의자(義子)의 양자(養子) 지정 사례를 통해 본 16세기의 수양(收養), 시양(侍養) 관행 - 「1584년 나주목 결급 입안」의 향리가 양자 사례를 중심으로 - = 16<sup>th</sup>Century Suyang and Siyang Adoption Customs as Seen through the Designation of a Stepchild as an Adopted Child - The Case of the “1584 Naju-mok Civil Docket” Concerning an Adoption by a Local Clerk Family -

이 연구에서는 「1584년 나주목 결급 입안」의 16세기 향리가 여성인 정 조이가 남편의 막내아들을 양자로 삼아 그의 대부분의 재산을 증여한 사례가 조선 전기의 수양, 시양의 관행과 16세기 가족·친족 관계와 사회질서 내에서 어떠한 의미를 지니는지를 파악하고자 했다. 이 입안에 수록된 소송은 本族과 義子 사이의 쟁송에서 출발했지만 의자 중 막내인 나기년이 정 조이의 양자로서 그의 대부분의 재산을 증여받았다는 것이 인정되어 의자측이 승소한 사건이다.
수양과 시양은 입양 대상과 목적에 제한이 없었던 입양 관행이다. 그러나 고려시대부터 계승되어 온 친족관계와 원 재주의 혈속 외에 재산을 주는 것을 꺼리던 증여·상속의 관행에 따라 夫妻의 친족을 수양 자녀나 시양 자녀로 삼을 때에는 남편과 처가 각각 자신의 친족을 양자녀로 삼고자 하는 것이 일반적이었다. 그런데 이 사례는 자신과 혈연관계가 없는 남편의 아들을 양자로 삼은 사례이다. 15세기에도 남편의 아들이나 손자를 양자로 삼은 사례가 나타나지만 왕실이 아닌 민가에서 많은 재산을 상속받은 여성이 남편의 직계 자손을 양자로 삼아 자신의 대부분의 재산을 증여한 것은 이 사례가 유일하다. 16세기 의자를 양자로 삼아 재산을 증여한 이 사례의 의미는 다음과 같이 파악된다.
이는 계모와 어려서부터 기른 막내 의자 사이에 친밀감이 형성되어 자신의 대부분의 재산을 주고 사후 제사를 부탁한 사례이다. 정 조이는 막내 의자 나기년을 양자로 지정하고 다른 의자와 차별화하여 그에게 자신의 대부분의 재산을 증여했을 뿐 아니라 다른 재산 상속권자인 본족에게 재산을 주지 않았다. 그의 재산 증여는 그의 사후 벌어진 이 소송에서 정당성을 인정받았다. 이렇게 수양 자녀나 시양 자녀의 지정은 재산 증여에 재주의 의사를 자유롭게 반영하기 위한 방법이 되기도 했다.
16세기 일부 양반가에서는 기존 입양 관행과는 달리 자식이 없는 여성이 夫家의 가계계승자를 수양자나 시양자로 삼아 자신의 대부분의 재산을 증여하고 자신과 남편의 사후 제사를 부탁함으로써 유교적 제사형태 정착을 지향하는 정부 정책에 부응한 사례들이 나타난다. 그런데 이 사례는 이와는 달리 장자를 봉사자로 지정한 남편과 별도로 막내 의자를 양자로 삼아 자신의 봉사자로 지정한 사례이다. 남편과 처가 자신의 재산을 이어받을 각자의 계승자를 지정하던 이전의 입양 관행을 답습한 사례인 것이다.
그럼에도 송관이 정 조이의 재산 증여를 인정한 것은 조선 정부에서 국초부터 유교적 제사형태를 정착시키기 위해 심혈을 기울여 여러 제도들을 만들어가면서도 이를 위해 새로 제정한 입후법에 의한 입후와 기존 입양 형태인 수양, 시양의 공존을 인정한 것과 같은 맥락에서 파악할 수 있다. 16세기 실제 대민 통치를 하던 수령 역시 개인이 자신의 감정이나 이익에 따라 기존 입양 관행에 의해 양자를 선택하더라도 이러한 선택이 법에 위배되거나 풍속을 해치지 않는 한 이를 존중하며 그 관계를 적극적으로 인정해 주는 방식으로 통치했다는 사실을 파악할 수 있다.
This paper analyzes the “1584 Naju-mok Civil Docket” concerning the adoption by local clerk family member Ms. Jeong of her youngest stepchild, as well as the corresponding passing down to that child most of her property. It assays the significance that this case held within the suyang (收養) and siyang (侍養) adoption customs of early Joseon, and within the familial and relative relations ― as well as the social order ―of the 16<sup>th</sup>century.
This suit began as a dispute between Jeong’s side of the family and the stepchild in question. With the legal recognition of youngest stepchild Na Ginyeon’s receiving the majority of Jeong’s estate in his capacity as her suyang/siyang adoptee, the suit wound up as a legal victory for the stepchild’s side.
Both suyang and siyang adoption practices were unrestricted in the objects or purposes of adoption. However, according to the relative relations and the estate bequeathing and inheritance practices of the time, in a married couple’s selecting among their blood relatives a suyang/siyang adoptee, both the husband’s family and the wife’s family commonly preferred to select from among their own lines. Yet the 1584 case was one of the adoption of a husband’s stepchild, with no blood relation to the adopter. Although there exist some 15<sup>th</sup>century examples of a woman’s adopting a husband’s son or grandson as her own, among those outside the court, the 1584 case stands out as the only one in which a wife ―having inherited a sizable estate from her parents ―takes a direct descendant of her husband as the adoptee and passes on to him the majority of that estate. The significance of this 16<sup>th</sup>century adoption of a stepchild and corresponding bequeathing of estate can be understood as follows.
This was an instance of a close bond forming between a stepmother and the stepchild she had raised from an early age, and that stepmother’s bequeathing the majority of her estate to that child with the request that he perform rites for her after her death. Ms. Jeong did not just adopt Na Ginyeon as her own child and treat him differently than her other stepchildren, bequeathing him the majority of her estate. She moreover elected not to give property to those among her own side of the family who held inheritance rights to her property, and through this lawsuit arising after her death, ultimately secured recognition for her preferred manner of passing down her estate. This became a means for the designation of one’s suyang/siyang adopted children to freely reflect a property owner’s estate planning intentions.
In the 16<sup>th</sup>century, certain yangban families ―diverging from established adoption customs and responding to the government’s policies of promoting Confucian ancestral ritual forms ―began to designate as a childless woman’s suyang/siyang adoptee the husband’s family successor, and to bequeath the majority of her estate to that child, together with the request that the child continue to perform rites for both adopted parents after their deaths. But the 1584 case stands apart from this trend; it was a case of a wife’s selecting, separate from her husband’s successor, her youngest stepchild as her adopted child, and of naming him the keeper of her rites. In other words, it was the implementation of an earlier form of adoption, in which the husband and the wife each designated their own successor and heir to their estate.
That despite this, the suit’s presiding official recognized Ms. Jeong’s passing down of her estate can be understood in light of the fact that, even though Joseon’s government had ―since the start of the dynasty ―focused intensely on ensuring the spread and establishment of Confucian ancestral ritual forms, developing numerous systems to hasten the process and even creating a new adoption law, it also recognized the coexistence of the preexisting adoption forms suyang and siyang. This case also reveals that for the 16<sup>th</sup>century magistrate directly interfacing with those he governed, providing that one’s choice of adopted child ―even if that choice were made on the basis of preexisting adoption practices and according to one’s personal feelings and to one’s own benefit ― did not violate the law or disturb the customs of life, respecting and actively acknowledging those adoption choices was a real strategy of rule.
