의료기관 전공의의 노동법적 지위와 보호방안 검토 - 전공의 근로자성과 전공의 특별법의 문제점을 중심으로 -

이 글은 의료기관 전공의의 열악한 수련환경을 개선하고 그들의 인권을 보호할 수 있는 원칙적인 방법이 무엇인지를 모색하기 위해 작성된 글이다. 먼저, 전공의 수련제도의 일반적인 내용과 보호의 필요성에 대해 분석하고 평가한다. 그 다음으로 판례 분석과 법 해석 전반에 걸친 쟁점사항을 검토하여 전공의의 노동법적 지위를 확인하고 마지막으로 새롭게 재정된 전공의 특별법의 주요내용과 문제점을 평가하여 기본적인 보호방안을 제시하고자 한다. 의료 질 향상을 통해 수준 높은 의료 서비스 제공을 목적으로 시작된 전공의 수련제도는 오늘날 의료인에게 일반화된 과정이다. 그러나 주100시간 넘는 수련시간 등 그 환경은 매우 열악하다. 수련병원이 전공의를 피교육자 지위에서 과도한 근로를 전제로 진료계획을 세우기 때문이다. 법원은 전공의의 근로기준법상 근로자성을 일관되게 인정한다. 근로 경험이 곧 수련이라는 관점에서 사용종속관계가 인정됨에 따라 근로자 권리를 인정하고 있다. 하지만 수련기준의 법제화라는 평가를 받는 전공의 특별법과 의료현실은 여전히 전공의를 피교육자 지위에서 처우하고 있고 일부에서는 근로제공의 동기가 수련이라는 점이 근로기준법을 온전히 적용 할 수 없는 이유라고 지적한다. 그러나 수련병원의 경영상 어려움이나 이중적 지위는 근로자성을 배제하는 근거로 볼 수 없고, 근로제공의 동기는 근로자성 판단요소가 아니다. 따라서 전공의 수련은 근로자 지위에서 평가되고 재정립되어야 한다. 아울러 전공의 특별법은 그 동안 전공의가 법원의 결정을 통해 근로자 권리를 인정 받아오던 상황에서 주80시간 근로에 대한 법적 근거로 활용될 수 있다는 점, 근로기준법상 근로자이나 보호 규정이 배제 된다는 점, 수련과 근로에 대한 개념 구별이 없고 각종 가산임금 산정 기준에 관한 규정조차 없다는 점 그리고 대등한 교섭 주체를 인정하지 않으면서 근로와 수련계약 체결을 강제하고 있다는 점 등 많은 문제점을 가지고 있다. 결국 전공의 수련제도는 근로기준법상 각종 근로자 권리를 전제로 재정립되어야 하고, 국가의 재정적 지원이 수반되어야 한다. 또한 스스로 수련환경을 결정할 수 있도록 교섭 가능한 전공의단체와 수련환경을 관리․감독할 수 있는 독립적인 단체의 설립 근거를 마련하여 전공의 보호의 실효성을 높이는 방안이 필요하다.
This article has been written with specific objectives in seeking the effective ways to improve inadequate training environments of the residents in medical institutions, and to find out complementary principles to protect their labor rights. To cope with such objectives, the empirical analysis and evaluation on the concept and enactment background of medical resident training system, along with its substantive needs of protection will be conducted. Subsequent efforts will be made to properly define the right concepts by determining the controversial issues on attitudes of the court, its interpretation of the laws and the labor legal status of medical residents in general. Lastly, some of the main contents, disadvantages and improvement methods for Special Act on Medical Residents, with other means of resolving the issues will be suggested as effective alternatives for protective directions. Medical resident training system has been initiated in order to deliver a high standard of medical services through the enhancement of medical qualities, which has become a generally accepted procedure among the medical specialist nowadays. Nevertheless, its training environments reveal quite inadequate institutional policies with more than 100 hours of training per week, and other infringements of labor rights. Such realities have been due to medical treatment plans, which are organized by the training hospitals based on a precondition of excessive training hours for medical residents as trainee status. In this regard, the court recognizes the status of trainee for medical residents, together with their legal nature of the labors based on the Labor Standards Act. In the perspective of practical working experiences as means of training, the court further acknowledges the appropriate labor rights in this context as well. However, the medical reality with Special Act on Medical Residents being evaluated as merely an enactment of training standards, still place medical residents in trainee status. Some has pointed out that resident training as the motives of offering labors may have caused an inability to apply the Labor Standards Act in its entirety. Unfortunately, neither the managerial difficulties nor dual status can be perceived as the evidence that excludes a legal nature of the labors. Even the motives of offering labors cannot be a judgement factor for such nature. Thus, it will be proper to perceive a resident training with the status of professional worker, rather than simply conclude it based on the perspective of trainee. Especially, there have been many disadvantages of Special Act on Medical Residents as it can be used for a legal evidence of working 80 hours per week, under the situation where the court has been the one to make a decision on the residents’ labor rights; the reality of partial applications of Labor Standards Act upon the residents; non-existence of payment standards and ambiguity in the differences between training and working; and finally for forcing the labors and training contracts with no such recognition of equal bargaining subjects. To conclude the article, the medical resident training system should be readjusted to meet various labor rights in the Labor Standards Act as obligatory prerequisites. Moreover, the nation’s financial supports should be entailed with empowering the protection of the residents’ rights through the inaugurations of relative associations, and the independent management supervisory institutions.
