Abstract: This essay aims to examine the special law relationship of the National Cemetery Law to the Funeral Law from a legislative perspective and suggest an alternative that can simultaneously satisfy the purposes of the two laws. To this end, the researchers, based on previous studies, study the discourse on the change of the consciousness regarding funerals along with the formation and development process of the Funeral Law and discuss the status as a special one of the National Cemetery Law to the Funeral Law and the relationship supplemented from the latter by comparing the provisions of the two laws. It is confirmed that the expansion of natural burial grounds in the National Cemetery is the best way to meet the legislative purpose of the National Cemetery Law and the Funeral Law Act altogether, pursuing the public interest. This study has a meaning in being an attempt to integrate the National Cemetery Law and the Funeral Law given that the two are observed respectively under the jurisdiction of the Ministry of Patriots and Veterans Affairs and the Ministry of Health and Welfare, and Korea’s national cemeteries, classified as Memorial Park (Hyunchungwon), Democratic Cemetery including Seonyeol Park, and Patriotic Park (Hogukwon), are supposed to meet the legislative purposes of the Funeral Law, such as health and sanitation and the efficiency of the use of the land.

‘국립묘지법’과 ‘장사법’의 법적 관계에 대한 시의적 해석전 명 길*ㆍ이 건 근**

연구 목적: ‘국립묘지법’의 ‘장사법’에 대한 특별법적 관계를 입법론적인 관점에서 고찰하여 두 법이 지향하는 목적을 동시에 만족할 수 있는 대안을 제시하는 것이다.
연구 방법: 선행연구에 기초하여 ‘장사법’의 형성･발전과정과 함께 장사의식의 변화에 대한 담론을 살핀 다음, ‘국립묘지법’과 ‘장사법’의 조문을 비교 분석하여 전자의 특별법적 지위와 후자로부터 보완되는 관계를 논한다.
연구 내용: 국립묘지 내 자연장지 확대가 ‘국립묘지법’과 ‘장사법’의 공익적 입법 취지를 동시에 충족할 수 있는 최선의 방안임을 확인한다.
결론 및 제언: 그동안 ‘국립묘지법’과 ‘장사법’이 각각 국가보훈처와 복지복지부 소관 하에 분리되어 운영된 가운데 현충원, 민주묘지와 선열공원, 호국원으로 분류된 상태에서 ‘장사법’의 보건위생과 국토 이용의 효율성이라는 입법 취지를 최대한 충족해야 하는 상황에서 이를 통합적으로 논한 시도라는데 의의가 있다.
