나고야의정서상 주요 이용국들의 접근 및 이익 공유(ABS) 법제 분석과 우리나라 유전자원법에 대한 비교 검토

나고야의정서에 비준한 국가는 123개국을 넘었고, 이제 나고야의정서상의 ABS 메커니즘은 국제사회에서 하나의 트렌드를 형성하게 되었다. 이러한 상황에서 개별국가들의 ABS 법제 분석은 이제 필수불가결한 일이 되었으며, 이용국 입장에 가까운 우리나라 유전자원법은 유사한 입장을 취하고 있는 선진 이용국들의 ABS 법제를 종합적으로 분석·검토하여 향후 개선점을 모색할 필요가 있다.
이에 본문에서는 먼저 나고야의정서상의 주요 쟁점사항들인 국가책임기관 등 관할기관의 지정, PIC, MAT, 상업적 이용 및 비상업적 이용, 유전자원 관련 전통지식, 처벌 등을 중심으로 개괄적으로 살펴본 후, 유전자원의 이용국에 가까운 입법태도를 갖는 국가들의 이러한 쟁점 사항들에 관하여 살펴보았으며, 이를 종합적 견지에서 우리나라의 유전자원법과 비교하여 평가하고 향후 개선점을 모색하였다. 첫째, 나고야의정서의 국내이행 주관기관으로는 주로 각국의 환경부가 역할을 수행하고 있으나, 나고야의정서가 우리나라 대외무역법상의 생물자원의 보호 및 국제통상이나 국제거래와 깊은 관련이 있고 MAT에 대한 산업통상자원부의 역할을 감안해 일본이 경제산업성을 국가책임기관으로 사실상 지정한 것과 같이 산업통상자원부를 국가책임기관으로 지정하는 것을 고려할 필요가 있다. 둘째, 나고야의정서가 인정하고 있는 유전자원에 대한 국가의 주권적 권리를 실행하기 위해 국가는 PIC을 허가제도나 신고제도로 운영할 수도 있고 PIC을 요구하지 않을 수도 있는데, 우리나라는 PIC을 요건으로 하되 허가제도 보다는 신고제도를 도입하고 있어 완전한 제공국 또는 이용국의 입장이라기보다는 이용국에 가까운 입장으로 어느 정도는 유전자원의 제공국으로서의 측면도 고려하고 있다고 볼 수 있다. 다만 접근신고의 예외나 간소화절차를 보다 명확하게 할 필요는 있어 보인다. 셋째, MAT은 나고야의정서상의 핵심사항으로 국가가 그 세부적인 내용을 직접 규율할 수 없고 또한 직접 규율하고 있지 않더라도 MAT은 PIC과 결부된 중요한 사항으로 그 존부에 대해 보장해 주어야 한다. 우리나라는 많은 이용국들과 마찬가지로 MAT체결을 의무화하고 있으나, 유전자원법 시행령이나 시행규칙에서 MAT과 관련한 규정을 추가적으로 마련할 필요가 있으며, MAT 미체결에 대한 처벌 규정의 마련이 필요해 보인다. 넷째, 우리나라 유전자원법도 유전자원에 대한 연구목적의 이용이 향후 상업적 이용이 될 가능성이 있다는 점을 인식하여 이 경우 변경신고를 하도록 하고 있다. 다만, 예외나 간소화절차의 적용을 받는 순수 연구목적의 이용이 연구의 활성화와 연구의 혁신이라는 효과를 가져 올 수 있으므로 바이오산업계에 대한 인식 제고의 측면에서 예외 및 간소화절차의 마련에 지속적인 관심을 가질 필요가 있다. 다섯째, 우리나라 유전자원법은 유전자원 관련 전통지식에 대하여 정의를 내리고 있으나 그 외에 이와 관련한 직접적 규정은 없고, 공개되어 일반적으로 사용되고 유전자원 관련 전통지식의 보유자가 현존하지 않는 경우 문제의 소지는 없다. 하지만 나고야의정서가 기본적으로 양자체제로 규율되고 국제사회의 상호주의의 적용을 간과할 수 없으므로 유전자원 관련 전통지식을 중요하게 여기는 중국 등 국가들의 동향을 예의주시할 필요는 있다. 여섯째, 나고야의정서 이행상 처벌 규정이 없는 국가도 있고, 처벌 규정이 있다하더라도 국가들마다 상당한 차이를 보이고 있다. 우리나라의 처벌 규정은 나고야의정서의 목적 달성에 어느 정도는 부합된다고 볼 수 있으나, 이는 이용자와 제공자 간의 이해관계의 균형 참작의 측면에서 개정될 수도 있을 것이다. 이처럼 우리나라는 CBD와 나고야의정서를 충실히 이행하면서 동시에 이용국에 가까운 국가들의 입법태도를 참작하여 우리나라에 유익한 ABS 이행을 강구해야 할 것이다.
