인구감소와 지방소멸에 대한 법적 대응 = Legal action against population decline and local extinction

국문 초록 (Abstract)

우리나라는 6.25. 전쟁 후 폭발적인 인구성장이 이루어져 오는 가운데 1960년대부터 1990년대까지 산아제한 정책을 펼쳐왔다. 지방은 일자리 부족, 기반시설 미흡, 자본 미흡 등으로 농촌인구와 소도시 인구가 대도시와 수도권 지역으로 집중현상이 이루어져 왔다. 우리나라는 2020년을 정점으로 2021년에 인구감소가 이루어지기 시작하였고, 2023년에는 0.72명으로 세계에서 가장 낮은 저출산 국가가 되었고, 조만간 초고령사회가 될 것이다.
정부는 저출산고령사회기본법, 지방분권균형발전법, 인구감소지역지원법 등을 제정하여 지역균형발전을 꾀하고, 지역의 인구감소와 지역소멸을 대응하는 법정책을 마련하고 있다. 그러나 우리나라의 지방에서는 아기 울음소리가 그친 곳이 많이 속출하고 있고, 저출산 고령사회로 인한 세대 간의 조세 및 사회보장비 부담의 형평성이 문제가 되고 있을 뿐만 아니라 지방자치단체에서는 사회복지비의 부담이 가중되고 있다.
이 논문에서는 인구감소과 지역소멸대응에 관한 우리나라의 법제현황을 분석한 후, 인구감소대응법은 다수 존재하나 지역소멸대응에 관한 일반법이 존재하지 않으므로 지역활성화(지역재 생)법의 제정방안을 제시한다. 또한 이민장려가 인구감소 및 지방소멸대응을 위한 근본적인 대책인 아니나 호주, 미국, 프랑스등의 국가에서 유연한 지방 이민정책으로 추진이 인구증가의 주요한 요인이 되고 있으므로 지역주도의 지방이민에 관한 제도를 강구한다. 또한 유럽의 경우 도시가 스마트도시로 조성된 경우에는 인구가 집중되는 현상이 일반적이고, ICT융합기술에 의한 사회기반시설이 낙후된 도시나 농촌지역에서의 인구감소현상이 이루어지므로 인구감소지역의 도시내에 스마트도시조성 문제를 검토한다. 또한 인구감소와 지역이 소멸된 경우 현재와 같이 도시를 지속적으로 확장하여 조성할 필요가 없으므로 컴팩트도시(압축도시)를 조성을 위한 입지적정계획제도의 도입문제를 검토한다. 또한 인구감소지역법에 의한 도입된 생활인구의 지원에 대한 활용범위 확대와 관계인구의 개념과 요건을 검토하고, 인구감소와 지역소멸을 대응하기 위하여 기업판 고향사랑기부세 도입문제를 검토한다.
끝으로 인구감소와 지역소멸을 대응하기 위하여 금전적 지원만으로 해결할 수 없으므로 헌법상 보장된 결혼과 가족공동체의 제도적 보장구현, 살기 좋은 지방환경과 인프라구축, 충분한 일자리 마련과 소득보장, 교통 및 교육, 문화, 의료 등의 접근성 보장하여 수도권과 지방이 살기 좋은 동등한 생활환경을 조성하도록 하는 헌법의 개정이 마련되었으면 하는 바람이다.

Korea has been implementing a policy of restricting birth from the 1960s to the 1990s amid explosive population growth after the Korean War. In the provinces, the rural population and the population of small cities have been concentrated in large cities and metropolitan areas due to lack of jobs, infrastructure, and capital. Korea's population began to decline in 2021 after peaking in 2020, and in 2023, it became a country with the lowest birth rate in the world at 0.72, and will soon become a super-aging society.
The government has enacted the Framework Act On Low Birth Rate In An Aging Society, the Special Act on Local Autonomy Decentralization and Balanced Regional Development, and the Special Act On Support For Depopulation Regions to promote balanced regional development and to prepare legal policies to cope with population decline and local extinction. In Korea, there are many places where baby cries have stopped, and the equity of the burden of tax and social security costs between generations is a problem due to the low birth rate and the aging society, and the burden of social welfare costs is increasing in local governments.
In this paper, after analyzing the current status of Korea's legislation on population decline and regional extinction response, we propose a plan to enact the Regional Revitalization (Regional Revitalization) Act since there are many population decline response laws, but there is no general law on regional extinction response. In addition, although encouraging immigration is not a fundamental measure to respond to population decline and regional extinction, the promotion of flexible local immigration policies in countries such as Australia, the United States, and France is becoming a major factor in population growth, so a regional-led local immigration system must be devised. do. In addition, in the case of Europe, when a city is created as a smart city, it is common for the population to concentrate, and as the population decreases in cities or rural areas with underdeveloped social infrastructure due to ICT convergence technology, cities in population-decreasing areas We review the issue of smart city creation within the city. In addition, when population decreases and regions disappear, there is no need to continuously expand and create cities as is currently the case, so the issue of introducing an appropriate location planning system to create a compact city (compressed city) is reviewed. In addition, we examine the expansion of the scope of use of the living population support introduced by the Depopulation Area Act and the concept and requirements of the related population, and review the issue of introducing a corporate hometown love donation tax to respond to population decline and regional extinction. Lastly, since population decline and regional extinction cannot be resolved through financial support alone, implementation of institutional guarantees for marriage and family community guaranteed under the Constitution, establishment of a livable local environment and infrastructure, provision of sufficient jobs and guaranteed income, transportation, education, and culture. I hope that the Constitution will be amended to create an equal living environment in the metropolitan area and local areas by guaranteeing accessibility to medical care, etc.
