기술표준화의 독점규제법 적용에 관한 연구 = (A) study on standardization, intellectual property and antitrust law

표준화란 생산물 및 생산 방법에 대해 그 형상, 규격, 성능, 시험 등에 관한 사항을 통일하고 단순화하는 활동을 말한다. 표준화가 쟁점이 되고 있는 정보통신 시장은 다른 산업과 달리 네트워크 외부 효과로 특징지어진다. 네트워크 외부 효과란 소비에 있어서 규모의 경제성으로 동일한 규격의 재화나 서비스를 구입하는 소비자 수가 증가하면 할수록 그 효과도 증대하는 것을 말한다. 이러한 외부효과를 통한 공익 실현을 위하여 지적재산권의 표준화가 추진된다.
그러나, 지적재산권의 표준화는 사유 재산의 공유화를 의미하기 때문에 본질적인 제약을 지니고 있다. 지적재산권자가 권리를 무상허여 하면 지적재산권과 표준화 사이에 아무런 갈등이 발생하지 않는다. 또한, 지적재산권자는 공정한 금액으로, 합리적 조건 하에, 비차별적 토대 위에서 권리를 행사함을 표준화 제정과정 중 서약함으로 자신의 지적재산이 표준화에 포함되도록 할 수 있으며 위 원칙에 의한 권리행사가 가능하다.
그러나, 표준화된 기술에 포함된 지적재산권의 행사가 정당한 범위를 넘어서 시장 경제질서를 해칠 경우에는 독점이라는 새로운 문제를 불러일으킨다. 독점의 문제를 해결하기 위하여 특허법의 강제실시제도와 독점 금지 또는 경쟁 정책에 의한 지적재산권의 제약을 검토해 볼 수 있다.
특허법의 강제실시제도는 우리 특허법 제107조 제1항 제3호에서 특허발명의 실시가 공공의 이익을 위하여 비상업적으로 특허발명을 실시할 필요가 있는 경우 특허권자(지적재산권자)에게 실시의 허락에 관하여 협의를 청구할 수 있다는 규정을 통해 검토해 볼 수 있다. 아직 이에 대한 국내판례가 거의 없지만 표준화의 ‘공익’을 충분히 증명할 수 있을 경우 이 조항에 의해 강제허여도 가능할 것이다. 또한 WTO협정 규정에서도 공공 비영리목적의 강제실시권을 인정하고 있으므로 이의 적절한 운용도 또 다른 방법이 될 것이다. 그러나 이러한 제도적 장치가 전세계적으로 마련되어 있는 것이 아니기 때문에 이의 적절한 운용을 위해서는 타국과의 법적 균형관계에 대해서도 고려해 보아야 한다.
독점금지 또는 경쟁정책에 의한 지적재산권의 제약은 지적재산권자가 누릴 수 있는 정당한 보상의 정도를 넘는 경우 지적재산권 남용으로 규제할 수 있다. 이 경우 독점규제법 제59조의 지적재산권 적용예외 규정을 어떻게 해석할지 문제된다. 그러나, 양법의 취지로부터 지적재산권과 독점규제는 서로 대립되는 관계가 아니라 상호 보완 관계이며 비본래적인 지적재산권의 행사에는 독점규제법이 적용될 수 있다고 해석하는 것이 타당하다.
그러나, 공정한 금액, 합리적 조건, 비차별적 토대라는 기준은 주관적인 판단에 따르는 기준이므로 지적재산권의 제한시 면밀한 검토가 필요하며, 표준화에 따른 경쟁상의 우위성을 이유로한 지적재산권의 잦은 제한은 신규 설비 투자와 혁신을 감퇴시켜 지적재산권법의 취지를 일탈할 수도 있으므로 신중한 적용이 필요하다.
정보통신 표준화와 지적재산권에 관한 분쟁사례로는 Dell 사건 및 Wang 사건 등이 있으며, 이상의 사례로부터 표준화에 참여하는 기업은 자사의 지적재산권이 표준(안)에 포함되는지 여부를 적극적으로 알아보아야 한다.
Standards development is the activity of unifying and simplifying shape, efficiency or examination for production or production method. The essential feature about the "New Economy" is dependent on goods and services that are the embodiment of ideas. Examples include such diverse products as computer software, Internet services, and new forms of communications - generally, the fastest growing segments of the present economy. Standards development is particularly critical for the New economy. New economy generally has characterized by network externalities. And de facto standards commonly exist in the markets with network externalities. In such markets a goods becomes more valuable as greater number of consumers use it.
The capture of an industry standard by a firm holding intellectual property rights in the technical subject matter of that standard, i.e., the assertion of intellectual property rights by a firm that both participated in the standard-setting activity and also obtained proprietary rights in some aspect of the technical subject matter of the standard.
Many standards-setting bodies have implemented intellectual property policies outlining a spectrum of obligations for holders of patents and other intellectual property rights in the subject matter of the standard. The most burdensome policies, from a patent owner's perspective, require that the owner of any patent deemed essential to practicing the standard grant a royalty-free license to any user of the standard. This case has not problem of Antitrust law. Other standards-setting bodies require that patent owners grant licenses under terms that are "reasonable and nondiscriminatory." Will agreeing to license a patent on nondiscriminatory terms actually bar a patent owner from filing suit for infringement? Will it limit her remedies under patent law? Or is such an agreement simply a contractual obligation enforceable only in a separate suit? These are complex questions, and the law so far doesn't have entirely satisfactory answers. But we can suggest compulsory licensing of Patent Law or inhibition of intellectual property by Antitrust Law.
There is "compulsory licensing" in Korean Patent Law §107. WTO/Trips agrees that each nation can grant "compulsory licensing". But, that judicial precedents has not been found, and that can not be adapted worldwide.
From the point of view of antitrust enforcement, remedial questions are a particular challenge in addressing intellectual property issues in a way that alleviates competitive problems without unduly interfering with innovation incentives. There is a need to revisit intellectual property policy to assess whether intellectual property protection has expanded in a way that threatens the appropriate balance between property rights and competition. Antitrust enforcement against patent owners could be circumvented by treating industry standards as essential facilities doctrine. The essential facilities doctrine provides that it is an antitrust violation for the owner of an essential facility to deny access to that facility at nondiscriminatory terms. Finally I suggest that apply Korean Antitrust Law § 3-2 "abuse of a dominant position" to order compulsory licensing as a remedy when the owner of proprietary rights that had become a national standard refused to license its competitors. Compulsory licensing should be required only as a penalty for failure to timely disclose patent rights relevant to the standard.
Antitrust is sufficiently flexible that it can play a useful role in the New Economy. In the New Economy, do require antitrust enforcement to make adjustments and exercise sensitivity towards intellectual property issues on a case-by-case basis.
Still other bodies do not oblige patent owners to license under any particular terms, requiring only that standards-setting participants disclose any patents or pending patent applications that are related to the subject matter of the standard. How can members of a standard-setting organization enforce a by-law that requires only disclosure of intellectual property rights, but not relinquishment or licensing of those rights? If a standards-setting organization ultimately adopts a standard that requires the practice of a patent that was not disclosed, a patent owner who participated in setting that standard but failed to disclose the patent's existence should be subject to compulsory licensing, i.e., the patentee should be compelled to license any user of the standard at commercially reasonable terms and may not refuse to license.