One hundred twenty three countries have ratified the Nagoya Protocol, and now the ABS mechanism in the Nagoya Protocol has formed a trend in the international community. In this situation, the analysis of the ABS legislations for individual countries is now indispensable, and Korea"s genetic resources law, which is close to the position of the user country, needs to comprehensively analyze and review the ABS legislations of advanced user countries who have a similar position to Korea.
This paper first reviewed the main issues of the Nagoya Protocol, including the designation of competent national authorities, PIC, MAT, commercial and non-commercial use, traditional knowledge associated with genetic resources and punishment. In addition, these issues of the countries with legislative attitudes close to the user country were examined, and were compared with Korea"s genetic resources law from a comprehensive perspective, and the improvements were sought. First, the Ministry of Environment of each country plays a role as the main institution of the implementation of the Nagoya Protocol. However, given that the Nagoya Protocol is deeply related to the protection of biological resources and international trade in Korea"s foreign trade law, and that the Ministry of Trade, Industry and Energy plays a role in MAT, just as Japan actually designated the Ministry of Economy, Trade and Industry as the competent national authority, Korea also needs to consider designating the Ministry of Trade, Industry and Energy as the competent national authority. Second, in order to exercise the sovereign right of genetic resources recognized by the Nagoya Protocol, the state may operate the PIC as a permit system or a declaration system, or may not require the PIC. However, Korea has a PIC requirement but introduces a declaration system rather than a permit system. Therefore, it considers the aspect of balanced position rather than a complete provider or user country. However, it is necessary to clarify the exception or the simplification procedure of the access declaration. Third, MAT is the core of the Nagoya Protocol, and even if the state cannot directly or precisely regulate its details, the MAT should be guaranteed as an important matter in connection with the PIC. Korea, like many user countries, requires mandatory MAT, but it is necessary to prepare additional provisions related to MAT in the Enforcement Decree or the Enforcement Regulations of the Korea"s genetic resources law and establish penalties for non-MAT. Fourth, Korea is also aware that there is a possibility that the use of genetic resources for research purposes may become commercial use in the future, so that in this case, the change declaration is made. However, since the use of pure research objectives subject to exceptions or simplification procedures can have the effect of promoting research and innovation of research, it is necessary to pay attention to the preparation of exceptions and simplification procedures for the bio-industry. Fifth, Korea"s genetic resources law defines traditional knowledge associated with genetic resources, but there is no direct regulation related to this. There is no problem when it is open and widely used, and there is no problem when the holder of the traditional knowledge associated with genetic resources does not exist. However, since the Nagoya Protocol is basically governed by a bilateral system, and the application of reciprocity in the international community cannot be overlooked, it is necessary to pay close attention to the trends of countries such as China, where the traditional knowledge associated with genetic resources is important. Sixth, some countries do not have penalties in implementing the Nagoya Protocol, and even though there are penalties, they differ significantly from country to country. Korea"s punishment provisions can be seen to be somewhat consistent with the purpose of the Nagoya Protocol, but this may be amended
