위법비용의 소득과세 방안에 관한 연구- 한국・미국・독일・일본 입법례의 비교분석을 중심으로 - = A Study on the Deductibility of Illegal Expensesin Income Taxation

본 연구는 위법비용에 대한 소득과세방안을 모색하기 위한 것인바, 그 연구결과는 다음과 같다.
첫째, 뇌물 등은 손금불산입하나 이를 업무무관비용으로 취급하는 것은 타당하지 않고 오히려 부정행위 등에 대한 지출의 하나로서 통합하여 취급하는 것이 타당하다. 외국공무원에게 공여한 뇌물 역시 손금불산입하여야 하고, ‘뇌물공여에 소요되는 비용 또는 그 공여에 의하여 발생하는 손실액’에 대하여서도 뇌물과 함께 손금불산입하여야 한다.
둘째, 벌금 및 과료는 동일하게 취급하여 손급불산입하고 이에는 통고처분에 따른 벌금 또는 과료에 상당하는 금액 역시 포함되어야 한다. 세법상으로 과태료는 벌금 및 과료와 동일하게 취급할 필요가 있으나 가산금과 체납처분비는 별도로 구분되어야 한다. 몰수 또는 추징의 손금산입 여부는 정책적 결단에 속하는 것이나 현행 판례의 입장이 유지되는 것이 바람직하다. 외국 또는 그 지방공공단체가 부과한 벌금 또는 과료에 대하여서는 형사절차에서 확정된 것임을 요구하는 것이 타당하다. 외국의 형사절차에서 벌금 또는 과료가 확정된 행위 또는 그와 유사한 행위에 대하여 우리의 형사절차에서도 벌금 또는 과료가 확정되었다면 외국 형사절차에서 확정된 벌금 또는 과료는 손금에 산입하는 것이 타당하다. 외국정부 또는 그 지방공공단체에 의하여 부과한 과태료는 손금에 산입하는 것이 타당하다. 벌금 등의 개념에 벌금과 유사한 벌칙을 포함시키는 것은 타당하지 않다.
셋째, 과징금 등을 포함하는 ‘법령상 의무의 불이행 또는 금지ㆍ제한 등의 위반에 대한 제재로서 부과되는 공과금’에 대하여 손금에 불산입하는 현행 입장은 유지되어야 한다. 또한 과징금이 제재를 넘어서 부당 이익의 환수 역시 의도한 것이라면 그 환수부분을 손금에 산입할 여지는 있다. 다만 우리 법령상 과징금 등이 부과될 수 있는 경우에 한하여 외국정부 또는 그 지방공공단체가 부과한 과징금 등이 손금불산입될 수 있다고 보아야 하고, 외국의 법령 위반을 이유로 과징금 등 공과금이 부과된 행위 또는 그와 유사한 행위에 대하여 다시 우리의 법령 위반을 이유로 과징금 등 공과금이 부과된다면 외국에서 납부된 과징금을 포함하는 공과금은 손금에 산입하는 것이 타당하다.
넷째, 징벌적 손해배상금과 관련하여서는 원칙적으로 전체 손해배상금의 3분의2에 해당하는 금액에 대하여 손금불산입하고 납세의무자가 실손해액을 초과하여 지급한 금액을 입증하는 경우에는 그 초과금액에 대하여 손금불산입하는 것이 타당하다. 다만 징벌적 손해배상소송의 제기 전 단계에서 화해함에 따라 지급하는 금액은 전액 손금산입하는 것이 타당하다. 우리의 법령에 따라 징벌적 손해배상금이 부과될 수 있는 경우에 한하여 외국에서 납부한 징벌적 손해배상금이 손금불산입될 수 있고, 외국에서 징벌적 손해배상금이 부과된 행위 또는 그와 유사한 행위에 대하여 다시 우리의 법령에 따라 징벌적 손해배상금이 부과된다면 외국에서 납부된 징벌적 손해배상금은 손금에 산입하는 것이 타당하다. 한편 업무와 관련하여 고의 또는 중대한 과실로 타인의 권리를 침해한 경우에 지급되는 손해배상금을 손금에 산입하지 않는다는 소득세법 제33조 제1항 제15호는 삭제되는 것이 타당하다.

This paper explores mainly legislative policies on the income taxation of illegal expenses, the results of which are as follows.
First, bribes shall not be included in deductible expenses. Bribes are classified not into non-business expenses but into one of illegal expenses which may belong to business expenses or not. Bribes under “the Act on Combating Bribery of Foreign Public Officials in International Business Transactions” shall not be included in deductible expenses. And expenses or loss incurred in provision of bribes shall not be included in deductible expenses as well.
Second, Fines and minor fines are of an character as non-deductible item, in which fines from disposition notice by tax authorities shall be included. Administrative penalty shall be treated in the same manner as fines or minor fines, but differently from surcharges or disposition fees for arrears. It belongs to choices in tax policies whether confiscation or additional collection be deductible or not, but, under the current decisions by the Supreme Court, confiscation or additional collection may as well be included among deductible items. Fines or minor fines by a foreign government or foreign local government shall be imposed through criminal procedures. Fines or minor fines by a foreign government or foreign local government shall be deductible if our government also imposes fines or minor fines on the same or similar behaviors. Administrative penalties by a foreign government or foreign local government shall be deductible. The concept of “penalties similar to fines” is unnecessary in respect of deductibility of illegal expenses.
Third, “public charges imposed as sanctions for non-performance of duties, or a violation of any of prohibitions or restrictions imposed under Acts and subordinate statutes” includes civil penalties. Civil penalties shall not be deductible in the same manner as the current “Corporate Tax Law” and “Individual Tax Law”. And if civil penalties include not only the sanction, but also the restitution of unjust enrichment, the part of restitution may be deductible. But civil penalties by a foreign government or foreign local government shall not be deductible only if our government can also impose fines or minor fines on the same or similar behaviors. And if civil penalties are imposed by our government and a foreign government or foreign local government, the latter civil penalties may as well be deductible.
Fourth, the 2/3 of punitive damages shall not be deductible unless taxpayers establish the real damages in case of which the excess of real damages shall not be deductible. But settlement payment before final decisions by court may as well be deductible. Punitive damages based on foreign laws and subordinate statutes shall not be deductible only if our laws and subordinate statutes can also impose punitive damages on the same or similar behaviors. And if punitive damages are payed based on our laws and subordinate statutes and foreign ones, the latter punitive damages may as well be deductible. “Compensation for damage to be paid by infringing another person's right on purpose or by gross negligence in connection with business” may as well be deductible in the Individual Tax Law. Therefore, Article 33 of the current Individual Tax Law should be amended.
Fifth, non-deductible illegal expenses shall not be included in the acquisition costs of relevant assets.
Sixth, legitimate defense costs against every kind of sanctions mentioned above shall be deductible, irrespective of deductibility of the sanctions.
Seventh, the deductibility of expenses shall not be denied only because they are against a sharply defined public policy. It would be appropriate to introduce the general provision which declares that tax base should be determined irrespective of legality under relevant laws and subordinate statutes other than tax laws and subordinate statutes.
