In our society, a strong desire about safety was amplified to civic security before and after the 1989 Asian Games and the 1988 Olympics. Amplified attention about civic security is a proof that protecting civil's life and safety that was an exclusive property of the public administrative agency became available among people. Recently, in the 2002 World Cup, civic security activity about surroundings of stadiums became an opportunity to remind an importance of civic security.
When the foundation of a nation was established, security of individuals was an exclusive property of the haves and protected their personal dangers and wealths with their personal expenses. As time changes, royal authority has become stabilized and society has gotten systematized, so personal security system for some classes has been absorbed to public establishment for a purpose of social integration. A change from personal security to public security has been achieved in stability of the nation. Since this convert, security by the public administrative agency always had been prior to personal security that results in performing a role exceptionally as a simple complementer.
However, as the world became industrialized, development of citizen classes and complicated and diversified society brought an interest of civic security. Because of developed classes of citizens, society brought a power shift from the aristocracy system to citizens, a central force of the society which modified liberalism and democracy. In addition, the aristocracy was converted to the civil society during this change. Development of classes of citizens generated self-relief ideology with economic capacity and demand of personal security.
To raise satisfaction for personal needs, a shift of security was made from public administration to increased personal security. Thus it led to a stack of works and an increase of social demands that extended active regions of civic security and diverse works in various fields.
Especially, in a modern society, demands for civic security were risen rapidly. In case of the U.S. since the 19th century civic security had been started in earnest and had been taken in a variety of fields. Even in battlefields such as Iraq and Afghanistan, security is being extended to caring and keeping watch public facilities. Like this, in socially developed nations, the public administrative agency has fulfilled fields that they can not take, or public administrative field works with civic security. Security work depends more and more on citizens than the public administration as time goes. A reason for this may be that the public administration can not take social expense and inefficiency of work.
In case of South Korea, a demand for civic security has been raised and a proper countermeasure should be prepared about this problem. In present, a number of polices are not enough for those demands , and there is a limit that diverse crimes and social unrest factors can not be handled properly. To cope with increased public order demands and social safety, the civic security is a mandatory component of the society in present. For now in South Korea, responsible population per a police is about 498 people. This number is about 150 more than Japan so public service in Korea is limited. Also, if public institutes take security works, actual public order services that citizens request would not be provided immediately and directly.
On the contrary, personal security is connected directly to public order demand and providers, so fast service would be available. Because of these reasons, citizens and society's requests about personal security are increasing but current legislation system about personal security still remains the level of the past. Thus, legislation system should be repaired to get the level that citizens and society request.
Civic security has a complementary role to take fields that police can not take. However, the present civic security has a role of a partner not just a complementary role. recognizing a limit that a change of public order is not actively counteracted, security business is working on this problem. Unless work range of security business infringe citizens' rights and interests, Civic security can take a role as a partner, not a complementary.
The current security law should work on an improvement for efficient and professionalized work about expanded security demands. To achieve this improvement, legislative problems should be resolved. First problem is that the definition of security business in security law is not clear. Second one, limits of work range of security. Third, the duality of admitters and inspectors. Fourth, unclear contents rule about semicontraction. Fifth, principle of liability with fault about damages. These security law problems are bringing a limitation that principle of clearness of administration law can not achieved. Further more, security law is not defined in detail, so if there is a damage by security law, then the damage relief does not get solved. Therefore, a solution about this problem should be come up with.
To deal with many problems that the security law has, growth and development of security business are suggested to obtain the purpose of this law. Among several suggestions, first, integration of security law and security guard law. Second, obvious definition of security law. Third, secured various work range about security.
