2010년도에 헌법재판소에 접수된 사건의 총수는 1,720건인데, 그 중 위헌법률심판사건이 99건, 권한쟁의심판사건이 6건, 헌법재판소법 제68조 제1항 헌법소원심판사건이 1,035건, 헌법재판소법 제68조 제2항 헌법소원심판사건이 580건이다. 한편, 지난 5년간(2006년 이후) 연도별 접수사건 추이를 보면, 위헌법률심판사건이 17→24→28→36→99건이 접수되었다. 권한쟁의심판사건의 접수추이는 7건→5건→8건→12건→6건으로 큰 변화가 없으며, 헌법재판소법 제68조 제2항 헌법소원사건의 접수추이는 119건→146건→180건→464건→580건이다. 헌법재판소법 제68조 제1항 헌법소원의 접수추이는 1,562건→1,596건→916건→975건→1,035건의 추이를 나타내고 있다. 2010년에 처리된 1,670건의 헌법재판사건 중에서 권한쟁의심판, 규범통제형 사건, 헌법재판소법 제68조 제1항 헌법소원 사건의 심판유형별로 각각 적법요건판단 2건 및 본안판단 2건씩 모두 12건의 결정을 분석해 보았다. 그 중에서 먼저 적법요건판단 부분을 보면, 국가인권위원회의 권한쟁의심판 청구인능력을 부인한 헌재 2010. 10. 28. 2009헌라6 결정은 국가인권위원회의 기능이 갖는 헌법적 의미를 고려하지 않은 판단이라는 비판을 면치 못할 것이다. 또한 고시의 헌법소원대상성을 인정한 헌재 2010. 9. 30. 2008헌마758 결정은 대법원의 항고소송 인정 판례가 쌓여가고 있음에도 불구하고 헌법재판소가 여전히 심판대상으로 붙잡고 있는 것으로서, 보충성원칙과 관련하여 지양해야 할 태도라고 판단된다. 한편 본안판단 부분을 보면, 소위 ‘제2차 미디어법 사건’인 헌재 2010. 11. 25. 2009헌라12 결정은 헌법재판소가 국회의원의 법률안 심의ㆍ표결권 침해를 인정했음에도 불구하고 국회의 자율영역을 존중한다는 이유로 당해 날치기 통과 법률의 효력을 인정한 ‘제1차 미디어법 결정’의 하자를 치유할 수 있는 기회를 스스로 포기하였다는 평가를 받아 마땅할 것이다. 반면에 소위 ‘미네르바’ 사건인 헌재 2010. 12. 28. 2008헌바157등 결정에서 심판대상인 전기통신기본법의 해당 조항에 대하여 명확성원칙 위반을 이유로 위헌임을 선고한 것은 표현의 자유의 가치를 다시 확인해 주었다는 점에서 높이 평가할 만하다고 할 것이다. 마지막으로, 헌법재판소는 그 결론의 당부는 물론이거니와 결론에 이르게 된 과정에 대한 설득력 있는 논증을 제시하여야 한다. 그런 점에서 헌법재판소는 기존의 이론에 안주하지 말고 부단히 노력하는 자세를 보여주어야 할 것이다.
더보기In 2010, a total of 1,720 cases are filed in the Constitutional Court this includes 99 constitutionality of statute cases, 6 competence dispute cases, 1,035 constitutional complaint cases according to Article 68(1) of the Constitutional Court Act, and 580 constitutional complaint cases according to Article 68(2) of the Constitutional Court Act. Meanwhile, the trend in number of filed cases by year since 2006 is as follows: 17→24→28→36→99 constitutionality of statute cases are filed. With 7→5→8→12→6 cases, there is little fluctuation in the number of competence dispute cases filed. The trend for constitutional complaint cases according to Article 68(2) of the Constitutional Court Act is 119→146→180→464→580. For constitutional complaint cases according to Article 68(1) of the Constitutional Court Act, it is 1,562→1,596→916→975→1,035. Among 1,670 constitutional court cases, in 2010, competence dispute case, Normenkontrolle-type (constitutionality of statute and constitutional complaint according to Article 68(1) of the Constitutional Court) case, and constitutional complaint case according to Article 68(1) of the Constitutional Court are, 2 cases of judgment on the justifiability requirements and 2 cases of judgment on the merits respectively, total of 12 decisions. First, let’s observe the judgment on the justifiability requirements part. The Constitutional Court’s decision of 2009Hun-Ra6, October 28, 2010, which the Court denied the National Human Rights Commission’s competence dispute party ability, cannot avoid being criticizedfor not considering the constitutional significance of the National Human Rights Commission’s function. Also, the decision of 2008Hun-Ma758, September 30, 2010, which the Court the constitutional complaint object of the public notification, demonstrates that the Constitutional Court is still taking hold of the adjudication object, despite the Supreme Court have accumulatively admitted those type of cases as administrative litigation. Thus, it can be judged that the Constitutional Court should avoid such attitude with respect to the principle of exhaustion of other remedies. Meanwhile, the next point for observation is the judgment on the meritspart. 2009Hun-Ra12, November 25, 2010—the so-called “second media acts decision”—deserves the evaluation that the Constitutional Court gave up on its chance to redeem the flaws of the first media acts decision—the case that the Court admitted the validity of the law passed by snatching to respect the National Assembly’s autonomy domain despite that the Court acknowledged the infringement of National Assembly member’s right to deliberate and vote on the legislative bill. On the other hand, 2008Hun-Ba157, etc., December 28, 2010 decision—the so-called “Minerva case”—is worthy of appreciation. The reason is that the Court reaffirmed the value of the freedom of expression as it sentenced unconstitutional to provisions of the Frame Work Act on Telecommunication for its violation for vagueness doctrine. Lastly, the Constitutional Court should present not only the conclusion’s true or false but also a persuasive rationale on how it arrived at the conclusion. In such regards, the Constitutional Court should not be complacent on the existing theory but show a diligently striving attitude.
