양심적 병역거부에 관한 법철학적 고찰 ― Ronald Dworkin의 법철학을 중심으로 ― = A Study on Conscientious Objection to Military Service from the Perspective of Legal Philosophy ― Focusing on the Perspective of Ronald Dworkin’s legal Philosophy ―

오늘날 사회 속에서 다양한 이념과 가치들이 상충함으로 인하여 때로는 실정법이나 개별 정책을 수용하지 못하는 소수자들이 나타나서 사회적 문제가 되기도 한다. 우리나라에서 큰 이슈가 되었던 사례로 양심적 병역거부 사건이 있었다. 2004년 양심적 병역거부와 관련된 대법원 판례와 헌법재판소 결정이 연이어 등장하게 되면서 양심적 병역거부 문제에 대한 본격적인 토론의 기회가 제공되었다. 양심적 병역거부 사건과 같이 특정 정책이나 관련 법률이 개인의 내적 확신에 따른 도덕적 양심과 충돌하는 사건의 경우에 해당 정책이나 법률규정이 정책적으로 불가피한지의 여부를 넘어, 자연법이나 정의의 원리 등에 위반하였는지에 관한 근본적인 검토가 필요하다. 이러한 점에서 “양심적 병역거부는 정당한가?”라는 물음은 필연적으로 자연법(自然法)ㆍ도덕률(道德律)ㆍ정의와 형평의 원리ㆍ최상의 구성적 법해석(the best constructive interpretation of the law)과 같은 법철학에 대한 근본적인 물음으로 나아가게 된다.
본 연구에서는 먼저 양심적 병역거부와 관련하여 대법원의 판결례들과 헌법재판소의 결정례들을 살펴본다. 그 다음 법실증주의 및 자연법론의 대립적인 두 관점에서 양심적 병역거부를 살펴본다. 먼저, 법실증주의 입장인 하트의 관점에 의하면 한반도의 특수한 안보현실에서 양심상의 이유로 병역을 거부 할 때에 발생하게 되는 병역의무 이행의 불가피한 문제점 등을 감안하여 사회 구성원들이 양심적 병역거부에 대한 내적 승인이 이루어졌다고 보는 것이 시기상조라고 볼 여지가 많다. 반면, 드워킨의 자연법론 입장에서는 양심적 병역거부 사안과 같이 개인의 정신적 자유와 국가공동체의 의무가 서로 충돌하는 경우 단순히 정책적 불가피성을 이유로 개인의 희생을 정당화하는 등의 사법적 재량을 행사하는 것은 옳지 않으며, 법률조항과 도덕적 원리에 대한 올바른 믿음을 기반으로 개인의 권리를 최대한 존중하는 관점에서 관련 규정을 해석하는 것이 마땅하다고 본다.
도덕성에 근거한 시민불복종의 관점에서 양심적 병역거부를 살펴본다. 먼저, 롤즈의 관점에서 양심적 병역거부라는 행위는 우리나라의 특유한 안보상황에서 국가안보라는 중대한 공익과 배치된다는 점에서 롤즈가 제시하는 ‘공공성의 원칙’이나 ‘공익성의 원칙’을 갖추었는지 여부가 명확하지 않다는 등의 문제점을 지니고 있는바, 양심상의 이유로 병역이행을 거부하는 행위가 정당화되지 아니할 가능성이 크다고 할 수 있다. 반면, 드워킨의 시민불복종이론의 관점에서는 개인의 내적 확신에 따른 개인의 양심과 종교의 자유는 사법적 판단을 함에 있어서도 가장 우선적으로 고려하여야 할 최고의 으뜸패(triumph)로 간주되는 만큼, 특정한 병역의무의 부과 시 개인의 내적 도덕성에 근거하여(integrity-based) 그에 대한 이행을 거부하는 행위도 정당한 것으로 봐야 한다는 입장으로 볼 수 있다.
마지막으로, 해석적 실천으로서의 정의의 관점에서 우리 사회가 양심적 병역거부자에 대한 이해와 관용을 보일 정도로 성숙하였는지에 관하여 살펴본다. 병역법 법규정을 해석함에 있어서도 단순히 그 규칙들의 문언에만 충실할 것이 아니라, 병역법의 입법목적과 해당 규정이 추구하는 궁극적인 법원리에 대한 근본적인 성찰의 자세가 필요하다. 양심적 병역거부 사건의 경우에도 양심적 병역거부자의 고뇌와 갈등상황을 외면하고 그대로 방치할 것이 아니라, 이들을 어떻게 배려할 것인가에 관하여 상위의 법원리에 비추어 그에 대한 온당한 해결책을 찾아야 할 때가 되었는지 끊임없이 성찰하여야 할 것이다.
