 거의 고려하지 않은 가산세 변수를 포함하여, 세무조사 이후 납세자들의 신고행태에 대해 분석하였다. 구체적으로 본 연구는 전기세무조사대상자 선정여부와 세무조사에 따른 전기가산세(독립변수)가 세무신고의사결정(조세순응: 종속변수)에 미치는 영향을 분석하였다. 본 연구는 인터넷을 이용한 실험을 통해 자료를 수집하였다. 실험참여자는 본인을 가상의 사업자로 가정하여 일반적인 세무신고의사결정을 수행하게 된다. 실험에서 실험참여자의 세무신고의사결정에 따라 세무조사대상자가 선정되고, 미신고소득에 대해서는 가산세가 부과된다. 이와 같은 세무신고의사결정 실험을 반복적으로 실시하여, 독립변수인 전기세무조사대상자 선정여부 및 세무조사에 따른 전기가산세와 종속변수인신고소득률(신고소득/실제소득*100)을 측정하였다. 분석결과, 전기에 세무조사대상자로 선정된 납세자는 그렇지 않았던 납세자에 비해 다음기에 보다 높은 과세소득을 신고하는 것으로 나타났다. 이는 전기세무조사대상자 선정이 납세자들로 하여금 적발위험가능성을 높게 인식하도록 하여 성실신고를 유도한 것으로 판단된다. 그런데 전기에 세무조사대상자로 선정된 납세자 중 세무조사로 인해 전기에 추징된 가산세가 상대적으로 높은 납세자는 그렇지 않았던 납세자에 비해 다음 기에 보다 낮은 과세소득을 신고하는 것으로 나타났다. 즉 과거에 탈루성향이 높은 납세자는 세무조사 이후에도 반복적으로 불성실한 세무보고를 하는 행태가 발견되었다. 이는 세무조사로 인해 이미 높은 가산세를 부담한 납세자의 경우 이후 세무신고에서 재산의 손실에 대한 보상심리로 신고소득을 보다 많이 감소시켜 보고한 것으로 판단된다. 이러한 본 연구의 결과는 과세당국이 과거에 세무조사대상자로 선정된 납세자들 중 탈루세액이 높은 불성실납세자들을 구분하여 세무조사 이후 이들을 대상으로 성실한 납세의무이행을 위한 계도 및 교육과 관찰 등의 특별관리가 요구됨을 시사하고 있다. 본 연구는 기존연구의 결과의 차이에 대한 해석가능성을 제시하고, 세무조사 이후 납세자들의 사후관리필요성에 대한 실험적 증거를 제시하고 있다는 점에서 의의를 갖는다.
더보기Tax audits and penalties are the most typical taxation policies to ensure tax compliance. The policies are to enhance the tax compliance of taxpayers on their own initiative by imposing psychological and financial burden on them. Also, the policies will act as precautions against any possible defaults on tax payments, as well as prevent their recurrence from happening in future. Accordingly, the continuous supervision on those who have ever turned out to be evaders is crucial, particularly when repetitive tax evasion happens. In the meantime, the Korean National Tax Service has recently announced that companies whose tax reports show a significant decline in taxable income will be subject to intensive scrutiny for the justification of the cause of the decline. As a result, some studies are required on taxpayers`` behavior with regard to the patterns of their tax reporting after they undergo tax audit. There exist some previous studies on the taxpayers`` behavior patterns, either experimentally, or empirically. However, there still needs to be more of such research to be done and moreover, because those previous studies have failed to achieve consistency among them. The previous studies used their own methods and analyzed different set of data. Therefore, further studies are required to find whether there are any other variables that have not been considered in previous studies but could possibly affect the tax reporting patterns. This study analyzed the taxpayers`` tendencies of behavior over the tax reporting, including one important variable, which has been overlooked or hardly ever been, given careful considerations in previous researches: the size of penalties. The current study is to examine how the tax audit (whether tax audit or non-tax audit) and the penalties influence the decision-making of taxpayers (tax compliance) when faced with filing their tax returns. This study conducted a web-based experiment to collect data. Company workers who are majoring in accounting in colleges have been recruited as participants of the online experiment. In the experiment, as fictitious business owners, the subjects are to file a tax return. By the rule of the tax authority, some subjects are selected for a tax audit, and the penalties will be charged to subjects for any under-reported amount of income. This study manipulated two independent variables: (1) tax audit selection (whether audit or non-audit) in prior period, (2) penalties in prior period by tax audit. Also, one dependent variable is measured (reported income rate = reported income/actual income x 100). The results of this study are as follows. First, the findings show that taxpayers who had undergone tax audit in the prior period are likely to report higher taxable income in the next period than those not. It is deemed that having been selected for the tax audit has heightened the vigilance against the detection risk and thus encouraged an honest tax reporting. Second, taxpayers who were charged and paid relatively high penalties in the prior tax audit tend to report lower taxable income than those otherwise. That is, it is shown that those who have high tendency of tax evasion remained still more prone to tax avoidance in the following period and onwards. It seems that the taxpayers who have paid higher penalties get easily tempted to make up for the financial loss from the results of tax audit by under-reporting taxable income in the next consecutive periods The results of our analysis suggest the need to examine previous conflicting research results. Some of existing empirical and experimental studies suggest that tax evasion increases after tax audits. When our results are considered, past findings were made from large companies with high tax audit penalties. In other words, companies that were charged and paid relatively high penalties reported relatively lower taxable income in the next tax reporting period to make up the loss of the prior period. In this way, this study verifies that tax avoidance after a tax audit is the result of loss recovery as well as the bomb crater effect, which has been supported in previous studies. Cuccia (1994) maintained that the increase of penalty rates increases not only economic costs but also psychological rewards, and causes a result contrary to the intention of taxation authorities (namely, the increase of penalty rates increases aggressive tax reports). Thus, it is necessary for taxation authorities to consider the psychological and economic effects of fines. The results of this study support Cuccia``s (1994) argument. In an analysis of tax avoidance after tax audits, previous researchers have not considered the effects of the tax evasion and penalty levels at the time of the tax audit. As a result, previous research has only reported the actual circumstances, excluding the effects of the tax evasion and penalty levels. This study is meaningful in that it suggests the cause of the existing inconsistent results. Given the above results, it could be inferred that it is required that the tax authorities first ferret out the habitual, serious tax evaders, and then carefully manage and supervise through ways of encouragement, training, and close observations be ensured.
