초기 인간 생명의 ‘조건 지음 방식’에 대한 비판적 고찰 = A Study on the Problems of Using the Condition-Build Method to Define Early Human Beings

In legal and philosophical discussions, there have been multiple attempts to determine by what measures to infer human status. For example, in legal dis- cussions, implantation, primitive line formation, and independent viability have been suggested, and in philosophical discussions, the ability to feel pain and to think, including self-consciousness, have given certain subjects rights and status as humans. This is defined as a condition-build method, and this study examines the characteristics and problems of this method. First of all, most claims raise scientific facts as the basis for the establishment of the condition, but the actual basis is social consensus according to social needs and demands. In addition, the condition itself is fluid, according to the persuasive power of the arguments; still does not have a specific time point; and will in- evitably be arbitrary. Moreover, this method has a problem with the intention to be included in the subject to obtain a specific authority even if it generates an object that does not meet the criteria and the intention to pursue socio- economic interests rather than the value of humans. It has consequential problems, including not only the deprivation of life but also the infringement of various rights and changes in moral status. This paper critically analyzes the application of the condition-build method in our society, and it addresses ethicalquestions about who is justified in determining the right of a specific objectto life and death. Therefore, this paper will be used to justify the need for a third approach.
