일제는 식민통치의 정당성과 안정성 그리고 효율성을 유지하고자, 지배정책에 순응하지 않고 반발하는 식민지의 조선인을 전체주의적으로 통제하고자 하였다. 이들은 치안질서를 문란하게 한다는 사유로 범죄인으로 규정되었으며, 강압적이고 강제적이며 자의적인 방식으로 구금되어 처벌을 받았다. 그렇지만 단순히 한시적으로 사회에서 격리시킨다는 것만으로는 계속되는 범죄인의 증가에 대처하기는 어려웠다. 이에 ‘범죄인에 대한 보호’를 실시하였다. 범죄인 보호의 근본적인 지향은 범죄인을 사회 안에 적응시킴으로써 이들에게 소요되는 사법과 행형 비용을 절감하고자 하는 것에 있었다.
일제는 사법보호사업을 결전태세 하의 일본에게 있어서 치안의 확보에서도, 생산부문의 충실에서도 소홀히 할 수 없는 사업으로 인식하였다. 이러한 목적 하에 시행된 「조선사법보호사업령」과 「조선사법보호위원령」은 사상범, 소년범, 일반범(보통범) 모두를 아울러 사법보호사업의 대상으로 설정하였다. 하지만 사상범의 경우 1936년 「조선사상범보호관찰령」, 1941년 「조선사상범예방구금령」과 「치안유지법」 개정안으로 이미 보호관찰소와 예방구금소가 설치되어 있었고, 소년범의 경우 1942년 「조선소년령」과 「조선교정원령」에 의해 소년재판소와 교정원이 설치될 예정이었다. 이처럼 사상범과 소년범의 사법보호에서 각각 특수한 관청과 유력한 기구가 이미 존재하고 있었기에, 해당 법령은 일반범과 소년재판소 관할구역 밖에 있는 소년범들에 중점을 두었다. 이를 위해 조선총독부는 사법보호위원을 선정하여 각 보호구에 배속하였다. 그리고 보호위원의 지도훈련기관인 사법보호위원회를 각 지방법원 검사국별로 경성·대전·함흥·청진·평양·신의주·해주·대구·부산·광주·전주에 설치하였다.
1943년 8월부터는 사법보호대상자를 근로동원하기 위한 근거를 마련하기 시작했으며, 이듬해인 1944년 3월에는 사법보호대상자를 항만정신대로 편성하여, 조선해륙운수주식회사에서 지정한 항만으로 동원하여 강제로 근로케 하였다. 항만정신대원은 당초 6개 항만에 3,100명이 파견될 계획이었으나, 1945년 4월부터는 13개 항만에 5,550명을 파견하는 것으로 계획을 수정하였다. 더불어 총독부는 형무소의 수형자와 마찬가지로 사법보호대상자를 규율에 순응하는 집단으로 탈바꿈시키고자 하였다. 이는 그동안 지지부진했던 사법보호사업의 법제화가 특정 시점에 일시에 달성될 수 있었던 이유가 사법보호대상자를 포함한 식민지 조선 내의 모든 범죄인까지도 강제로 동원하여 근로시키기 위함이었음을 여실히 보여준다고 할 것이다.
In order to maintain the legitimacy, stability, and efficiency of its colonial rule, the Japanese Empire sought to exert totalitarian control over the colonized Koreans who refused to comply with its policies of ruling and rebelled against them. They were criminalized for disturbing public peace and order, and were detained and punished in a coercive, forceful, and arbitrary manner. However, simply isolating them from society temporarily was not enough to deal with the growing number of offenders. Thus, a ‘protection for offenders’ was implemented. The fundamental aim behind the protection of offenders was to reintegrate them into society, thereby reducing the expenses incurred for their judicial and criminal administration.
The Japanese Empire recognized the judicial protection project as one that could not be neglected in ensuring public peace, as well as being devoted to the productive sector, for Japan that was under a state of the decisive battle. The Korean Judicial Protection Project Ordinance and the Korean Judicial Protection Officer Ordinance, which were enacted for this purpose, set up the judicial protection project to include thought offenders, juvenile offenders, and general offenders (common offenders). However, probation centers and preventive detention centers had already been established for thought offenders by the 1936 Korean Thought Offender Probation Ordinance, the 1941 Korean Thought Offender Preventive Detention Ordinance, and the amendment to the Public Peace Maintenance Act; juvenile courts and houses of correction were to be established by the 1942 Korean Juvenile Ordinance and the Korean House of Correction Ordinance. As special government offices and authoritative bodies already existed for the judicial protection of thought offenders and juvenile offenders respectively, these ordinances focused on general offenders and juvenile offenders outside the jurisdiction of juvenile courts. To this end, the Japanese Government-General of Korea selected judicial protection officers and assigned them to each borough of protection. In addition, the Judicial Protection Committee, a guidance and training organization for protection officers, was established in each district court prosecutor’s office in Gyeongseong, Daejeon, Hamhung, Chungjin, Pyongyang, Sinuiju, Haeju, Daegu, Busan, Gwangju, and Jeonju.
In August 1943, the government began laying the groundwork for mobilizing judicially protected subjects for work, and the following year, in March 1944, judicially protected subjects were organized into port dedication corps, which were mobilized to ports designated by the Korea Maritime Transport Corporation and forced to work. Initially, 3,100 people were to be dispatched to 6 ports, but by April 1945, the plan was revised to dispatching 5,550 people to 13 ports. Furthermore, the Governor-General sought to transform judicially protected subjects into a group compliant to rules, much like prisoners in a penitentiary. This shows that the reason why the legislation of the judicial protection project, which had been stalling, was achieved at a certain point in time was to forcibly mobilize all offenders in colonial Korea, including judicially protected subjects, to work.
