헌법개정과 국가배상책임의 재구성-과실책임제도에 대한 비판적 검토를 중심으로 = Reformation of the State Liability System and a Proposition for the Constitutional Revision in South Korea - Focusing on the “negligence” requirement

헌법 제29조 제1항은 “공무원의 직무상 불법행위”로 손해를 입은 국민의 국가배상청구권을 기본권의 하나로 인정하고 있으며, 국가배상법 제2조 제1항은 이를 구체화하여 공무원의 ‘고의·과실’에 기한 ‘위법’한 직무집행행위를 국가배상책임의 성립요건으로 요구하고 있다. 이 ‘위법성’과 ‘과실’ 요건을 어떻게 해석하고 그 판단 기준을 어떻게 세울 것인가가 국가배상책임 제도의 구성에 있어서 핵심적인 문제가 된다. 이를 위해서는 헌법 제29조 제1항과 국가배상법 제2조 제1항에 따른 국가배상책임을 먼저 규명할 필요가 있는데, 학자들의 절대다수와 판례는 모두 이를 대위책임이 아닌 자기책임으로 이해하고 있다. 위헌법률심사, 헌법소원, 항고소송 등의 사법제도를 통해 국가의 불법이 심판되고 그에 따른 법적 효과도 직접 국가에 귀속되는 헌법구조에 비추어 볼 때 유독 불법행위책임에 있어서만 그 법적 효과가 직접 국가에 귀속되지 않는다고 볼 이유가 없고, 항고소송 등과 국가배상청구소송 모두 행정주체의 잘못을 따져 그 책임을 묻는 것이라는 점에서 다를 바가 없기 때문이다.
국가배상책임에 관한 대법원판례를 ‘위법성’과 ‘과실’이라는 두 성립요건을 중심으로 유형화하여 검토해 보면 두 가지 문제점이 나타난다. 첫째는 행정처분이 위법하여 항고소송에서 취소되었음에도 그 직무집행이 “객관적 정당성”을 상실하였다고 볼 수 없다는 이유로 국가배상청구소송에서 ‘위법성’ 요건을 부인하는 것으로 의심되는 일련의 판례이다. 항고소송과 국가배상청구소송에서 위법성 판단 기준을 달리하는 것은 행정통제라는 공통의 목적을 고려할 때 선뜻 이해하기 어려우며, 사법작용에 대한 불신의 원인이 된다는 점에서도 문제가 있다. 둘째는 근거법령의 해석, 적용, 포섭, 또는 재량행위에서의 이익형량이 위법하다 하더라도 그에 대하여 공무원의 직무상 과실이 인정되지 않는다고 보는 판례인데, 요구되는 주의의무의 수준을 지나치게 낮게 설정하고 있을 뿐만 아니라 공무원 개개인을 기준으로 주의의무 위반 여부를 판단하는 것이라는 점에서 문제가 있다.
이와 같은 문제를 해결하기 위해서는 ‘공무원’의 ‘과실’이라는 요건을 삭제하고 ‘공무수행상의 하자’ 또는 ‘국가 등의 위법한 공무수행’을 책임의 성립요건으로 하여 국가배상책임의 객관적 성격을 강조하는 것이 중요하다. 아울러 재판작용 등 그 특성상 국가배상책임을 제한할 필요가 있는 일부 행정작용에 대하여는 ‘중대한’ 하자 또는 위법성을 요구하는 등으로 책임의 성립요건을 강화함으로써 ‘위법성(하자)’ 개념을 행정작용의 유형별로 또는 구제수단별로 달리 판단하여 구체적 타당성을 꾀하려는 시도를 차단할 필요가 있다. 헌법 제29조 제1항의 “공무원의 직무상 불법행위”라는 표현을 “공무수행상의 불법”으로 개정한다면 위와 같은 개정에 힘을 실어줄 수 있을 것이며 현행 국가배상법상 ‘공무원의 과실’ 개념을 좀 더 객관적으로 해석하는 계기가 될 수 있을 것이라 기대한다.
Article 29(1) of the Constitution of the Republic of Korea recognizes as one of the fundamental rights the state compensation claim of any citizen who have suffered from an “unlawful action by a public official” for damages against the State or other responsible administrative body (herein after the “State”). Article 2(1) of the State Compensation Act elaborates on this by requiring a public official’s “illegal” performance of duty by “intention or negligence.” How to interpret the “illegality” and “negligence” requirements and what their standards should be are the key questions in establishing the state liability system. To this end, it is necessary to first identify state liability under Article 29(1) of the Constitution and Article 2(1) of the State Compensation Act. Absolute majority of scholars and the precedent agree in construing “public official’s negligence” to mean the State’s direct liability for its own acts, as opposed to vicarious liability for public officials’ tort. This is because our constitutional structure is one in which the State’s unlawfulness is adjudicated through such judicial processes as the adjudication on the constitutionality of statutes, constitutional complaint, and appellate litigation, and the legal effect flowing therefrom is directly attributable to the State. In light of this, there is no reason not to view that the legal effect of tort liability is also directly attributable to the State, and appellate proceedings and state compensation claim do not differ in that both hold the administrative subject accountable for its error.
An analysis of the Supreme Court’s case law on state liability reveals two main issues concerning the illegality and negligence requirements. First, there are a series of cases in which the Court seems to deny the illegality of a disposition on the ground that the pubic official’s performance of duty cannot be deemed to have lacked “objective legitimacy”, even though the same disposition was revoked in an appeal litigation because of its illegality. The differentiation of the standard against which to determine illegality in appellate proceedings and state compensation claim is unpersuasive in view of the common purpose of administrative control, and can be problematic in that it may undermine public confidence in judicial process. Second, there are also cases in which the Court denies any negligence on the part of the public official, even while admitting that there were illegality in the public official’s interpretation, application, and subsumption of the underlying statutory provision or in the weighing and balancing of interests in exercising his/her discretion. This is problematic not only because these cases set the bar too low for the standard of care required, but also because the cases determine whether there was any breach of duty of care from the perspective of individual public officials.
To solve the second problem, it is important to emphasize the objective nature of state liability by requiring only “defect or error in the performance of public duty” or “illegal performance of public duty by the State, ets.”, while removing the “public official’s negligence” requirements. To solve the first problem, it is necessary to set a higher bar for establishing liability by, for instance, requiring a “gross” defect or illegality, for certain types of administrative process, such as judicial trials, which inherently require the limitation of state liability, and by so doing, remove any incentives to set different criteria for judging “illegality (defect)” by different types of administrative process or by different types of remedy, as a means to gain specific legitimacy. Revision of the phrase, “unlawful action by a public official”, as stated in Article 29(1), into “unlawfulness in the performance of public duty” would help set the guidelines for a future revision of the State...
