미시시피 항해권과 핑크니 조약: 워싱턴 행정부의 대응을 중심으로 = The Rights of Navigation of the Mississippi and The Pinckney’s Treaty in 1795: Focus on the Washington Administration’s Responding

1795년 워싱턴 행정부는 스페인과 강화, 제한, 항해조약(Treaty of Friendship, Limits, and Navigation Between Spain and the United States)을 체결했다. 핑크니 조약(The Pinckney’s Treaty)으로 알려진 이 조약으로 인하여 미국은 1784년 이후부터 금지되었던 미시시피 강의 항해가 가능해지게 되었다. 기존 외교사가들은 스페인이 미국과 핑크니 조약을 체결한 이유로 미국과 영국이 동맹을 맺을 것을 우려했다는 시각과 프랑스, 스웨덴과 1795년 6월 22일 맺은 ‘바실레아 조약(Peace of Basilea)’ 때문에 영국의 복수가 두려워 스페인이 미국과의 관계를 개선해야겠다는 생각에 이르게 되었고 결국 미국과 조약을 체결해 미국에게 미시시피 항해권을 허용한 것이라고 보았다.
하지만 미국 내부적으로 스페인과 조약을 맺어 미시시피 항해권 문제를 해결해야 하는 이유가 있었다. 서부 정착민들은 동부로 가는 육로와 연결되어 있었을 뿐 아니라 아니라 서부 땅에서 나오는 물건을 교환하여 현금을 얻을 수 있는 기회를 제공해주는 뉴올리언스로 가기 위해서는 미시시피 강을 통과해야 했다. 1784년 스페인이 미시시피 항해권을 주장하며 미국인들에게 미시시피 항해권을 금지한 이후 서부 정착민들은 지속적으로 연합의회와 연방정부가 이 문제를 해결해 주기를 바랐다. 서부 정착민들의 기대와 달리 연합의회는 통합적이고 효율적인 외교권한이 없었기 때문에 이 문제를 해결하지 못했고 워싱턴 재임 1기 초반에는 행정부서를 만들고 정비하는데 시간을 보냈기 때문에 이 문제를 해결하지 못했다.
또한 워싱턴 재임 1기에 워싱턴 대통령은 북서영지의 오하이오 강의 문제를 먼저 해결하느라 미시시피 항해권 문제를 적극적으로 해결하려는 모습을 보이지 않았다. 독립 직후 오하이오 강 주변에는 영국군이 주둔지에서 철수하지 않고 있었으며 영국의 지원을 받는 인디언들은 오하이오 강 주변에 있는 북서영지(The North West Territory)의 정착민들과 갈등을 빚고 있었다. 워싱턴 대통령은 오하이오 강을 미국이 통제해야만 오하이오 강과 미시시피 강을 연결하여 미시시피 항해권 문제를 해결할 수 있다고 생각했다. 1792년 즈음에 북서영지의 문제가 어느 정도 해결되자 켄터키와 테네시 지역인 남서영지 주변에서 발생한 인디언과의 문제와 미시시피 항해권 문제를 해결하겠다는 의지를 1792년 11월에 발표한 연례교서를 통해 보였다.
한편, 서부 정착민들은 미시시피 항해권 문제가 오랫동안 해결되지 않자 켄터키를 중심으로 민주 협회(The Democratic Society)와 같은 정치단체를 만들고 켄터키 가제트(Kentucky Gazette)를 출간해 서부 정착민들의 의견을 결집시키고 미시시피 항해권 문제를 해결하지 않고 있는 연방정부를 비난했다. 또한 당시 연방정부의 소비세법에 대항하여 위스키 반란이 서부지역에서 일어나고 있었고 이 과정에서 서부 정착민들이 외국과의 접촉을 통해 연방에 대항하려는 움직임이 보이자 워싱턴 행정부는 서부 정착민들의 이러한 행동을 막고 연방의 결속을 강화시키기 위해서는 미시시피 항해권 문제를 해결해야 한다고 생각했다. 1794년부터 스페인으로 파견할 대사를 물색했고 1795년 핑크니는 스페인과의 조약을 체결했다. 이로써 서부 정착민들이 오랜 기간 동안 바라왔던 미시시피 항해권 문제는 해결되었다. 따라서 핑크니 조약은 건국 이후 스페인과 발생했던 영토문제를 해결하는 조약임과 동시에 미시시피 항해권을 둘...
In 1795, the George Washington Administration signed the Treaty of Friendship, Limits, and Navigation Between Spain and the United States. With this treaty known as the Pinckney’s Treaty, the United States was able to sail the Mississippi River, which had prohibited by Spain since 1784. Concerning the reasons for Spain’s conclusion of the Pinckney’s Treaty, the existing diplomatic historians noted that it was concerned about the formation of an alliance between the United States and Britain and feared of the revenge of Britain because of ‘Peace of Basilea’ with France and Sweden on June 22, 1795 and reached the idea to improve its relationship with the United States and consequently, concluding a treaty with the United States, it allowed the rights of navigation of the Mississippi River.
However, the United States internally had a reason that it should resolve the problem of the navigation of the Mississippi River, concluding a treaty with Spain. The western settlers, which was connected to the land route to the east, had to pass the Mississippi River to go to New Orleans that would provide a chance to get cash, exchanging goods from the western land. Since Spain prohibited the Americans’ navigation of the Mississippi River, the western settlers continuously asked the Confederation Congress and the Federal Government would solve this problem. Unlike the expectation of the western settlers, the Confederation Congress did not have integrative and efficient diplomatic authorities, so it could not solve this problem, and in the earlier period of the first term of office, President George Washington spent time to establish and maintain the Department of Administration, so he did not solve this problem.
In addition, in the first term(1789~1792), President George Washington did not actively try to solve the problem of the rights of navigation of the Mississippi River to solve the problem of the Ohio River in the Northwestern territory, first. After independence, the British Army did not withdraw from the post near the Ohio River, and Indians supported by Britain had a conflict with the settlers in the Northwestern territory near the Ohio River. President George Washington thought that the United States must control the Ohio River to solve the problem the navigation of the Mississippi River, connecting the Ohio River to the Mississippi River. Around 1792, as the problem of the Northwestern territory was solved to some degree, he showed his will to solve the problem that occurred with Indians near the Southwestern territory and the problem of the navigation of the Mississippi River through an annual message in November 1792.
In the meantime, as the problem of the navigation of the Mississippi River was not settled for a long time, the western settlers established political organizations like the Democratic Society, centering around Kentucky, published Kentucky Gazette to collect the opinions of the settlers in the west and criticized the Federal Government that did not solve the problem of the rights of navigation of the Mississippi River. In addition, at the time, as Whiskey Rebellion took place in the western region against the Federal Government’s Income Tax Act, and in this process, the western settlers showed a movement to resist against the Federation through a contact with foreign countries, the George Washington Administration thought that it had to solve the problem of the navigation of the Mississippi River to prevent this action of the settlers in the west and strengthen the solidarity of the Federation. He looked for ‘a envoy extraordinary and only commissioned plenipotentiary’ to be dispatched to Spain since 1794, and Pinckney signed a treaty with Spain in 1795.
