사법상 반려동물의 생존에 대한 보호 방안에 관한 소고 = 증여와 유언을 중심으로

1. 본 논문은 반려동물 인구가 천만시대에 접어든 우리 나라에서도 반려동물의 소유자가 사망한 후 반려동물의 생존에 대한 보호 방안을 논구한 것이다. 서구 유럽의 민법들이 “동물은 물건이 아니다(Tiere sind keine Sache)”라는 선언적인 규정과 함께 구체적인 조치들을 통해 동물의 법적 지위의 보호를 모색하고 있다. 그러나 우리 나라에서는 아직 이러한 사법상의 입법 조치가 이루어지지 않고 있는 실정이다. 이러한 상황 하에서 반려동물의 인구가 폭증하고, 또한 고령화 사회에 접어 고령자들이 자신의 사망 후 반려동물의 생존 보호에도 관심을 갖게 되었다. 그러나 반려동물의 소유자의 사망 후 반려동물의 생존 보호에 대한 사법상 특별한 조치들이 미흡한 상태에 있다. 따라서 사법상 일반 원칙에 따라 반려동물의 생존 보호를 모색해야 하는데, 민법상으로는 부담부 증여와 사인증여 및 부담부 유증이며, 신탁법상 유언신탁과 유언대용신탁 등이라 할 수 있다.
2. 먼저 부담부 증여와 부담부 사인증여에 의한 동물의 생존 보호 방안은 계약에 따라 동물의 생존 보호가 법적 의무로 결정되는 것이기 때문에, 동물의 생존 보호에 게을리한 경우 채무불이행으로 인한 손해배상뿐만 아니라 담보책임까지 부가할 수 있다. 따라서 증여자의 의사에 부합하는 동물의 보호가 이루어질 수 있을 것이다. 이에 반해 부담부 유증은 유언이라는 단독행위에 의해로 부담이 발생하기 때문에, 수증자가 부담을 포기할 수도 있다. 다시 말해 유증자가 사망하기 까지 수증자가 부담을 수용할지 여부가 불안하게 된다. 따라서 거의 같은 효과가 예상되는 부담부 사인증여가 부담부 유증보다 나을 것이라 여겨진다.
3. 이러한 민법상의 증여나 유언에 의한 반려동물의 생존 보호 이외에도 유증의 기능과 유사한 신탁법상 유언신탁과 유언대용신탁이 활용될 수 있을 것이다. 유증은 증여자가 일단 증여 목적물을 양도하고 나면, 더 이상 목적물에 대해 권리를 행사할 수 없으나, 신탁의 경우에는 위탁자가 계속해서 일정한 권능을 보유하게 된다. 또한 수증자는 증여 목적물에 대한 부담과 같은 별도의 급부의무를 인수하지 않는 한 증여물을 자유롭게 사용 수익 처분할 수 있으나, 신탁법상 수탁자는 신탁 목적에 따라 그 관리나 처분에 제한을 받게 된다. 그러나 신탁계약은 계약자유의 원칙상 위탁자의 의사가 가장 반영될 수 있는 다양성과 유연성을 지니고 있어 동물의 생존 보호에 가장 바람직한 제도로 활용될 수 있을 것이라 여겨진다.
4. 신탁법상 유언신탁과 유언대용신탁는 금융상품으로 활용되고 있지만, 반려동물의 생존 보호조치로서는 상대적으로 생소한 것이라 할 수 있다. 특히 법정상속이 중심이 되어 있는 우리나라 상속제도에서는 크게 주목받지 못하였다. 그러나 유언대용신탁이나 유언신탁은 단순히 사인증여나 유증에 비해 다양하고 탄력적인 방법으로, 더 나아가 위탁자의 의사를 보다 적극적으로 반영하여 위탁자의 재산승계를 설계할 수 있다는 장점을 지니고 있다. 최근 KB 펫 (Pet)신탁에서 확인할 수 있듯이 앞으로 가장 유용한 제도로 평가될 수 있을 것이라 여겨진다. 특히 헴슬리(L. Helmsley)와 같은 부호가 아닌 일반 소시민들이 소액으로도 반려 동물의 생존을 보호할 수 있는 제도라고 생각된다. 다만 은행 등 수탁자가 대부분 영업을 목적으로 하는 것이기 때문에 수수료의 지불은 불가피할 것이다.
1. This paper explores protective measures in Korea, where the companion animals have reached 10 million in recent years, in order to ensure the survival of companion animals after their owners decease. Civil law in western Europe protects the legal status of animals by specific measures alongside the declaration of “Tiere sind keine Sache”, meaning “Animals are not objects.” In Korea, however, there is no such legislative action in place yet. Under these circumstances, the population of the companion animals continue to steeply grow, and in today’s aging society, the elderly became interested in protecting the survival of companion animals following their death. Therefore, for the sake of protecting the survival of companion animals in accordance with the general principles under civil law, Schenkung unter Auflage, meaning “onerous gift”; Schenkung von Todes wegen, meaning “gift effective upon death”; and Vermaechtnis unter Auflage, meaning “bequest subject to charge”; testamentary trust and living trust, among others, are available under civil law.
2. First, the plan for the survival of animals by onerous gift and gift effective upon death is determined by the contract of protecting the survival of animals as a legal obligation. This may cause the responsibility for their security along with indemnification, contingent upon non-performance of the obligation, when the negligence of the protection of animals for their survival might occur. Therefore, the protection of animals that conforms to the wishes of the gifter may be feasible. On the other hand, because onerous gift is actuated by the sole act of the will, the burden may be abandoned by the giftee. In other words, until the gifter dies, it is uncertain as to whether or not the giftee will accept the burden. Therefore, it is likely that the gift effective upon death having almost the same effect would be better than the onerous gift.
3. In addition to the protection of the survival of companion animals by the gift under civil law or testament, the testamentary trust and living trust under trust law may be utilized instead for the similar function of bequest. The bequest is such that once the donor transfers the object, he or she could no longer exercise any rights over the object. By contrast, in the case of the trust, the entrustor will continue to have a certain power of ownership. . Furthermore, the beneficiary may freely dispose of the gift as long as he or she does not accept a separate payment obligation, such as a burden on the gift, but trustees are subject to restrictions on their management or disposition according to the very purpose of the trust in question. However, it is believed that the trust contract can be utilized as the most desirable system for protecting the survival of animals because of the diversity and flexibility that the consent of the consignor can best reflect under the principle of freedom for contract.
4. Although testamentary trust and living trust are utilized as financial instruments under the trust law, they are relatively new as a protective measure for the survival of companion animals. Particularly, they have not attracted much attention in Korea where the inheritance system is centered upon court inheritance. However, these trusts can be designed in a much more flexible way than the gift is, which is effective upon death or bequest. Moreover, they can reflect the trusters intention more positively and design succession of the truster’s assets. As can be seen in the recent KB Pet Trust, it is considered to be the most useful system in the future. Especially, unlike the Helmsleys, ordinary people can use such a system to protect the survival of their companion animals even in small monetary value. However the payment of fees will be inevitable since the trustees such as banks are providing relevant services mostly for business purposes.
