인지무효와 상속분가액지급청구권 = Nullification of affiliation and Claim for Payment of the Amount Equivalent to Portion in Inheritance

국문 초록 (Abstract)

최근 우리 헌법재판소는 제1014조의 상속분가액지급청구권에 제999조 제2항의 ‘상속권 침해행위가 있은 날로부터 10년’이라는 기간을 적용하는 것을 위헌이라고 결정하였다. 대법원은 일관하여 상속분가액지급청구권에 제999조 제2항의 제척기간이 적용된다고 판시하지만, 그 기산시기에 대하여는 구체적으로 논의되었던 바는 없다. 그러나 상속권의 침해행위가 있은 날을 다른 공동상속인이 상속재산을 분할 기타 처분한 날로 해석하면 상속재산을 처분한 날부터 10년이 지난 후에 인지를 받은 피인지자는 상속권을 잃는다. 이는 여러 가지의 면에서 피인지자의 상속권을 침해하여, 결과적으로 이를 위헌으로 한 것은 타당하다. 다만 심판대상을 제1014조로 하고 그 청구권의 제척기간을 구체화하지 아니한 잘못을 지적함이 보다 적절하였을 것이다.
한편 법원의 재판은 헌법소원의 대상이 될 수 없지만, 민법학의 시각에서 전제가 되었던 인지무효 판결이 적절하였는지를 검토할 필요가 있다. 이 사건 청구인의 표현부가 한 인지는 실제 친생자관계에 있지 않으므로 인지무효사유에 해당한다. 그러나 법원은 그 인지가 2012년 민법 개정 전 이루어진 것으로서 무효행위 전환 법리에 따라 입양의 효력을 인정할 수 있다는 인지와 입양의 법리를 오해하고 인지무효를 인정한 잘못이 있다. 향후에도 친부와의 관계 못지않게 가족관계를 형성하고 부양하여 온 표현부의 관계도 단절되지 않도록 배려하여 복잡한 법률분쟁에 휘말리지 않도록 하는 방법이 마련되어야 한다.

다국어 초록 (Multilingual Abstract)

Recently, our Constitutional Court ruled that the application of the period of “ten years from the date the right of inheritance is infringed” in Article 999, Paragraph 2 to the right to Claim for Payment of the Amount Equivalent to Portion in Inheritance under Article 1014 is unconstitutional. The Supreme Court has consistently ruled that exclusion period in Article 999, Paragraph 2 applies to the right to Claim for Payment of the Amount Equivalent to Portion in Inheritance, but there has been no specific discussion on the starting point of ten years from the date the right of inheritance is infringed. However, if the date of the infringement of inheritance rights is interpreted as the date when another joint heir divided or otherwise disposed of the inheritance, the person who received affiliation after 10 years from the date of disposal of the inheritance rights loses the right to inheritance. This infringes on the inheritance rights of the person who received affiliation, so the Constitutional Court’s unconstitutionality decision is valid. However, it would have been more appropriate to have Article 1014 as the subject of the judgment.
On the other hand, although a judgment of the courts cannot be the subject of Adjudication on Constitutional Complaint, it is necessary to review whether the ruling of nullification of affiliation, which was the premise from the perspective of civil law, was appropriate. The affiliation made by the false father in this case is not in the actual biological relationship, so it is a ground for nullification of affiliation. However, the court may recognize the effect of adoption according to conversion of null act, but it is wrong to recognize nullification of affiliation by by misunderstanding the legal doctrine. In the future, consideration must be given to ensure that the relationship with the false father, who has formed and supported the family relationship as well as the relationship with the biological father, is not severed, and methods must be developed to prevent the child from becoming embroiled in complex legal disputes.
