이른바 ‘준연동형비례대표제’와 ‘사회적 참사법’ 입법과정의 위헌성에 대한 소고— 신속처리의안의 문제점과 수정안의 한계를 중심으로 — = A Study on the Unconstitutionality of the So-called ‘Quasi-linked Proportional Representation’ and ‘Social Disaster Law’ Legislative Process - Focusing on the Problem of Expeditious Processing and the Limits of Amendment Bill -

The swift handling of the agenda was introduced in the National Assembly Act as part of the National Assembly Advancement Act on May 25, 2012, and was expected to resolve the issue of designating the date of review by the chairman, which has been problematic. Without the actual case, we would end up with academic discussions, but we already have two cases. One is Special Law for the humidifier disinfectants, and the sinking of Sewol ferry and the case and another legislation on so-called (Hey, not at night) between political forces of the extreme conflict.Some election law revision to the Act that are type with a proportional representation inside. Both parties suffered from noise throughout the legislative process due to extreme conflicts between political forces and conflicts of values, and their negligence or omission of the deliberation of their respective standing committees precludes the right to review and vote by standing committee members, and have common ground that the revision bill was passed, not by the original bill, at the plenary session of the National Assembly.
As the revision bill to the plenary session allows almost unlimited revision, even though it is explicitly stipulated in Article 95 of the National Assembly Act, a very abnormal form of legislation that omits the legislative process of the subcommittee and the legislative process of the judiciary committee's system and self-help screening is being carried out and the pros and cons of the plenary session is being voted on.
In the case of a “special bill aimed at uncovering the truth behind social disasters and building a safe society,” the key point is the composition of the committee. Given that the committee's decision was made by a majority democracy, the nine-member panel was changed to favor the ruling party by 5:4 in the original bill, while the five-member standing committee was also changed to 2:3 in the original bill, but the ruling party's share was 3:2 in the revision. In addition, data requests for ‘criminal trials’ cases that did not exist in the original version were made possible in the revision. It can be judged as an amendment that has inherent differences between the original and the amendment and is beyond the purport and content of the original.
The difference between the original plan and the revision bill is even more serious in the case of some revision of the “public election law” related to the so-called quasi-linked proportional representation system. The main contents of the revision to the extent that the original plan is not deviated from the purpose and content of the bill are the downgrading of the age of 18 in the electoral district and the “democratic process” of recommending candidates for proportional representation. In the case of allocating 300 lawmakers to local constituencies and proportional representation seats, the original bill is the same as that of local constituencies and proportional representatives under the Public Official Election Act before submitting the original bill to 225 for local constituencies, 75 for proportional representation, and 47 for proportional representation. The change is part of the original plan, which constitutes the core of the original plan, and the revision is clearly a departure from the scope of the original plan's revision with a substantial backlash from lawmakers in their constituencies. The success rate system and the list of candidates for proportional representation seats in six districts were also key to the original bill, but all of them were deleted from the revised bill. In addition, only the 21st general election of the National Assembly, which was held on April 15, 2020, was modified to link some seats, not all seats. This also clearly violates the intent of introducing an interlocking proportional representation system in the original plan.

안건의 신속처리는 2012년 5월 25일 일명 국회선진화법의 일환으로 국회법에 도입되었고 그간 문제되었던 의장의 심사기일 지정(직권상정) 문제를 해결할 수 있으리라 기대와 함께 우려도 공존했다. 실제 사례가 없었다면 학문적 논의에 그치고 말 것이지만, 우리에게는 이미 2개의 사례가 존재한다. 하나는 세월호 및 가습기 살균제 사건을 위한 특별법이고 또 다른 하나는 정치세력 간(단순히 여・야간이 아니라)의 극단적 대립을 입법화 한 이른바 준연동형비례대표제로 표현되는 공직선거법 일부개정법률안이다. 양자 모두 정치세력 간 극단적 갈등과 가치관의 충돌로 입법과정 내내 잡음에 시달렸고, 소관 상임위원회 심의가 소홀하거나 생략되어 상임위원의 심의・표결권이 배제되고, 국회 본회의에서 원안이 아니라 수정안이 통과된 공통점을 가지고 있다.
본회의 수정안은 원안의 취지와 내용과 직접적인 관련이 있어야 함을 국회법 제95조에서 명시적으로 정하고 있음에도 거의 무제한의 수정을 허용함에 따라 소관 상임위의 입법과정과 법사위의 체계・자구 심사라는 입법과정을 생략하고 본회의에서 표결을 거쳐 찬반만을 가리는 매우 비정상적인 입법의 형태가 진행되고 있다.
‘사회적 참사의 진상규명 및 안전사회 건설 등을 위한 특별 법안’의 경우 핵심이 위원의 구성이다. 위원회의 의사결정이 다수정 민주(majority-rule)로 이루어짐을 감안할 때 총 9인의 위원정수가 원안에서는 여당 몫: 야당 몫이 3:6이었으나 수정안에서는 5:4로 여당에 유리하도록 변경되었고, 총5인의 상임위원정수도 원안에서 여당 몫: 야당 몫이 2:3이었으나 수정안에서는 3:2로 여당에 유리하게 변경되었다. 또한 원안에는 존재하지 않던 ‘형사재판 진행중’인 사건에 대한 자료요구도 수정안에서는 가능케 하였다. 법률안의 원안과 수정안에 본질적인 차이가 존재하고 원안의 취지와 내용을 벗어나는 수정안으로 판단할 수 있다.
이른바 준연동비례대표제 관련 ‘공직선거법’ 일부개정법률안의 경우는 원안과 수정안의 차이가 더욱 심각하다. 원안의 취지와 내용을 벗어나지 않은 정도의 개정에 대한 주요 내용은 선거권 연령의 18세 하향과 비례대표후보자 후보자 추천의 ‘민주적 절차’뿐이다. 300인 국회의원을 지역구와 비례대표의 정수 배분의 경우도 원안은 지역구 225명, 비례대표 75명이나 수정안은 지역구 253명, 비례대표 47명으로 원안 제출 전 공직선거법상 지역구와 비례대표 국회의원의 정수와 동일하다. 이에 대한 변경은 원안의 핵심을 구성하는 부분으로 지역구 국회의원들의 실질적 반발에 의한 수정안으로 수정은 원안의 수정 범위를 명백히 일탈한 것이다. 석패율제와 6개 권역별 비례대표국회의원 후보자 명부의 경우도 원안의 핵심을 이루는 것이었으나 수정안에서는 모두 삭제되었다. 또한, 비례대표 의석의 연동의 경우도 2020년 4월 15일 실시하는 제21대 국회의원 총선거만 특별히 모든 의석의 연동이 아닌 일부 의석의 연동으로 수정하였다. 이 또한 원안의 연동형비례대표제 도입의 취지를 명백히 위반하는 것이다.