결론적으로, 양심적 병역거부와 관련된 대법원의 판결들이나 헌법재판소의 결정들은 모든 남성들에게 병역의무의 이행을 일방적으로 강제하기만 할 뿐, 사회적 소수자인 양심적 병역거부자들의 양심의 자유와의 심각하고도 고독한 갈등관계를 해소하여 사회의 통합을 도모할 진지한 노력은 부족하였다고 생각된다. 따라서 이상의 여러 법철학적 관점들을 종합하여 우리 사회가 더 이상 정책적 불가피성을 이유로 양심적 병역거부자들을 외면할 것이 아니라, 보다 높은 법이상과 법원리에 비추어 양심적 병역거부자들이 처한 갈등관계를 해소하여 진정한 사회통합을 이루기 위하여 최선의 노력을 다 해야 할 것이다.
Today, due to the conflict of various principles and values, minorities who cannot accept positive laws or specific policies sometimes emerge to become major social problems. One example of a major issue in South Korea was conscientious objection to military service. In 2004, cases in the Supreme Court and the decisions of the Constitutional Court regarding conscientious objection led to the opportunity for debate on this and related issues. In incidences where a particular policy or social system conflicts with the personal conscience of an individual's internal convictions―such as in cases of conscientious objection to military service―it is necessary to review not only whether the policy or legal provision is inevitable, but also whether it violates the principles of natural law or justice. In this aspect, the question, “Is Conscientious Objection to Military Service is Justified?” leads us to the fundamental question of legal philosophy―that of which is inevitably related to natural law, morality, the principle of justice and equality, as well as the best constructive interpretation of the law.
This study first examines the decisions of the Supreme Court and the cases of the Constitutional Court concerning conscientious objection to military service. It then examines conscientious objection to military service from the two opposing views of positivism and natural law. Firstly, according to Hart's argument regarding legal positivism, and in view of the inevitable problems of military service obligations that arise when military service is rejected for reasons of conscience in the special security context of the Korean Peninsula, it is too early for the members of society to have endorsed internal consent for conscientious objection. However, Dworkin's view of natural law is that it is wrong to exercise judicial discretion―such as justifying individual sacrifice―on the grounds of policy inevitability when the individual's mental freedom and obligations of the national community are in conflict with each other. Based on the belief of rights in legal provisions and moral principles, it is desirable to interpret the relevant provisions from the perspective of respecting the rights of individuals as much as possible.
Next, we examine the conscientious objection from the standpoint of integrity-based civil disobedience. From Rawls' point of view, conscientious objection is against the public interest of national security in the peculiar security situation of Korea, and it is not clear whether this is a case of ‘the principle of publicity’ or ‘the principle of public interest’ as Rawls has suggested. Therefore, it is highly likely that the act of refusing to perform military service is not justified by conscientious objection. However, from the position of Dworkin's theory of civil disobedience, the individual's conscience and freedom of religion, in accordance with the internal conviction, are regarded as more important and are considered the highest priority in judicial judgment. Consequently, it can be seen that the integrity-based act of rejecting a certain military obligation should be judged as justified on the basis of the individual's internal morality.
Finally, we examine whether our society is mature enough to understand and tolerate conscientious objectors in terms of justice, as an analytical practice. In interpreting the legal provisions of the case provided for by the Military Service Act, it is necessary to be faithful to the meaning of the rules, and also fundamentally reflect on the purpose of the military service law and the ultimate legal purpose pursued by its provisions. In the case of conscientious objection, we should constantly reflect on how it is time to look for a reasonable solution to the issue in light of the higher legal philosophy at hand.
In conclusion, the decisions of the Supreme Court or the Constitutional Court relating to the conscientious objection to military service merely unilaterally impose the enforcement of military service obligations for all men. Moreover, the serious effort necessary to solve the conflict and integrate society is lacking for the social minority of conscientious objectors. By combining the aforementioned arguments, conscientious objectors can no longer be ignored on the grounds of political inevitability. Therefore, we should do our best to solve the conflicts of conscientious objectors in light of both higher law and the principles of law.
