現行 補償法上 土地評價規定에 관한 法的 考察 = A Study on the Appraisal Provisions of the Land by the Existing Compensation Law

다국어 초록 (Multilingual Abstract)

The purpose of this research is to suggest the point at issue about the appraisal provisions of the land by the existing compensation law resulted from the operation of public works as well as to propose improvement measures in legal system
The large-scale developing public works that has been carrying out recently is extended its range of infringement to the right of property
Thus the compensation program in Korea that has been operated based on compensation in substitutes has its limitation so it resulted in its change inevitably.
The change of such laws of compensation and feelings of people to it resulted in the expansion of compensation program that was carried away and it provided us for the indisputability for the logical necessity
So, firstly the meanings of current interpretation on ‘the concept of compensation for loss,’ and ‘just compensation’ were newly suggested as below.
First, extension for compensation in the aspect of its concept is required considering critical viewpoint and the change of realistic compensation environment, and it is reasonable to define compensation that ‘it is an accommodative and supplementary system under guarantee of continued existence and guarantee of the right to live against special sacrifice which is forced by legal exercise of public power that is required by public necessity.’
And the interpretation for current constitutional ‘just compensation’ should be seen as ‘perfect compensation’ in the manner of most of theories and precedent cases, but it is expanded for its extent in the concrete meaning and scope of ‘perfect compensation’ as below; ① compensation for actual property loss in expropriation area, ② compensation for incidental loss directly or indirectly raised by the case of ①, ③ life compensation followed by the loss of life benefits ④ lastly compensation in the area outside the expropriated province
On this research based on above-mentioned ‘the concept of compensation for loss,’ and ‘just compensation’, appraisal provisions(of the land) which were the most controversial problems in the existing compensation law
For this, as a matter of convenience, appraisal provisions(of the land) were reviewed by dividing 2 categories of compensation for general and special type
After this, the latter case is subdivided by ‘the land of the not-compensated’, ‘the land of the not-permitted to be built’ and ‘the land of the illegal changed’.
And then this approach presented the limitations of the these appraisal provisions(of the land) and that improved plans in each case
