지방자치단체 외국인주민 인권정책의 규범적 이상과 특성 - 경기도 사례를 중심으로 - = Normative Ideals and Characteristics in the Human Rights Policy of Foreign Residents of Local Governments : Based on the Case of Gyeonggido

Even after the COVID-19 pandemic in early 2020, the influx of foreign residents continued in Korea, reaching 4.4% of the total population as of October 2024. In the face of the low birth rate and aging crisis in Korea, Korea has no choice but to accept the expansion of foreign residents as a natural form and emphasize mutual culture and cultural diversity based on mutual trust and cooperation between migrants and indigenous people. However, this rapid multicultural socialization also means that there are more situations that violate the human rights of foreign residents. Given that local governments can respond much faster to the prevention and relief of human rights violations of foreign residents, it is necessary to reconsider the practices that the central government has tried to solve at the central government level. This paper proposes to identify theoretical differences between the two while raising issues with the practice that local governments have not distinguished support for foreign residents from human rights policies, and to establish a human rights center for foreign residents, especially in basic local governments.
To this end, on behalf of local government regulations related to foreign residents, the "Gyeonggido Ordinance on Support for Foreigners" is compared with the "Gyeonggido Ordinance on Support for Foreign Residents" and the difference between the two is revealed to confirm the normative ideal of mutual trust and cooperation between migrants and indigenous people.
Next, with this principle in mind, the research report investigation method and contents produced in 2021 by the Gyeonggido Foreign Human Rights Support Center will be analyzed as an example of local governments institutionalizing the development of policies to support migrants' human rights. In this process, the difference between human rights and support policies for foreign residents that can be implemented at the level of local governments is identified, and the policies operated by the above center are considered to suggest implications that can contribute to the policy decision of late local governments. Finally, this study emphasizes that when each basic local government operates a human rights center for foreign residents, human rights education and publicity for all residents and public institutions in the jurisdiction, counseling and relief activities for human rights violations, continuous and accurate investigations, and network construction and operation to maintain cooperation with indigenous people can be carried out permanently. And it is expected that specific plans would be produced in subsequent research.
