미국에서의 환경책임 및 환경보험에 관한 연구 = A Study on Environmental Liability and Environmental Insurance in U.S.A. - Focusing on CERCLA and RCRA -

우리나라는 최근 「환경오염피해 배상책임 및 구제에 관한 법률」을 통해 환경피해 구제를 위한 개별적 환경책임법제를 마련하였으나 이와 관련하여 검토해야 할 많은 문제들이 있다. 이 논문에서는 미국의 환경책임과 환경정화조치와 관련된 연방법 「종합환경대응배상책임법(CERCLA)」과 「자원보존복구법(RCRA)」 및 판례를 살펴봄으로써 한국의 환경책임 규제, 배상책임 요건 및 책임분배, 환경책임보험에 관한 정책적 시사점을 제시하였다.
미국 연방법 「종합환경대응배상책임법(CERCLA)」은 잠재적인 책임당사자의 범위를 정하여 엄격책임, 연대책임, 소급책임을 부과하고 배상자력 확보를 강제하고 있다. 한편 심각한 환경오염정화대상에 대해서는 슈퍼펀드를 운영하여 오염정화 비용을 충당하고 차후 잠재적 책임당사자로부터 환수한다. 「자원보존복구법(RCRA)」은 ‘요람에서 무덤까지 시스템’을 마련하여 연방정부가 유해폐기물의 배출시점부터 폐기시점까지 엄격하게 규제 · 집행하며, 관련 사업자 및 당사자에게 엄격한 폐기물 관리요건과 배상책임을 부과하고, 배상자력 확보를 강제하고 있다. 즉, 배상책임 규제와 관련해서 환경청EPA에게 강력한 집행권을 부여하고 행정형벌 등의 엄격한 행정제재를 규정하고 있으며, 관련 사업자 및 당사자에게는 폭넓은 고지의무와 공개의무를 규율하고 시민참여를 보장함으로써 절차적 정당성을 확보한다. 또한 책임당사자의 범위를 매우 광범위하게 규정하고 엄격책임, 연대책임, 소급책임을 인정함으로써 배출로 인한 환경오염에 대해 경각심을 극대화하고 있다.
인과관계의 입증책임과 관련해서 미국은 오염이 현존하기만 하면 원고는 잠재적 책임자들에 대하여 입증책임을 부담하지 않고, 책임자들은 소급하여 연대책임을 진다. 과소기여자의 경우 질적으로 경미할 때에는 책임에서 제외해주고 있으며, 판례로써 ‘시장점유율에 따른 분배책임방안’을 인정한다. 우리나라의 경우 입증책임을 개연성이론에 따르고 있어서 사법구제를 통한 환경책임의 구현이 쉽지 않고 과소기여자의 책임분배 등에 대한 해석상의 문제가 남아있으므로, 미국의 관련 규정과 판례는 우리에게 시사하는 바가 클 것이다.
마지막으로 환경책임보험의 보장범위와 관련해서 미국은 초기에는 보험자의 위험 평가 및 인수능력에 대한 우려로 인해 점진적 · 누적적 오염사고를 보장하지 않았으나 법률을 통해 환경오염에 따른 배상책임을 강조하고, 법원의 입법취지를 고려한 적극적 해석으로 인해 지금은 점진적 · 누적적 오염사고까지 보장하고 있다. 현재 우리나라는 우발적 · 돌발적 사고에 대한 규정만을 반영하고 있는데, 환경보험의 취지가 실질적으로 달성될 수 있도록 입법으로써 보험의 보장범위를 확대할 필요가 있다.
Although Korea has prepared a legislative system for environmental liability for environmental damage and relief via ‘the Act on Liability For Environmental Damage And Relief Thereof’, there are still various relevant concerns to be reviewed. This paper suggests policy implications on environmental liability regulations, compensation liability requirement and distribution of responsibility, and environmental liability insurance by reviewing ‘the Comprehensive Environmental Response, Compensation, and Liability Act (CERCLA)’ and ‘the Resource Conservation and Recovery Act (RCRA)’ as environmental liability and environmental cleanup measures-related US federal laws and cases.
The US federal law ‘CERCLA’ sets the range of Potentially Responsible Parties (PRP) with strict liability, joint liability, and retroactive liability, and imposes financial responsibility. When it comes to the National Priorities List, the US has operated ‘SuperFund’ to clean up a contaminated site until the PRP eventually assume financial responsibility for the cleanup cost. On the other hand, RCRA employs the so-called ‘Cradle to Grave’ system for the US federal government to strictly regulate and enforce proper hazardous waste treatment from generation to disposal. In other words, CERCLA and RCRA stringently empower EPA regarding compensation liability and regulate administrative sanction including administrative punishment. In addition, it imposes stringent recordkeeping and reporting requirements on relevant parties, and guarantees civil participation to secure procedural legitimacy. Regulation on a wide range of PRP with strict, joint, and retroactive liabilities promotes the awareness regarding environmental pollution.
As for the burden of proof, plaintiff does not bear the burden of proof to PRP if pollution exists, and the PRP has joint and retroactive liabilities. When it comes to small contributor, they can be exempt from liability for cleanup cost if it is a minuscule amount of waste to the site, and court has accepted the market share liability theory. Since Korea has accepted ‘the probability theory’ which makes it difficult to impose environmental liability through judicial remedy, and concerns regarding the interpretation of small contributors’ liability distribution still remain. As such, the US legislations and cases would provide further suggestions to us.
Finally, regarding environmental liability insurance and its coverage US insurance companies initially did not cover gradual and accumulated pollution accidents because of concerns on risk evaluation and acceptability. However, due to emphasis of compensation liability for environmental pollution under CERCLA and RCRA, and court’s interpretations considering legislative purpose, they began to cover gradual and accumulated pollution accidents. Though Korea currently reflects only sudden and accidental pollution accidents, it should extend the insurance coverage via legislation in order to pragmatically achieve the intent of environmental insurance.
