민사소송에서의 개인정보 비공개 -우리 민사소송법 개정과 일본의 2022년 개정 민사소송법의 비교 = Personal Information Protection in Civil Procedure -A Comparative Study between the 2023 Amendment of the Act of Civil Procedure in Korea and the 2022 Amendment of the Act of Civil Procedure in Japan

민사소송제도의 이상은 지속적으로 변화하는 사회환경에 대응하여 투명하고 적정한 재판을 실현하면서 당사자의 재판청구권을 실질적으로 보장하는 것이다. 우리 민사소송법은 형사소송과 달리 범죄피해자가 소를 제기하는 경우 피해자의 개인정보를 보호하는 조치가 없었으나, 2023. 7. 11. 민사소송법 개정안이 성립하면서 제3자뿐만 아니라 상대방 당사자에게도 개인정보를 보호할 수 있는 법적 근거가 신설되었다. 이 개정안은 2025. 7. 12. 시행예정이며, 민사소송 중에 노출되는 개인정보를 보호하여 당사자가 위축되지 않고 재판청구권을 행사할 수 있도록 보장한다는 점에서 중요한 의의를 가진다.
일본은 2022년 일본 민사소송법 개정을 통하여 민사소송에서 소송 당사자 등의 주소·성명 등을 비공개하는 제도를 신설하였고, 이 제도는 2023. 2. 20.부터 시행하고 있다. 당사자의 성명 등 개인정보를 상대방 당사자를 포함하여 일반 시민에게 비공개하는 것은 전통적으로 민사소송에서 주요하게 적용되는 재판공개원칙과의 충돌 가능성에 더하여, 상대방 당사자의 방어권과 충돌할 가능성이 있다는 점에서 신중하고 정교한 입법이 필요하다.
재판공개원칙과 당사자의 프라이버시 보호의 균형 관점에서, 일본의 개정법은 두 가지 난점을 가지고 있다. 첫째는 주소·이름 등의 비공개 요건을 실무에서 완화하여 해석할 우려가 있어 비공개조치가 지나치게 허용될 우려가 있다는 점이고, 둘째는 비공개결정의 취소를 구할 수 있는 사람으로 상대방 당사자 외에 제3자도 포함하였음에도 제3자의 기록열람권의 법적 성질에 대하여 충분한 논의가 없었다는 점이다. 한편 일본 개정법의 경우, 피고의 방어권 보장을 위하여 비공개결정의 요건이 결여된 경우 외에도 피고가 피고의 방어권에 불이익이 있다는 점을 소명하면 비공개결정의 취소 및 열람허가를 구할 수 있도록 규정하여, 피고의 방어권보호를 위한 입법적 조치를 취하였고, 이는 우리에게 시사하는 바가 크다.
이러한 측면에서, 일정한 경우 상대방 당사자에게 이름과 주소 등 신원을 공개하지 않고 소를 제기할 수 있도록 개정한 우리 민사소송법과 일본 민사소송법의 내용을 비교하여 시사점을 도출하는 것은 의의가 있을 것으로 보인다. 이 논문은 민사소송에서 개인정보의 필요성과 우리 민사소송법의 개정 경위와 그 내용을 살펴보고, 일본 민사소송법의 개정 경위와 그 내용을 비교하여 고찰하며, 이러한 비교법적 연구를 통하여 민사소송에서 개인정보의 보호와 재판공개원칙, 양 당사자의 실질적인 재판청구권 보장 방안에 대하여 탐구하는 것을 목적으로 한다.
The imperative of the civil procedural framework lies in its adaptability to the dynamic sociocultural milieu, seeking to actualize transparent and fair adjudication while substantively safeguarding the litigants' right to trial. In contrast to criminal proceedings, the Civil Procedure Act of Korea lacked provisions to protect the personal information of crime victims when they filed a lawsuit until the amendment on July 11, 2023. This amendment introduces legal grounds for protecting personal information not only from third parties but also from the opposing party. The amendment is scheduled to take effect on July 12, 2025, and is crucial in safeguarding personal information exposed during civil litigation, ensuring that litigants can exercise their right to trial without intimidation.
Conversely, Japan, in 2022, enacted a legislative amendment to the Civil Procedure Act of Japan, ushering in a mechanism allowing the non-disclosure of addresses and names of litigants in civil proceedings. This provision has been in effect since February 20, 2023. The non-disclosure of personal information, including the names of parties involved, to the general public, including the opposing party, poses a potential conflict with the long-established principle of open trials in civil litigation, raising the need for careful and sophisticated legislation.
From the perspective of balancing the principle of open justice and the protection of parties' privacy, the Japanese amendment faces two challenges. First, there is concern that the criteria for non-disclosure may be excessively lenient in practice, leading to an undue allowance of non-disclosure measures. Second, there has been insufficient discussion regarding the legal nature of the right to access records for third parties, even those beyond the opposing party, who can seek the cancellation of non-disclosure decisions. In contrast, the Japanese amendment includes provisions allowing the opposing party to seek the cancellation of non-disclosure decisions and access permission, provided they demonstrate a detriment to their defense rights. This legislative measure instituted for safeguarding the defense rights of the defendant bears noteworthy implications.
In this regard, comparing the content of the amendments to our Civil Procedure Act and the Japanese Civil Procedure Act, which allows the filing of lawsuits without disclosing identity in certain cases, would be meaningful. This paper will explore the necessity of personal information in civil litigation, examine the background and content of the amendment to our Civil Procedure Act, and compare it with the background and content of the amendment to the Japanese Civil Procedure Act. Based on the review, this paper will attempt to conduct a comprehensive analysis of the protection of personal information, the principle of open justice, and practical measures to guarantee the right to trial for all parties involved in civil litigation.
